said office, and shall be entitled to demand, have and receive of
and from any clerk of the Superior Court who may have acted
ex officio as Ordinary, any and all records and other papers and
tilings appertaining to said office; and any clerk ofthc Superior
Court who sha ll retuse to deliver the same shall be liable to
rule and attachment in the Superior Courts of said county for
contempt ; Provided, in case of a tie the justices of the Inferior
Court shall order anew election, in the same way and manner
as in a case ofvecancy.
Pec. 14th. Jhul hr. tt further enacted, That each and every
Ordinary, before he shall enter on the duties of his office, shall
give bond and security, in the suin of two thousand dollars, for
the faithful discharge of his duties as clerk by himself and his
deputy, which bond shall be approved by three justices of the
Inferior Court, and be made payable to the Governor for the
time being, and his successors in office, and shall be filed and
recorded in the same manner as Sheriffs’ bonds. And said
Ordinary shall have power to take bond and security from his
deputy, for the faithful performance of bis duty as such.
PIC. 15tll. .Ind be it further enacted try the authority aforesaid
That the Ordinary elected or to be elected as aforesaid, shall
before he is commissioned and enters on the duties of his office,
take and subscribe before the justices of the Inferior t.oiut of
the county of his residence, or a majority of them,the follow ing
oath or affirmation. “I, A. 8., do solemnly swear oraffiim (as
the case may be) that I will w ell and faithfully discharge all the
duties of Ordinary for the county cf during my continu
ance in office, according to law, to the best of my know ledge
and ability, without favor or affection to any party, and that I
will only receive tny legal fees of office. Fo help me God.
And each and every deputy adpointed under the provisions of
this act shall take and subscribe a similar oath before said jus
tices.
Sac. 16th. .Ind hr it further enacted, That all bond? relating to
the probate of wills, or the administration or guardianship of
estates, heretofore required to be payable to the justices of the
Inferior Court, when sitting for Ordinary purpoes, and their
successors in office, or to the Inferior Court, or the justices
thereof, under whatever name or style, shall fr. in and af'er the
time at which this act shall take eti'eci,bc payable to the Ordi
nary and his successors in office.
.Vrc. 17th. And he it further enacted, That no return of any
executor, administrator, or guardian, shall lie allowed until
after the expirat on of thirty dys from the filing of ibe same;
and it shall be the duty of the Ordinary to record all vouchers
offered with said returns, and return said voucher* to (-aid exec
utors, administrator or guardian, on demand for the same; and
said Ordinary, for recording such vouchers, i hall he e. titled to
ten cents for every hundred words.
Ski-. 18th. Hr it farther enacted. That the fees of said Ordina
ry, for the examination and recording of returns upon estates,
shall be as follows, to wit: On all eslates not worth more than
two thousand dollars, the same fee as heretofore allowed for
examining and recording a return, on estates worth more than
t:ro thousand, and not more than ten thousand dollars, twrnty
fine per centum in addition to such former fee; and on estates
worth more than ten thousand dollars, fifty per centum on such
former fees. And all other fees and charges for services ren
dered hy said Ordinary shall be the same as now fixed by law.
Sue. 19. And be it further enacted try the authority aforesaid.
That in case either party in said Court of Ordinary shall or may
lie dissatisfied with any decision cf the said Ordinary thereof,
then, and in all such cases, such dissatisfied party may. within
four days after the decision and judgment of the satd Ordinary
therein, be allowed to enter an appeal to the Fujierior Court,
under the same rules and restrictions asare now prescribed by
law for entering appeals from the Inferior Courts silting for
Ordinary purposes.
Sec. 20th. And he il further enacted. That it shall not be
lawful for the Ordinary, nor any legal partner of said Ordinary
1 1 practice in said Court of Ordinary, or be retained as Counsel
in any cause originating in said Court, and carried by appeal
or writ of error to any higher Court nor shall such Ordinary or
his legal partner receive any fee or reward for any service
rendered or Counsel given in any inattter connected with said
Court other than the fees authorized hy law to said Ordinary;
and any Ordinary violating the provision of this section, or
permitting its violation by any legal partner practising in said
Court liefore him, shall be guilty of a misdemeanor, and on con
victim shall be lined and imprisoned at the discretion of the
Court, and shrill forfeit his commission, and shall be ineligible
to re-election : Provided, nothing in this section shall prevent
said Ordinary from practising in any other cause, in any other
Court.
Sec. 21st. jAnd be it further enacted, That at the
first term of the Superior Courts of each county, after
the election of the Ordinary, it shall be his duty to re
port to the the said Court the estates in his
hands unrepresented, and which devolve upon the
Clerk of the Superior Court or other persons by the
provisions of this act, and also a statement of the con
dition ol said estates, and it shall he the duty of tha
said.ludfre to compel the said Clerks to take out ad
min slration or guardianship on the same, if he has
neglect pd or refused so to do, or to appoint a receiver
or guardian under such rules as he may prescribe, and
the said Clerk, or such receiver, if such be appointed,
shall he subject to such orders in chancery as may be
made from to time respecting the management of any
estate committed to him, and shall also account to
the Ordinary in the same manner os other adminis
trators all his transactions with regard to said estate.
St. 22. And he it further enacted by the authority afore
said, That all laws and parts of laws militating against this
act. he and the same are hereby repealed.

County, on Wednesday night last, R. K. HINES,
Esq. of this citv, aged -It) Years. Mr. 11. was one of
our most prominent Attorneys, and was much es
teemed as a man and as a citizen. He leaves a
large circle of relatives and friends, to mourn their
ioS’ of a kind parent, and a waini and generous friend.

The Bridge Keeper reported tolls for the week to

The Committee on Public Property, reported hav
ing examined the magazine, and placed D. C. Hodg
kin-, the keeper elect, in possession of the same.
The Finance Committee, recommended the payment
of Fiver ifc Murray's account for work to the gutter
near E. A. Ni.-bet's; amount $l5O, which was passed
and ordered paid.
it having been reported to the Mayor that M. E.
Murphy was suspected of setting fire to the store oc
cupied by him, on the morning of the 19th, it was.
thought to be due to Mr Murphy, as well as to the
citizens generally, that an investigation should be had.
Several witnesses were exemined in the ease which
resulted in entirely exhonorating Mr. Murphy from
any knowledge of how, or where the fire originated.
The ease was discharged.
Ray & Ross’ and M. D. Barnes’ account was re
ceived and referred to the Finance Committee.
A petition from property < wners in Madison st., to
grant permission to If. M. Lindsay to cutout and open
said street, so as to make it passable, was received and
referred to tlie Street Committee.
On motion of Aid. Whittle,
Resolved, That the Mayor is requested to have the
necessary fixtures attached to the city clock, so that
the bull can be used as an alarm bell, and that 11 is Hon
or also make an arrangement with the sextons of the
different churches to toll their hells in an alarm of fire,
and pay them therefor such compensation as lie may
deem proper—Passed.
