ALTERNATIVE
ROAD LAW.
Below wo print, in.full the Al
ternative Hoad Law winch shall
go into effect in Baulding county
during the fall of 1908. Every
one should read and fauiiliari/.e
themselves with this law as it is
a mutter of great importance. It
would be advisable to preserve
this paper as future reference in
order to keep posted in regard to
the law.
f>78. Countv authorities to lay
out roads—The commissioners of
roads and revenues, ordinary, or
such other officer as has charge
of county matters of each county
in this State, shall have the sole
right to lay out, open, change or
dipcontiuue public raids therein,
and the sole management, of the
working of said roads; and saiil
authorities shall have authority
to appoint a superintendent, of
public roads when necessary, and
also to. appoint all overseers,
guards and officers that, may he
required to successfully carry out.
the provisions of this Article, to
prescribe the dutiesof said super
intendent, guards and officers,
15 x the terms of office of the same,
and to prescribe and pay said ap
pointees such salaries or wages
as may he deemed proper.
574. Who is subject, to road
duty—Each male citizen between
the a?e of sixteen and fifty years
shall he subject, to road duty (ex
cept those who aro now exempt
hy law), and shall he required,
when notified or summoned, to
work on the public roads of the
county of his residence for such
length of time in each year as
may he fixed, or to pay such com
mutation tax as may be fixed by'
said authorities; Provided, that
no one shall he required to work
for longer than ten days in any
one year, nor shall said commu
tation tax he fixed at a sum that
will amount, to more than fifty
cents per diem for the number
t f days work required.
575. County tax for roads—The
commissioners of roads and rev
enues, or ordinary, as the case
may be, shall levy a tax addition
al to anv now authorized by law,
of not more than two-tenths of
one per cent, on all the taxable
property of the county, and the
L funds saised hy said taxation,
together with commutation tax
w heretofore provided for, shall lie
known as the .“Public Bond
he used and expended for the
purposes of paving the salaries
and wages, and for wording, im
proving and repairing the public
roads, as herein set forth.
570. Provision for working—
Said authorities are authorized to
work, improve, and repair tie
public roads, as follows :
1. .They may work a chain-
gang (which said authorities are
hereby empowered to organize;
said gang to consist of the mis
demeanor convicts of the county,
or of any other county in this
State that, may he obtained with
out cost or for hire) and those
who do not, pay the commutation
tax: Provided, that the convicts
and those who do not pay the said
tax shall not tie worked together
2. They may work free hired
labor and those who do not pay
the commutation tax, ,
8. They may have said roads
worked, improved or repaired,
by contracting for the same in
such mannpr as they may deem
lit, with private parties, or cor
poration : Provided, that if the
work is done hy contract, the con
tractors shall be required to ein
plrty the chain-gang, if establish
ed, and the labor of those who
do not pay the commutation tax
and to pay for the same
4. They may employ or com
bine any or all of said three
above mentioned methods,
may use any other method or sys
tern thnr may be desired for ac
complishiiig the work necessary
to put and keep the public roads
in good condition. 0
577. Machinery, tools etc—
Said authorities may purchase
any and all machinery, implo
meets, tools, wagons and stock
necessary and required for work
ing said roads, and may build
such houses or stockades, and
purchase any thing or article

580 Defaulters—Any person I
who has failed or refused to pay
the commutation tax when de
manded by the officer appointed
by the authorities to make such
demand, and who shjtll, without
a good excuse, fail or refuse to
appear at the time and place ap
pointed to work,, when summon
ed or notified hy the officer whose
duty it is to give said summons
or notice by the rules of the au
thorities having charge of the
public roads, or who shall fail or
refuse to do faithful work as or
dered by the officers in charge of
the work when lie has appeared,
shall be fined not less than one
dollar nor more than five dollars
for each day he fails to work, or
to bo imprisoned in the common
jail, at the discretion of the au
thority trying the case, or be
sentenced to work in the chain-
gang for not longer than ninety
days.
581. Defaulters, by whom
tried—One or more of the com
missioners of roads and revenues
in counties having commissioners
and the ordinaries in counties
where the ordinary has ohage fif

under this Article, and the coun
ty judge in counties where said

courts for the trial of said de
faulters, at any time or times,
and at any place or places in the
county that my be fixed by said
authority: Provided, that ten
days notice be given of the time
alid place, or times and places,
to defaulters.
582. Summoned byjwhom—
Defaulters shall be summoned
for trial by, or arrested by, such
officer or officers as the commis
sioners or ordinary or county
judge may appoint, or by any
lawful constable pf the county.
588. Provision of force on rec-
oinendation of grand jury—This
Article shall not go into efl’ect
in any county in this State until
it is recomepded by tl\o grand
jury of said county, said reco-
mendation to be made at any
term />f court, and operation of
this Article 'shall lie suspended
in any county of this State upon
like recomendation of the
grand jury made at any term of
court.
