Qualification of Electors and
Registration of Voters.
A PROCLAMATION

Atlanta,,On., August 1, 1908.
Whereas, the Oennral Assembly,
at its session in 100H proposed an
amendment to the Constitution of
this state as set fortli in an Act ap
proved August 1st, 1908, to-wit:
An Act to amend the Constitution
of tlie State of Georgia by repealing
section I of article 2 of the Constitu
tion of this State and inserting in
lien thereof a new section, consisting
of nine paragraphs, prescribing the
qualifications for electors; providing
for tlie registration of voters, and for
other purposes.
Section I, Ho if enacted by tlie
General Assembly of tlie Slate of
Georgia, and it is hereby enacted by
tlie authority of tlie same', that sec
tion one of article two of tlie Consti
tution of this state be, and tlie same
is, hereby repealed, and the follow
ing section, consisting of nine para-

Paragraph 1. After tlie year 1908
elections by tlie people shall be by
ballot, and only those persons shall
be allowed to vote who have been
first registered in accordance with
the requirements of law.
Par. 2. Every male citizen of this
.State who is a citizen of the United
States, twenty-one years old or up
wards, not laboring under any of the
disabilities named in tills article, and
possessing the qualifications provid
ed by It. snail be an elector and en
titled to register and vote at any
election by the people; provided,
tliat no soldier, sailor, or marine in
the military or naval services of tlie
United States shall acquire tlie
rights of an elector by reason of be
ing stationed on duty In this state.
Par. 8. To entitle a person to reg
ister and vote at any election by tlie
people, lie shall have resided In the
state one year next preceding the
election, and in the comity in which
he offers to vo.e six months next pre
ceding the election, and shall have
paid all taxes which may have been
required of him since tlie adoption
of the Constitution of Georgia or 1877
that he ir.ay have had an opportunity
of paying agreeably to law. Such
payment must have been made at
least six months prior to the election
at which he offers to vote, except
when such elections are held within
six months from the expiration of the
time fixed by law for the payment of
such taxeB.
Par. 4. Every male citizen of this
State shall be entitled to register as
an elector and to vote in all elections
in said State who is not disqualified
under the provisions of section 2 of
article 2 of tills Constitution, and
who possesses the qualifications pre
scribed in paragraphs two and three
of this seotlon or who will possess
tItem at the date of the election oc
curring next after life registration,
and who in addition thereto comes
within either of tlie classes provided
for in the live following stib-divlsions
of tills paragraph:
1. Ail persons wliohavo honorably
served in the land or naval forces of
tlie United States in the Rovolut,Ion-
ary war, or in the war of 1812, or in
the war with Mexico, or in any war
with the Indians, or in the war be
tween the States, or in the war with
Spain, or who honorably served In
tho laud or naval forces of the Con
federate states, or of tho Stato of
Georgia In the war between tlie
States, or
2. All-persons lawfully descended
from those embraced in the classes
enumerated in the sub-division next
above, or
1. All persons who are of good
character, and understand tlie duties
and obligations of citizenship under
a Republican form of government,
or
4. All persons who can correctly
read in the English language any
paragraph in tlie Constitution ot the
United States or of tills State and
correctly write tlie same in tlie
English language when road to them
by one of tho registrars, and all per
sons who solely, because of physi
cal disability are unable to comply
with the above requirements, but
who can understand and give a rea
sonable interpretation of any para
graph of tho Constitution of tlie Uni
ted States or of tills State, that may
lie read to them by any one of the
registrars; or
6. Any person who is the owner
in good faith in Ids own right of at
least forty acres of land situated In
tills Statu, upon which lie insides, or
is the owner in good faitli in his own
right of property, situated in this
State and assessed for taxation at tlie
value of five hundred dollars.
Par. 6. Tlie right to register under
sub-division's one and two of para
graph four shall continue only until
January 1st, 1915. Hut tlie registrars
shall prepare a roster of all persons
who register under sub-division one
and two of paragraph four, and shall
return the same to tho clerk's office
of tlie Superior Court of their coun
ties and the clerks of the Superior
Court shall send copies of the same
to the Secretary of state, and it shall
be the duty of these officers to record
and permanently preserve these ros
ters. Any person who lias been once
registered under either of the sub
divisions one or two of paragrapli
four shall thereafter be permitted to
vote; provided, ho meets the require
ments of paragraphs two and three of
this section.
Par. 6. Any person to whom the
right of registration is denied by the
registrars upon the ground that lie
lacks the qualifications set fortli in
the five sub-divisions of paragraph
four, shall have tlie rigid to take an
appeal, and any citizen may enter an
appeal from the decision of the regis
trars allowing any person to register
under said sub-dlvislons. All appeals
must be filed in writing with the l eg-
istrars within 10 days from the date
of tlie decision complained of and
shall be returned by the registrars to
the office of the clerk of the Superi
or Court to be tried as other appeals.
Par. 7. Ponding an appeal and un
til the final decision of I lie case, tho
judgment of the registrars shall re
main In full force.
Par. 8. No person shall be allowed
to participate in a primary of any po
litical party or a convention of any
political party in tills State who is
not a qualified voter.
Par. 9. The machinery provided by
law for the registration of force Oc
tober 1st, 1908, shall be used to carry
out the provisions of tills section, bx-
copt where inconsistent with same:
the legislature may change or amend
the registration laws from time to
time, but no sueli change or amend
ment shall operate to defeat afiy of
the provisions of this section.
Sec. 2. He it further enacted, That
whenever tlie above proposed amend
ment to the Constitution shall be
agreed to by two-thirds of tlie mem
bers elected to each of tho two houses
of tho General Assembly, and tho
samo has been entered on their jour
nals with the ayes and nays taken
thereon, the Governor shall cause
said amendment to be published in
at least two newspapers in each Con
gressional District in this State for
the porlod of two months next pre
ceding the time of holding the next
general election.
Sec. 11. Hu it further enacted, That
the above proposed amendmentshall
be submitted for ratification or re
jection to the electors of this State
at tlie next general election to be
held after publication, as provided in
tlie second section of this Act in tlie
several election districts of ' tills
State, at which election every per
son shall be qualified to vote who is
outitled to vote for members of tlie
General Assembly. All persons vot
ing at said election In favor of adopt
ing the proposed amendment to the
Constitution shall have written or
printed on their ballets the words
“For amendment of Constitution,
providing qualifications of voters,"
and all persons opposed to the adop
tion of said amendment shall have
written or printed on their ballots
the words, “Against amendment of
Constitution providing qualifications
of vot.rs.”
Sec. 4. Be it further enacted, That
the Governor be, and he is, hereby
authorized and directed to provide
for the submission of the amendment
proposed in tins Act to a vote of tlie
people, as required by tlie Constitu
tion of this State in paragraph one of
section one of article thirteen, and if
ratified the Governor shall, when he
ascertains such ratification from tlie
Secretary of State, to whom the re
turns shall be referred in the man
ner as in cases of elections for mem
bers of the General Assembly, to
count and ascertain the result, issue
his proclamation for one insertion in
one of the daily pnpers of this State,
announcing such result and declar
ing the amendment ratified.
Now, therefore, T, Hoke Smith.
Governor of said State, do issue this
my proclamation, hereby declaring
that tlie foregoing proposed amend
ment to the Constitution issubmitted
for ratification or rejection to the
voters of the State qualified to vote
for members of tho General Assem
bly at the ge|}oral election to be held
ou Wednesday, October 7th. 1908.
