Art. XV. In case the stipulations, Contained in the Xlllth article of the preliminaries, (hould not be com pleated at the time of the signature of the present treaty, as well with regard to the evacuations to be made by the ar mies of France of the fortrefles of Cleves, Wcfel, Guel ders, and of all the countries belonging to the King of Prussia, as with regard to the evacuations to be made by the Biiti(h and French armies of the countries which they occupy in Weftpbalia, Lower Saxony, on the Lower-Rhino, the Upper-Rhine, and in all the empire, and to the re treat of the troops into the dominions of their refperiive sovereigns; their Britannick and Moft Christian Majcfties promise to proceed, bona fide, with all the dispatch the case will permit of to the said evacuations, the entire com pletion whereof they stipulate before the 15 th of March next, or sooner if it can he dene: and their Britannick and Moft Christian Majesties further engage, and promise to ach other, not to furnifh any fuccours, of any kind, to their refbeftive allies, who (hall continue engaged in the war in Germany. Art. XVI. The decision of the prizes made, in tunc of peace, by the fubjefls of Great-Britain, on the Spani ards, (hall dc referred to the courts cf justice of the admi ralty of Great-Britain, conformably to the rules established among all nations, so that the validity of the said prizes, between the British and Spanish nations, (hall be decided and judged, according to the law of nations, and accord ing to treaties, in the courts of justice of the nation, who (hall have made the capture. Art. XVII. His Britannick Majesty (hall cause to be demoliihed all the fortifications which his fubjeds (hall have creried in the Bay of Honduras, and other places of the territory of Spain in that part of the world, four months after the ratification of the present treaty: And his Catho lick Majesty (hall not permit his Britannick Majesty’s fub je&s, or their workmen, to be disturbed, or mo’.efted, un der a y pretence whatsoever, in the said places, in their x>cctrpatirn of cutting, loading, and ccrrying away log wood: And for this purpose, they may build without hind rance, and occupy without interruption, the houses and magazines which are neceflary for them, for their f ai milies, and for their efFe&s: And his Catholick MajeftV aflures to them, by this article, the full enjoyment oftholb advantages, and powers, on the Spaniffi qpafts and territo ries, as above stipulated, immediately after the ratification of the present treaty. His Catholick Majesty deflfts, as well for himfelf, as for his fuccfeflbrs, from all pretensions, ich he mav have formed, in favour of the Guipufccan nd other his fufaic£b, to the right of (idling in the neighbour hood of the island of Newfoundland. Or thofc who (hall have any commercial affairs to fettle there* (hall have liberty to fell their lands and their estates, to fettle their affairs, to recover their debts, and to bring a way their effects as well as their persons, on board velfels which they (hall be permitted to fend to the said island re stored as above; and which (hall serve for that use cnlv* without being restrained on account of their religion, or under any pretence whatsoever, except that cf debts, or of criminal profecutien; and for this purpose, the term of 1# months is allowed to his Britannick Majesty’s fubje&s, to be computed from the day of the exchange of the ratificati ons of the present treaty: But as the liberty granted to hi* Britannick Majefty’* fubjefls, to bring away their persons, and their effects, in vefiels of their nation, may be liable to abuses, if precautions were not taken to present them, it has been exprefly agreed, between his Britrnr.ick Majesty and his Catholick Majesty, that the number of English ve(- fels, which (hall have leave to go to the said island restored to Spain, (hall be limited, as tvell as the number of tons of (each one; that they (hall go inballaft; (hall fu fail at a fix ed time* and (hall hiake one voyage only; all e dFefts belonging to the English being to be embarked at the fame time: It has been further agreed, that his Catholick Maje sty (hall cause the neceflary passports to be given to the said veflels; that, for the greater security, it (hall be allow ed to place two Spanish desks, or guards, in each of the said veflels, which (hall be visited in the landing places and ports of the said island restored tt Spain; and that the merchan dize, which (hall be found therein, (hall be confifcated. Art. XX. In confequentt of the rdlitution stipulated in the preceding article, his Catholick Majesty cedes and gbaranties in full right, to his Britannick Majesty, Florida, with Fort St. Augustine, and the bay of Ftnfacoia, as well as all that Spain pofTeflcs on the Continent of North. America, to the east, or to. the south-cast, of the river Miflifippi. And, in general, every thing that depends 0:1 the said countries and lands, with the fovercignty, pro perty, pofteflion, and all right.*, acquired bv treaties or otherwise, which the Catholick King, and the crown of Spain, have had, till now, over the laid countries, lands, places, and of the inhabitants; so that the Catholick King cedes, and makes over the whole to the said King, and to the crown of Great-Britain, and that in the moft ample manner and form. His Britannick Majesty agrees, on his fide, to grant to the inhabitants of the countries, above ceded, the liberty of the Catholick religion: He will con fequentlv give the moft exprefi and moft effe£lua! orders that his new Roman Catholick fufcjcfts may profefs the worihip of their religion,according to the rite* of the Rcmiih church, as far as the laws of Great-Britain permit: His Britannick Majesty further agrees, that the Spanish inhabitants, or others, who had been fubjefts of the Catholick King in the said countries, may retire, with all fiifrty and freedom, wherever they think proper: and may fell their estates, provided it be to his Britannick Majesty’s (übjefts, and bring away their effect, as well as their oerfons, without being restrained in their emigration, under any pretence whatsoever, except that of debts, or of criminal prolccu cutions: The term limited for this emigration, being fixed to the space cf eighteen month*, to be computed frora thi day of the exchange of t* e ratifications of the prclen. trcat\.
