‘ It is exceedingly unpleasant to have a newspaper
controversy with any one, and more especially,'with

j After my election to the Mayoralty of the city of
[Macon, I had repeated conversations with Mr. Isaac
[Scott. President of the Macon and Western Railroad
It ompa.iy, with regard to the crossings of the streets
which the Macon and Western Railroad Company had
bound themselves to make. Oil one occasion, Mr.
Scott requested me to go with Mr. l'oota to examine
the crossings with the view, as 1 then supposed, of en
gaging in rh-; work at an early dav, after our examin
ation. Mr, Foote said he would proceed with the work!
as coon as a contractor could be obtained. Suspecting]
nothing derogatory to the character ami good faith in
w hich tho agreement was entered into by the Macon
A, \Y estorn Railroad Company to complete their s-. ver
ai crossings, 1 cherished the hope that the work would
proceed forthwith—but iu this 1 was chagrined when
tlld by Scott that lie did not luieud to make the cross
j ng. as stipulated unless the city of Macon had the
right to stop the cars of the Macon & Western Railroad
Company by injunction. This language wi’ so unex
pected, so unlooked for. titter what hud passed between
us, t.oat [ determined that for the future any and ail
communications in relation to the crossings, between
Mr. Scot’ and myself should be in writing. It was!
thou that I made a demand of him in writing to earn j
oul the agreement between the city of Macon and the]
Macon &, \\ estern Railroad Company, and because]
the .streets happened to be misnamed in niy letter, he
availed himself of a contemptible quibble in reply to
my note. In proof of my charge of quibbling, l refer
to the cotresp. ndcnco already published, und to Mr.
Scott’s note published in his card,

men of the city ol’Macon, 1 stated that Mr. Isaac
Golt, pres.dent of tlie Macon and Western Railroad
Company, had induced me to believe that he would
comply with the agreement vvith'the city to make suit
able crossings, but that I regretted to sav, he had de
termined otherwise. Mr. Scott denies tho truth oi’the

no authority for saying that tho Macon and Western

In corroboration oi the charge which I made against
.Mr. Seoti of resisting the demand of the city in regard
to the crossings, and which is denied by him, I submit

submit the c-rtificates oftwo gentlemen, whose state

While conversing about general matters, I said I

you the following particulars. Some time since, pro
bably in the month of March or April, I had gone to
Cotton Avenue with Mr. E Bond, to examine a house

It is proper to add, as I told you, I thought Mr, Bond
had left us before thi* conversation took place. He has
since convinced me he was present, and although hr
rccollectssomthing being said by Mr Scott and my
self on the subject, does not recollect the reply I think
Mr. Scott made. My recollection still ia that he did
use the j e words—or others of eimilar purport, although
I took no trouble to impress them on ray mind, and I
do not think I ever mentioned tho matter until so you,
an Friday last, if I ever thought of it again up to that
time.
I will also add that I never knew any conversation
between Mr. Scott and yourself on the subject, and in
justice to my*"lf übl do not. wish to obtrude into this

to you, on Friday last, I did not know there was any
difficult) between you and Mr. Scott in regard thereto,
or that such a thing was likely to take place, nor that
I should be asked to make this written statement,which

clined giving a certificate, but said I could avail myself
