Submitting a proposed amendment to the
Constitution of Georgia to be voted on at
the General Election to be held on Tuesday,
June 3, 1941, amending Article 7, Section 7,
Paragraph 1, of the Constitution of Georgia,
so as to authorize Cook County by vote of
its fiscal authority to issue, in addition to all
other bonds, Funding Bonds sufficient in
amount to pay off and retire the warrant
indebtedness, notes, judgments, county orders
open accounts, and demands of all kinds
against said County; to provide that in the
event such indebtedness is paid off and retired
that said County shall thereafter operate on
a strictly cash basis and be prohibited from
issuing warrants or orders payable in the
future, except that the right, in said governing
authority to borrow money to supply casual
deficiencies in revenue as heretofore authorized
shall not be affected nor defeated by this
amendment; to provide that the bills and
claims of and against said County ahull be
paid by check, and how such checks shall be
executed; to legalize tax levied through the
year 1941, and to authorize the levy and
collection of a tax in the current year for
use, all or in part, for the operation of said
County for the next ensuing year; to provide
how said bonds shall be authorized, validated
and issued; to require the fiscal authority
of said County to make provision for paying
off and retiring said bonds; to provide that
the proceeds of said bonds shall be used
exclusively for paying off and retiring Du

BE IT ENACTED BY THE GENERAL
ASSEMBLY OF the state of Georgia,
and it in hereby enacted by authority of name:
Section 1.
That Article 7, Section 7, Paragraph 1, of
the Constitution of Georgia, which has hereto¬
fore been amended shall be further amended
by addin# thereto a paragraph in the following
words and language, to-wit:
“Provided, however, that in addition to the
bonded indebtednesH now or hereafter author

warrant indebtedness of said County, and all j

payable thereon, as the same appears of
record in the office of the Commissioner of
Roads and Revenues of said County of Cook
on the date as determined by the governing
authority of said County, which date shall
be not earlier than ten days and not more
than sixty days next after the date of the
proclamation of the Governor declaring this
amendment ratified ; said bonds to be known j
and designated as “Funding Bonds.” !
"In the event the privilege granted herein
is exercised by said County after said date as
determined by said governing authority,
said County and the governing authority there
of are prohibited from issuing warrants and
deferred payment orders on the Treasury of
said County, and said County shall thereafter
be operated on a cash basis, so that all bills
and claims chargeable to or against said
County or payable by the Treasury of said
County Khali be paid monthly or otherwise
as may he determined by the governing
authority of said County, and in no other
way ; no such checks to be issued and delivered
unless funds are on deposit sufficient to
immediately pay aamc and all other then
outstanding chocks, ail such chocks to be j
signed by the Chief Executive Officer of said
governing authority, and countersigned by
the Vice Chairman of said authority of the
County, with the right in said governing
authority to borrow money to supply casual
deficiencies in revenue as heretofore authorized
by this Constitution. All tax levies for lawful
County purpose** heretofore made and made
in the year 1941 by the governing authority ;
charged with the duty of managing said |
County's affairs shall be legal with the express
Power and authority to levy and collect taxes
for lawful County purposes for the then
current year for use all or in part in the
operatio njfnf said County for the next ensuing !
year. No violation of any provision of this
amendment as to the conduct of the fiscal ,
affairs of said County after the date deter¬
mined by the governing authority for the
issuance of Funding Bonds shall in any wise
affect or impair the validity of said Funding
Bonds.
“Said Funding Bonds shall have such terms
and provisions as to maturity, rate of interest,
and otherwise, an may he fixed by the govern¬
ing authority of Raid county, provided, how¬
ever, that said bonds muat ail mature within
thirty years from the date of issuance. ’rovi
sion shall be made by the governing authority
by resolution for the assessment and collection ]
of an annual tax sufficient in amount to pay (
the principal and interest of said Funding ,
Bonds as they respectively become due, and
the proceed© of said bonds shall be exclusively
used for the purpose of paying and retiring
the indebtedness and interest thereon of said
County, as may be determined at the date
set by the governing authority of said County,
Said Funding Bonds shall be issued under the
authority hereof when so authorized by a
majority vote and resolution of the governing
authority f Cook County but without the
necessity of an election ns in the case of
original obligation bonds of said County, and
shall then be validated in the manner and
under the procedure as is provided by law for
the validation of original obligation bonds.”
Section 2.
Be it furthur enacted by the authority afore¬
said, that when said amendment shall be
agreed to by two-thirds vote of the members
of each House, with the “ayes” and “nays”
thereon, the Governor is hereby directed to
have this proposal published in one or more i
newspaper* in each Congressional District in
this State for two months previous to the time
for holding the m4t general election at which
proposed amendments to the Constitution " f I
this State may be voted on, and shall at said
election be submitted to the people for ratifica¬
tion or rejection. All persons voting at said
election in favor of adopting said proposed
amendment to the Constitution shall have
written or printed on their ballots the words
“For ratification of amendment to Article 7,
Section 7, Paragraph 1. of the Constitution
so os to authorize Cook County to issue
Funding Bonds, and thereafter to operate on
a cash basis, and for other purposes,” and
all persons opposed to the adoption of said
amendment shall have written or printed on
their ballots the words “Against ratification
of amendment to Article 7, Section 7, Para¬
graph I, of the Constitution, so as to authorize
Cook County to issue Funding Bonds, and
thereafter to operate on a cash basis, and
for other purposes.” And if a majority of the
electors qualified to vote for members of the
General Assembly, voting thereon, shall vote
for ratification thereof as provided by law.

required by law in elections for members of
the General Assembly, then said amendment
shall become a part of Article 7. Section 7,
Paragraph J, of the Constitution of the State

proclamation therefor as provided by law.
Section 3.
Be it furthur enacted, that ail laws or
parts of laws iri conflict herewith be, and
the same, are hereby repealed.

By virtue of the power of sale contained
in a deed to secure debt from Clarence Ad
kins and J. C. Adkins to C. E. Martin dated
November 18, 1921, recorded Book 29, page
228, Clerk’s office Houston Superior Court,
Will be sold before the door of the court
house of Peach County, Georgia, on May 6th,
1941, to the highest bidder for cash the fol
lowing described property, to-wit:
All that certain tract, lot or parcel of land
situate, lying and being in said Houston (now
Peach) County. Georgia, and in the Ninth
District therein, containing 42 acres, more or
Jess, being part of land lot No. 149; the tract
hereby conveyed being bounded on the North
by the old public road leading from Fort Val
ley to Houser' Mill; on the Ea:it by lands
formerly belonging to the estate of John A.
Houser; on the South by lands of W. J.
Evans; on the West by lands of A. J. Evans.
The tract hereby conveyed being the .same as
was conveyed by C. K. Martin to Mrs. Lois
Adkins Tripp© by warranty deed dated Dec.
1st, 1919, recorded Clerk’s office Houston
Superior Court Book 27. page 435, reference
to which said deed and the record thereof is
here had and made for all purposes.
On October 12, 1925, the deed to secure debt
and the Indebtedness thereby secured, with
title to the property therein described and all
of the privileges and options therein conferred,
whs transferred, conveyed and assigned unto
Mrs. Susie M. Catchings, her heirs or assigns.
The indebtedness owing to the undersigned
is represented by five promissory notes aggre
gating the principal sum of $4700.00, besides
interest, aJl of which arc* in default,
Proceeds of sale will be applied as directed
the deed to secure debt, and proper deed
will he made to the purchaser or purchasers

Clarence Adkins, one of the grantors in said
deed to secure debt, having died since the
