Cm E ".10 K J5 E LAWS. - [CONTINUED.] Nero Town, Oct. 28, 1820. ,1 Resolved by the National Committee mid Council, That any person or per mits whatsoever, who shall tnde with any negro slave without permission feora the pioper owner of such slave, <1 the property so traded for, be oven to have been stolen, the pur- aser shall he held and bound to the gal proprietor for the same, or the lue thereof; and be it further Resolved, That any person who shall rmit their negro or negroes to pur- lase spirituous liquors and vend the me, the master or owner of such ne- 0 or negroes shall forfeit and pay a e of fifteen dollars for every such ’ence, to be collected by the mor als within their respective districts r the national use; and should any gro be found vending spirituous li- ors without permission from their pectivfe owners, such negro, so ending, shall receive fifteen cobbs paddles for every such offence, m the banns of the patrolers of the tlement or neighborhood in which offence was committed, and eve- settlement or neighborhood shall privileged to organize a patrolling mpany. [Resolved by Vie National Committee Council, That the judges of the [trict courts shall keep a record o r proceedings of all causes, evitlen- and decisions; and I Re it further Resolved, That each Irson who may he employed as clerk “the district courts shall he allow' aud paid the 6umoftwo dollars per New Town, Nov. 8, 1822. Whereas, the great variety of vices emanating from dissipation, parti cularly from intoxication, and gam ing at cards, which are so preva lent at public places, the national committee and council, seeking the ' true interest and happiness of their people, have maturely taken this . growing evil into their serious con sideration, and being fully convin ced that no nation of people can prosper and flourish or become mag nanimous in character, the basis of whose laws are not founded upon virtue and justice; therefore, to suppress, as ‘much as possible, those demoralizing habits which were introduced by foreign agency Resolved by the National Committee That any person or persons whatsoev er, who shall bring ardent spirits with in three miles of the General council house, or to any of the court houses within the several districts during the general council, or the sitting of the courts, and dispose of the same so as to intoxicate any person or persons whatsoever, the person or persons so offending, shall forfeit his or their whis key, the same to be destroyed; and be it further Resolved, That gaming at cards is hereby strictly forbidden, and that any person or persons whatsoever, who shall game at cards in the Cherokee nation, such person or persons, so of fending, shall forfeit and pay a fine of twenty-five dollars; and further, any person or persons whatsoever who may or shall he found playing cards at any house, camp, or in the woods within three miles of the general conncil house or any of the court houses of the several districts during the session of the .general council or sitting of the district courts, such person or persons, so offending, shall forfeit and pay a fine of fifty dollars each for every such offence, and that any person or persons whatsoever, who shall bring into the Cherokee nation and dispose of play ing cards, such person or persons, be ing convicted before any of the judges, marshals, or light horse, shall pay a fine of twenty-five dollars for every pack of cards so sold; and it shall be the duty of the several judges, mar shals and light horse companies, to take cognizance of such offences and to enforce the above resolutions; and Be it further Resolved, That all fines collected from persons violating the above resolutions, the money so col lected shall be paid into the national treasury. Resolved, That the business of the council, during the session, he suspen ded on the Sabbaths, and also, that the merchants & pedlars, and mechanics, at New Town, close the doors of their shops and suspend all business; and any person or persons violating this resolution shall foifeit and pay the sum of fifteen dollars, to be collected for the benefit of the nation liy the proper officer. Resolved by the Natit <ial Committee and Council, That th< marshals or tax collectors of the se eral districts, are hereby authorized 0 seize upon and attach the propertytof any person or persons who shall not make punc tual payments of their Respective tax es, when called upon, aWl the proper ty so seized and attached shall be ad vertised for sale, and ten days shall be allowed for the redemption of the prop erty so attached, hi case the prop erty be not redeemed in that time, then the mat jhal or collector shall pro ceed to expose to public sale such property to the highest bidder, and all sums of money which may be receiv ed over the amount of taxes, for which the property may be seized, attached and sold shall he returned to the per son or persons from whom it was ta ken. Resolved by the National Committee and Council, That the Chattoogee, Cliickamauga and other turnpike com panies, who have not been heretofore under any obligation to keep in good repair their respective roads, be, and they are hereby, required to keep in good repair their respective roads and in case of non-compliance with the a- foresaid requisition, the privileges aud authority in them vested for keep ing a toll gate thereon, shall cease and become void whenever full and sufli- •ient evidence may be established before the national committee and council. Resolved by the National Committee and Council, That a decree passed October 28. 1819, impwng a tax on merchant citizens ofthe nation, is here by reduced from twenty dollars to twelve dollars per annum, and the tax on pedlars, not citizens of this nation, is also hereby reduced from eighty ollars to fifty dollars, per annum, to ake effect after the first of January text.; the regulation to he observed and •nforced agreeably to the said decree. The National Committee have discov ered, that. claims of a private na ture, which more properly belong to the courts for adjustment, have been taken up by the Council and acted upon by that body and sub mitted to the Committee for con currence, those claims are brought before the committee without evi dence 0 the presence of the par ties, which makes it difficult and impossible to investigate the mat ters of dispute, therefore, Resolved by the Committee, That all matters of private controversy, bro’t before the Council or Committee, which hove not been appealed from the district courts should be submit ted to that court of the district where the parties reside, and all causes which have been appealed from the do Ision of the dist.ri t courts, should he submitted to the supreme court in session for a decision agreeable to law and equity.
