Congressional.
Washington, Aug. 13.—In the Senate, a
treaty with the Sandwich Islands was under
consideration. Collamer opposed it as uncon
stitutional, on the ground that it contained a
modification of our tariff, which could not be
made by treaty. The subject was postponed
until to-morrow.
The House extended the patent to Adam's
Press. The bill containing legislative judicial
and executive appropriations was returned to
the house amended by the Senate. The house
struck out the Senate’s amendments insisting
on the provision that no expenditure should be
made for the government of Kansas uutil the
Indictments for treason were dismissed.
It is understood that the Oabiuet to-dayi
agreed to. order the discontinuance of those
prosecutions at the request of Gov. Geary.
Treaty with Nicaragua.
Washington, Aug. 13.—The Senate has
ratified a treaty concluded with Nicaragua last
June Just before Walker's advent to power. Its
terms are unusually liberal Also,ratified treaty
with the two Sicilies of the same character.
Also Extradition treaty with the Grand Duchy
of Baden.

By the arrival of the Gov. Dudley off the bar
this morning, we are in possession of some
items, translated from tbe Premade la Uabanu,
Capt. Gen. Concha, has received the title of
Uurquis of Havana and Viscount of Cabo, in
consideration of his services as Captain General
doriughU two terms.
Accounts to the 13th oi July, state that the
Ministry of Spain have resigned, and the Queen
has acoepted their resignation, and charged
Captain General O’Donnell with the duty of
forming a new Ministry. O’Donnell himself is
to be Minister of War.
The new Government have decided to disarm
the National Guards.
On the 17th, every thing was quiet under the
new organization.
Oa dit Gonoral Espartero had started for
Lozrono.
The late Queen Christina, intends establishing
herself in Italy, aud taking naturalization
papers, aud will not return to Spain.

As to tbo first proposition—Mr. Bartow said
that it could not bo expected, por would it bo
dignified, In tho American piirly of Georgia, to
go over to tho Rupport of jir. Buchanan, ina»
much as tho Doiuocratic party, both upon the
occasion of tho election of Mr. Speaker Banks
and at tho Cincinnati Convention, demmuccd
thorn in tho most unqualified manner. Tills is
true to u certain extent, that is, that tho prin
ciples of secrecy, religious intolerance, mid tlm
twoiity one years probationary citizenship, wu 8
condemned. Biit tho two first of them,, tho
American party of Georgia, have absolutely
abjured—aud -the last, it him never hud the
boldness to avow. Tbo application therefore^
could in no wise be to them. It was intended
for the American party of the North, both Fill,
more and untl-Fillmore. Georgia had separated
herself, and still continues to bo separated, from
the main body of the American party. Let us
see how the matter was carried on within our
own limits. Tho whole Democratic Press of
Georgia were guurdod iu tho extreme, in not
allowing one ofionsive word to appear against
our opponents. They appealed to the Ameri
cans, not to run an electoral Ticket in Georgia*
that it would only excite bitter feelings, and that
tho times required there should be no
differences amongst us. They did not ask cv
cry American in Georgia to veto for Buchanan.
They merely required them to stand still at the
Soulh. They might preserve their principles,
notjfor “a generation,” but to tho end of the
world, if they saw fit; but only not to inter
fere whero they could do no good, and only
cripple our exertions.
But wo pass ou to the next proposition, and
one containing mutter of gravo moment:
He said that the Democratic party called
upon them to coalesce, upon tliegruuud that it
was tho party lighting the battles of the South.
That that party hud not given any explicit de
claration that it was sound upon the Southern
question, except the Kuusus-NelirAsku net,
which ho looked upon as a Janus-faced instru
ment, intended to defraud both seeliom of the.
country j that it was construed to include the
doctrine of squatter sovereignty ut tho North
und the opposite ut the South, and that the on
ly true construction was the former. That, ho
sukj, could not have uny claim ou him us u
Southern nmii.
It was tho roiuark of a di-lingidslied gentle.
;maii of Georgia, ou a visit to this city, last
summer, “that the American party of Georgia
would denounce the Nebraska Bill if they dar.
ed.” It has now been openly done. When it
is taken into consideration that tho American
party of Georgia last year, solemnly declared
in Convention assembled’, their advocacy of the*
principles of that Act, und that but u twelve
month since, we uve utterly uta loss to fathom
the intentions of Mr. Bartow and his party. He
tells us that it has nothing to recommend it to
Southern men, and in tho very same breath ill-
forms us, in tho language of Mr. Fillmore, that
it was a Fandoms Box, out of which nil tho evils
of the oouutry had come forth. If Mr. Bartow
demonstrates that it has a free soil face for tho
North, why docs Mr. Fillmore characterise it a 8
a Pandoras Box ? Is it because of its freo
soil face? Or Is it not rather the-declaration
therein contained,tk\t the Missouri Compromise
it forever “inoperative and void ?” No imswer
is required to tiifo, it is a self-evident proposi
tiou.
But we would ask Mr. Bartow, one simple
question, and ask him and every honorable mau
ofihis party to tell us, what in heaven’s num«
has been the absolute life-blood of tho ltepub-
licdu party at tho North but the Kansas Act?
Was it the freesoil Hide of tho janus-faco, which
caused tho North to biazo out,und which dragg
ed three thousand New England preachers
from their pulpit to desecrate their holy calling
by political iuterferoace ? It will not be ne
cessary to argue such a point
It is with deep sorrow that we see a mau
whom God has blessed with a fine intellect und
a noble character—ono who, like ourselves, is
“to the manor born,” led on by tbe blindness
of party zeal to attack an instrument whose
nature no man can doubt, and especially coup
ling with his denunciation an expressed aspira
tion of himself aud his friends, that they should
rise aud soar above this corrupt and demoral
izing influence of party spirit.
But to the last:
Tho third main proposition,amounled to this—
After demonstrating to his own satisludtion,
that’Fremont would sweep tho whole North
and North west, and that Mr. Buchanan would
not get a Northern State, and after tacitly ad
mitting that Mr. Fillmore would not carry u
Southern, lie said that tho American Party
should bo kept up, because it could be votsuppoa
ed ihut\f Mr. Fillmore declined, ui the Free,
States hit party would assist the Democrats,
but that most of them would go over to Mr
Fremont, or at least remain neutral, and there
fore, whatever benefit might, should inure
to Mr. Buchanan, and that they should be al
lowed to retain their party organization be
cause they believed in the principles they - ad
vocate.
Tills is an a admirable urgument, and ono
which we have frequently adopted by ourselves
We desire that the Northern Americans should
keep up their orgauizntiou, and Mr. Fillmore
stand tho contest-, for the very reasons stated
by Mr. Bartow, because they would most cer
tainly go over to the Black Republicans. In
fact we see recently that tho Democrats go to
their meetings to help them along, cheer and
be enthusiastic. But is this an argument for
Southern Men? Is there any fear of their go
ing over to tho Black Republicans? Aro the
Americans of Georgia, in any way bound to
Mr. Fillmore, by which good faitu would re
quire them to stand to him? They did not
participate iu his nomination, and he has treat
ed their nomination with silent contempt, and
has left it for the Hero of Tulip Grove, liko
the gudgeon, to gorge every bait which comes
in his way.
What good can be effccted.'at the South ? .Can
Mr. Fillmore bo benefited ? No. Can Mr. Bu
chanan bo benefited? No. The only way
which wo can account for this persistence in a
useless course,is very well illustrated by Mr. Jef
ferson in his memoir. It will be recollected thut
under tho articles of confederation, previous to
the adoption of tho Constitution, the executive
functions of tho government were exercised by
a committee of six. Tills committco was nl.
ways divided by tho most rancorous party
spirit. Mr. Jefferson relates tiio following con*
versation betwceii Dr. Franklin and himself:

disposition of men to quarrel, and divide into

These is great disappointment expressed herd
at tile rejection by tho House on Friday last of
uu amendment, offered by Mr. Goode, to the
civil appropriation bill, appropriating $300,000,
for continuing the construction of ilio Wash
ington Aqueduct. In purauanco of a law pass
ed in 1802, a survey was mudo of tho proposed
ouurau ot tho uquuduct, und a planwusap-
ptoved by President Piiiinoro. Subsequently,
at two sessions of Uougrcas, two appropriations
amounting lu all to $335,000 wero made to be.
gin the work, which, it was estimated by the
Engineer, Captain Meigs, would cost $2,300,000.
Those appropriation uro now exhausted, uud*
the Work must thoreoforo bo suspended during
tue coming lull uud winter, unq. will be much
lujutod by tho weather. Uuder the appropri
ation, contracts liavo been made, winch are
dot yet completed, aud lor which the contract
ors have uot been paid. Moreover, the Govern
ment must incur great loss from the neces

cessful, to hinder its execution by refusing the

foiling into the Democratic ranks. Senator
Jones, of Tenuessee, publicly gave in his
adhesion to Buchauan, ou Friduy, iu the Sen

The published opiuiou of Attorney General
Cushing, ou the question, referred to him by
the President, us io whether the Federal Gov
ernment can now cuusiilutiuuully interfere to
suppress the insurrection iu San Frauc.sco, ja
most clear and conclusive. It is plain thut tho
right of iutei'lerence should oiily bo exercised
iu extreme eases,uud when all the requirements
of the Constitution and tiie law have beeu ful
ly complied with. The utter irregularity of the
action of Governor Johnson makes tho interpo
sition of the President entirely inadvisable ut
preseut.

the President, returning, for re-consideration,
the bill passed a short time ago for the improve
ment oi the Des Moines Rapids. It was im
mediately takcu up und passed by a two-third
vote, it will be culled up iu the Seuate ou
Weduesduy by Mr. Seward, in pursuance of uo-
tice given by Him to-day. The President grouuds
his veto on tho reasons against bills making
appropriations for general purposes, assigned
in his veto message of Dec. 3u,1854.
The present aspect of tiie late election re
turns authorizes tfio belief that tho South will
vote as a unit iu November. Maryland, which
appears to be tiie lost bragging ground ol the
Fillmore party, is last wheeling into line.
Senator Bumuer, is iu a quiet retreat on the
\ lleghany Mountains in Pennsylvania. His in
dications are all more favorable, though he is
still both physically aud mentally prostrated;
so much so that he is still iucapabie of uny con
tinuous ell’ort. I learn these lucts frura a letter
received from himself in this city to-day.

Tho yellow lover, tho all prevailing topic of con-
versation iu our midst for Hovoral weeks past, has

victim to add to our previous list, forwarded by
tho Isabel of the 25th July. This last death was
that of Major William D. Fraser, or tho Corps of
Eugfoner, U. S. Army—which occurred on the 27th
ultimo. Major Fraser wa3 wholly uuacclhuated—
being ordered here from Fort Kuor, Maino, {tnd as
suming tho command or Fort Taylor, in February
last, ho was a lit subject for this foul disease.
Tho corps or stoppers aud Minora under his chargo
and stationed at Fort Taylor, havo been down to a
mau, but having boon upon tho Key two summers,
ull recovered.. This detachment havo been ordered

to assert that Great Britcinhos assented to the
surrender of the Bay of Islands Colony to Hon

authority also asserts that France approves ot
this arrangement, and has asked permission to
become a party to the treaty.

Our advices from Spain continue meagre

city of Saragossa, whereupon the insurgents

ties, which was granted.
-Information conveyed to the London press,
however, stute that although the city of Mad
rid is quieted, the whole of the important pro
vince of Aragon continues in successful re

Newspaper correspondents further report
that Gen. O’Donnell and the ftueeR have al
ready had disagreements, and tiiut it is not im
probable that Navarez may snccecd to the
Ministry.
The Faris Moniteur contains an editorial
exculpating Gen. O’Donnell in regard to the
present difficulties in Spain.
Tho same paper also announces that the
Spanish Junta nas decreed to tho infant son
the Emperor of France the rights of Spanish ol
citizenship.
From Italy we have a statement by telegraph
ofa revolt in the Duchy of Massucarra. We
are, however without any riliable particulars.
Tho Austrian official state that tbe movement
was inslgnlficlent, and that it wa« promptly
suppressed.
SOUND DUES.
The special Committee of tho British House
of Commons, have made their report in relation
to the Danish Sound Dues, but they do not
suggest any precise mode of adjustment of the
vexed question. They however urge au im
mediate and Unal settlement of this matter if
practicable, by negotiation.
We have nothing new from the late seat of
war, excepting a reported serious disagreement
respecting the boundaries between Russia and
Turkey.
The Anglo-Saxon brings Bombay dates of
the 26th, and Shanghai to the 2d of June. Tbe
crops of tea and Bilks are reported very abun
dant.

The favorable change of the weather whlcu
was noted by the Asia on tbe 26th inst. has
continued, and our market for breadstuffs has,
conBcqueatly, experienced a marked decline,
especially in the inferior grades of flour aud
wheat. Some respectable houses quote the de
cline as much as two to five shillings on inferior
flour, and from three to sixpence on inferior
wheat. Tbe finer qualities ol flour are quoted
at a decline of sixpence to one shilling, and of
wheat about two to four pence per 70 lbs. The
market yesterday was quite unsettled and ac-
curate quotations cannot be given.
