E. Edwards, was on the point of leaving Galveston direct for San Juan with emigrants for General Wah ker. The prrtlal failure of the crops in many of the upper counties of Western Texas, is causing many families to remove to the East, where the abundance of wheat and the success of other crops render provisions plentiful and cheap. The Brazos Statesman says that the streets and the public highways leading to and through Waco, having been lined tor two or three weeks past with emigrants going north and eastward. A man named Walker recently escaped from Waco with a negro and two horses, and was pursued as far as the Cherokee Nation and seized with his spoils. Walker and the negroes however, managed to effect their escape, am were again panned by Ur. Herring with some 30 Indians, whom he had employed for the pur pose. After a desperate resistance, the parties were seized, and Walker was subsequently killed. Earthquake In Malta. On Sunday, the 25th of October, at eleven minutes before 2 o’clock A. U., the islands of Malta and Gozo were visited by shocks of an earthquake, so violent in their nature, and so long in duration, that the oldest inhabitants do notremember ever to have experienced anything so severe. The first shock made itself percep tible by tremulons motion similar to that caused by the passing of a heavy gun carriage a thousand times repeated, accompanied by a rambling noise, of distant thunder, which rapidly increased in violence until every build* ing trembled. Scarcely a minute had elapsed when a more violent shock, accompanied b,^ a louder noise, occurred. The alarm oc casioned was general throughout town and country. “Men, women, and children, suddenly arouss ed from their slumbers, issued from every house, ruishing into the Btreets made the beBt of their way to the squares, and other spaces which soon became lull of people. The sentry nt the, Treasury left bis post and ran to the main guard which be turned out, under the impression that shells were being thrown into the town by any enemy from some steam fleet. The two shocks, the interval being so brief as to be incalculable, lasted two minutes. In the City of Valetta scarcely a building escaped injury, and all corner strnctures have more particuU rly Buf fered. Of the Roman Catholic churches these of Ban Giacomo, St. Orsolo, and St. Domenico appear to have suffered most. At Floriana and each of the three cities, as well as in the harbor, the shocks were felt with considerable vigor, and at Sencles, Cosp cua, and Vittorioso, many of the buildings are injur* ed. Persons on board ships in tue port des cribe the effects of the earthquake, as felt by them, as of letting go the ships boats from the davits by tbe run, only much stronger. The sea receded two feet and a half. The night had been without a breath of air, with a sultry sensation, tho sea perfectly calm, and tho moon shiuiug in a clear sky, with a brightness that seemed to transform night into day, it being within twenty onohonrs of full moon. AtCivita veccbia, in the iuterior of tho is land, all the churches, monasteries, nuuueries and hospitals (the church of St. Augustine ex cepted,) sustained greater or less damage. The dome of the cathedral is reent, so as to admit the light, and the belfry is much sha ken. Interesting from St. Domlngoi American Consul Intuited—Progress of the Spanish Designs on the Dominican Republic. Correspondence of the New York Daily limes. St. Domingo City, Wednesday, Oct. 15. On the night of the 11th ot October, a mob, instigated by Mr. A. M. Segovia, Spanish Con sul General, assembled before tho United States Consulate, for the purpose of pulling down the flag-staff and the sign, throwing stones against the eagle, and making tho greatest disorder. There were also cries of "Down with the filli- busters!—down with the American ensign! ’ The American Consul, Mr. Jacob Pereira, rc paired to the spot for the purpose of imposing respect, but all his efforts were in vain. Not being able at that moment to obtain any assis tance from tho authorities, he was obliged, for the safety of his person and life, to leave the place of disorder. A greater outrage by Spaniards was never committed in any civiliz ed country, and ft shows that the Spanish Con sul is determined to trample on the honor of the United States Government. He bus not only compelled this Government , to withdraw the treaty just made with the United States, but he is doing all in his power to break down the United States Consulate, and poison the f ood-natured Dominicans against Americans, a this scheme he will succeed, if some serious measures are noruken at once by the United States. The morning after the riot, the American Consul represented the case to the Government by means of an official note, and the Mayor was immediately informed of the conduct of Mr. Segovia. Tne Mayor then called on the Ameri can Consul, to offer him protection, and a file of soldiers, to impose that respect which was due to the United States Consulate. This was, however, refused by Mr. Pereira, who stated that the American flag needed no guard to cause it to be respected, and that he was then prepared to meet any mob that might appear. But all disturbance was soon quelled. Mr. 8e- ffovjatook fright and remained at home. This is not all. Segovia has turned Santa Ana.Mots* and the Almas out of the Govern ment. He has sent the American Minister, Delmonte, his passport, and for aught wo kuow, will soon have a Spanish army to meet the Americans, when they demand satisfaction for withdrawing their treaty. Below we give an important communication from the State Department, in reference to much vexed question, the citizenship of fn negroes. It is addressed to H. H. Rice, Clerk of the Superior Court of New York, through whom same free negroes (Berenaders,) who were about to go to Europe, made application for passports : Dki’aktuknt op State ( Washington, Nov. 4.) H. II. Rice, Esq,, New York City: Sir—Your letter of the 29th ultimo, aud 3d inst., requesting passports for eleven colored persons, have been received, and 1 am directed by the Secretary to Inform you that the papers transmitted by you do not warrant the depart ment in complying with your request. A passport is a certificate that the person to whom it is grunted, is a citizen of the United States, and can only he issued upon proof of this fact. In the papers which accompany your communication, there is uo satisfactory evi dence that the nersonsfor whom yonrequestpass ports are of this description. They are repres ented in your letter as “colored,” and describ ed in the affidavit as “black,” from which state ments it may be fairly inferred that they are negroes. If this is po, there will be no doubt that they are not citizens of the United States. The question whether free negroes are such citf- zeus is not now presented for the first time, but has repeatedly atisen in the administration of both the National and State governments. In 1821 a controversy arose as to whether freepersons of coilor were citizens of the United Stutes within the intent aud meaning of tbe acts of Congress regulating foriegn and coasting trade, so as to be dfsq ualitied to com mand vessels; and Mr. Wirt, Attorney General decided that they were not; and moreover held that the words, “citizens of tho United States,” were used in tho acts of Congress in the same sense as in the constitution. This view is also fully sustained in a recent opinion of the present Attorney General. The judicial decisions of the country arc to the same effect. In Kent’s Commentaries, vol. 2, p.277, it is stated that in 1833 Chief Jus tice Daggct, of Connecticut, held that free blacks are not '"citizens” within tbe meaning of the term as used in the constitution of the United States, and the Supreme Court of Ten ncssee, in the case of tho State agaiust Clai borne, held the same doctrine. Such being the construction of the constitution in ragard to free persons of color, it is conceiv ed that they cannot be regarded, when beyond tbe jurisdiction of the government, as entititlod to the full rights of citizens; but the Secretary directs me to say, that though tbe Department could not certify that such persons are citizens of tho United States, yet, if satisfied of tbe truth of tho fucts.it would give n certificate that they were born in tbe United States, aud free, and that tho government thereof would re- g nrd it to be its duty to protect themif wronge y a forigen government, while within ts their rights ana breax aown the Dominican Republic, or Will the American people consent toft, are questions we want answered.
