Georgia law does not specify a
minimum age for school attend
ance and the fixing of such policy
is “an administrative question to
be decided by each county or city
board of education,” Attorney Gen
eral Eugene Cook has ruled in an
unofficial opinion.
The ruling points out that while
Georgia has a statute providing
that “admission to all common
schools shall be gratuitous to all
children between the ages of six
and 18 years,” the State Supreme
Court has held that that provision
“is not a limitation as to the ages
of children who may be taught”
but rather “a statement that all
children between the ages of six
and 18 shall be taught free.”
“The Compulsory School Attend
ance Law requires that all children
between their seventh and 16th
birthdays be enrolled in a public or
private school,” the opinion reads.
“There is no provision as to any
minimum age that child must at
tain prior to being enrolled in a
public school. Several such bills
were introduced in the recent ses
sion of the General Assembly but
non passed.
