ARTICLE VIII
EXCEPTIONS and modifica
tions
sec. 81: Height
1. R-Residence Zones
a. A structure may be in
creased in height, providing
the required size yards are
increased one (1) foot for each
additional three (3) feet in
height.
2. Structures Permitted Above
Hieght Limit:
a. The following structures
may extend above the estab
lished zone height regulations
providing that they shall not
be used primarily for dwell
ing pruposes:
(1) chimneys or smokestacks.
(2) Cooling Towers.
(3) Elevator Penthouses.
(4) Fire or parapet walls.
(5) Flagpoles.
(6) Gas Containers.
(7) Radio or television
towers.
(8) Roof Signs.
(9) Skylights.
(10) Stairways.
(11) Steeples or spires.
(12) Water tanks or stand
pipes.
(13) Similar structures.

Section 82: Area
1. Yard Regulations:
Where the yard regulations
cannot be reasonably complied
with or their application deter
mined on lots or peculiar sh
ape, location or topography,
such regulations may be modi
fied by the Board of Appeals.
Section 83: Setbacks:
1 Side Yard Waived:
For the purpose of side yard
regulations, the following dw
ellings with common party walls
shall be considered as one bu
ilding occupying one lot.
a. Semi-detached dwellings.
b. Row Dwellings.
2. Projection Into Yards:
a. Cornices, sills, eaves,belt
courses, chimneys or other si
milar architectural feature may
extend or project into a req
uired side yard.
b. Unroofed platforms, land
ings, steps or balconies may
extend or project into a re
quired side yeard.
Section 84: Fence, Wall or
Landscape Feature:
A fence, screen, solid wall
or shrubbery not exceeding six
(6) feet in height between the
building setback line and the
street, may be located in any
required front, side or rear
yard except where prohibited
by corner setbacks for inter
section visibility.
Section 85 LOT OR RECORD
Where the owner of a lot
at the time of the adoption of
these regulations or his suc
cessor in title thereto does not
own sufficient land to enable
him to meet the minimum lot
size requirements of these re
gulations, such lot may be used
as a building site, providing the
Board of Appeals and Health
Officer find that the owner’s
building plans are consistent
with existing health codes and
the owner’s building plans will
not otherwise adversely effect
the health, safety, or welfare
of the area.
85. 1 ADJOINING AND VA
CANT LOTS OR RECORD: If
two or more adjoining and va
cant lots with continuous front
age are in a single ownership
at the time of the adoption of

In the case of a corner lot which abuts on two

less than the required setback
not less than the average of
the existing setbacks on the de
veloped lots. This section shall
not be construed to allow less
setback on lots which extend a
developed area.

terms of these regulations may
be varied by the Board of Ap
peals in a manner that will
be in harmony with the char
acter of the neighborhood, and
will insure substantially the
same character of occupancy
and intensity of land use no

space no lower than that per
