Peach County Board of Education,
Fort Valley, Georgia, until 4:00
P.M., Eastern Daylight Saving
Time, May 16, 1967, for the con
struction of Addition to Byron El
ementary School, Byron, Georgia.
At the time and place noted above,
the proposals will be publicly op
ened and read.
Bidding documents may be ob
tained at the office of the archi
tect, Warren and Riley, 901 Bank
ers Building, Macon, Georgia. Ap
plications for documents together
with deposit of $50.00 per set per
improvement should be filed
promptly with the architect.. Bid
ding material will be forwarded,
shipping charges collect, as soon
as possible. The full amount of de
posit for one set will be refunded
to each general contractor who
submits a bonafide bid upon re
turn of such set in good condition
within 30 days after date of open
ing of bids. All other deposits will
be refunded with deductions ap
proximating cost of reproduction
of documents upon return of
same in good condition within 30
days after date of opening of bids.
Contract, if awarded, will be on
a lump sum basis. No bid may be
withdrawn for a period of 30 days
after time has been called on the
date of opening. Bids must be ac
companied by a bid bond in an am
ount not less than 5 percent of the
base bid. Both a performance and
a payment bond will be required
in an amount equal to 100 percent

WHEREAS, in order to ade
quately secure the payment of said
indebtedness, the said V. E. Har
ris did execute a deed to secure
debt conveying to the Citizens
Bank, the following described
land:
All that tract, lot or parcel of
land situate, lying and being' in
the State of Georgia, County of
Peach, and in the Alice Jordan In
gram Sub-division located in Land
Lot No. 201 of the Ninth (9th)
Land District therein, being more
particularly described on a plat of
said sub-division made by T. F.
Flournoy, Surveyor, on April 21,
1960, as Lot No. Five (5) in said
subdivision, said plat is recorded
in Map Book Four (4) Page 42,
Clerk’s Office, Peach Superior
Court and said plat and the record
thereof is here referred to for any
and all purposes. Said property is
the same as that described in the
deed from Alice Jordan Ingram to
Davis Jones Post No 510, The Am
erican Legion, Dated June 27, 1960
and recorded in Book “O-l”, Page
80, Peach (County records.
AND, WHEREAS, said security
deed provided that said instrument
was made to secure said indebted
ness and any other previous or
further indebtedness or liability
of the said V. E. Harris to the se
cond party therein, and;
WHEREAS, on June 14th, 1966,
he said V. E. Harris did execute
to the said Citizens Bank, a prom
issory note in the principal sum
of $3,429.1(5 repayable on July
14th, 1966, and bearing interest af
ter maturity at the rate of 8'/p
per annum, and;
WHEREAS, said note, at the
time if its execution, was also ex
ecuted to be secured by the above
described deed to secure debt, and;
WHEREAS, on July 14th, 1966,
the said V. E. Harris defaulted in
making the monthly installment
as it matured and has failed to
make the said monthly install
ments since that date,and pursuant
to the provisions of said note and
the deed aforesaid securring same,
the undersigned has exercised its
option and declared the entire bal
ance due and payable. There is a
balance due as of September 3rd,
1966 of $3,429.16, besides interest
thereon. Said deed to secure debt
is recorded in Deed Book X-l, at
Page 279 in the Office of the
Clerk of the Superior Court of
Peach County, Georgia.
The said deed contains a power
of sale, authorizing the grantee,
as attorney in fact for grantor
therein to sell the property con
veyed thereby in order to satisfy
said note, as well as subsequent
advances, after advertising tha
same once a week for four weeks
in the official gazette of said Coun
ty, and in accordance with said
power of sale and by virtue there
of The Citizens Bank will sell the
property above described at pub
lic outcry to the highest and best
bidder for cash, on the first Tues
day in June, 1967, at the place of
public sales before the courthouse
door in Peach County, Georgia,
and within the legal hours of sale.
The proceeds of the sale will be
used as follows; (a) To pay the
expenses of said sale; (b) To pay
the sums secured by said deed;
(c) To apply on any other indebt
edness owing by the said V. E.
Harris to the undersigned; (d)
The balance to V. E. Harris.
