Arson Probe Continues

Superior Court Clerk Cecil McClure’s
office were intact. Several inches of
water gathered on the floor of the vault,
which is temporarily being used as the
clerk’s office.
The county commission split into
teams to secure temporary and semi
permanent office space and get rid of the
apparently dangerous ruins of the
courthouse.
Commissioner Crawford Roe said he
contracted with Continental Wrecking
Co. of Atlanta to level the courthouse for
$3,500. Roe said bids for the brick have
neared SI,BOO and he has hopes that the
sale of rubble from the building will pay
for nearly ail the cost of raising it.
County officials meanwhile are using
various offices.
Tax Commissioner Donald Majors,
whose records were not damaged as
duplicates of tax bills were being
computer processed in Atlanta, is using
an office in the County Building facing
Maple Street.
County Deals With

Forsyth County Bank and the Bank of
Cumming to see which bank would get
the county’s business for the next year.
The Bank of Cumming bid an interest
charge of 2.95 per cent per annum for
money borrowed during next year by the
county if the contract included the
county’s checking account.
The Forsyth County Bank’s bid was
2.89 per cent per year with no mention of
the checking business.
Both bank’s promised to pay the legal
high on money deposited by the county in
90-day passbook savings accounts.
The commission accepted the low bid
by the Forsyth County Bank.
Louis Hansard of Cumming was named
to the Cumming-Forsyth Planning and
Zoning Board. Hansard was nominated
by J. Lanier Bannister, whose district he
will represent. He will occupy the spot on
the board vacated by Jimmy Brackett,
who moved from the county.
The Commission agreed to ask the
legislators representing the county in the
Georgia General Assembly to pass a
local bill calling for a referendum to
decide if the county should have a county
police force.
Commission Vice Chairman Lanier
Bannister said he would like to see if the
people want to get politics out of police
business.
The Commission also discussed
sources of revenue other than ad valorem
Thieves Strike 3 Schools
Vandals and thieves struck at three Forsyth County Schools over the
weekend.
Midway and Sawnee schools were vandalized Saturday night by thieves
who took miscellaneous items including two television sets and four turkeys.
Burglars broke into the electronics lab at Forsyth County High School
broke into the drink machine and lifted other items Sunday night
Sheriff Donald Pirkle said four young men are in custody and are being
questioned in connection with the break-ins.
The vandals “tore up everything” at the two elementary schools, the
sheriff said. They smashed windows and turned over desks, according to
Pirkle.
At Midway stolen goods included an electric adding machine, four
turkeys, some tomatoes and oranges, approximately $2 in change and a
large trash can.
Taken from Sawnee were two television sets, a record player and two 16
mm movie projectors. A third television set was broken and left behind by
the thieves.
The names of the possible suspects were being withheld pending the
completion of the investigation. Ther sheriff said the Georgia Division of
Investigation (DOI) is assisting in the cases.

Commissioner Larry Watson got bids
from two local mobile home dealers for
three office trailers. The low bidder was
Da-Je Mobile Homes Inc., which will sell
the county three office trailers for $3,652
each or a total of $10,956.
Two of the trailers will be placed up
against the clerk’s vault and will be used
for offices of the tax commissioner and
court clerk. The third mobile unit will be
attached to the ordinary’s vault and used
by the ordinary and registrar.
Commissioners expect the mobile
offices may have to used for as long as
two years or at least until a new cour
thouse can be constructed.
A location for superior court
proceedings is still in doubt although the
gymnasium at the old upper elementary
school looms as the most likely prospect.

board action.

unlikely and a hotel-motel tax would be of
little good since the county has but two
small motels.
Commissioner Larry Watson said a
local option one per cent sales tax would
not help much. “We don’t sell anything.
We’re more or less a bedroom com
munity,” Watson said.
Bannister said he would put a local
option income tax on a priority basis in
making a recommendation to legislators.

nine months of 1972 numbered 589
compared to 491 in the first nine months
of this year. Mobile home permits so far
this year number 438 compared to 466 for
the same months of 1972.

The afternoon was spent in
a very pleasant and sociably
way, with the best of order.

Later in the year it was
found that the contractor
could not finish the building
with three floors on account of
a shortage of money, so it was
decided that the third floor
would be left off. Then it was
later learned that the con
tf-actor could not finish the
building with the money left
in his bid. The contractor,
Fred Wagener, borrowed the
money from the new Bank of
Cumming and the county
guaranteed the loan. Wagener
then left town with the money.
The Bank of Cumming
finished the building and then
the county would not pay for
this work. A lawsuit resulted
and still, the county would not
pay. Later in 1913, when a new
ordinary, W.J. Tidwell, was
sworn in, one of his first acts
was to apy this in
debetedness to the Band of
Cumming.
This old building that was
finished in controversy and
now, destroyed by fire at the
hands of apparent arsonists,
is no more.

The new Forsyth County Sub
division Code specifies:
'‘Subdivision” means all di
visions of a tract or parcel
of land into two or more lots,
building sites, or other di
visions for the purpose,
whether Immediate or future
of sale, legacy, or building
development, and includes all
division of land involving a
new street or a change in
existing streets, and Includes
resubdivision and, where ap
propriate to the context, re
lates to the process of sub
dividing or to the land or area
subdivided: Provided, how
ever, that the following are
not Included within this def
inition:
"The division of land into
parcels of five acres or more
where no new street is in
volved” (this provision means
each parcel to be five acres
or more).
The same Code provides:

by the Planning Commission

and extended in the total am
ount of ONE THOUSAND FOUR
HUNDRED SIXTY FIVE and
20/100 ($1,465.20) DOLLARS.
By virtue of Power of Sale
contained in said Security
Deed there will be sold by the
undersigned at public outcry to
the highest bidder, for cash
before the Courthouse Door
of Forsyth County, Georgia,
within the legal hours of sale
on the First Tuesday in De
cember, 1973, the same being
December 4,1973, the follow
ing described property:

Hills Estates Subdivision, sh
own on Subdivision Plat sur
veyed in and prepared by Pey
ton-Gerard and Associates,
Surveyor, dated July 28, 1960;
recorded in Plat Book #3, Page
175, in the Office of the Clerk
of the Superior Court ofFor
syth County, Georgia, said Lot
lying and being in the 14th Dis
trict, Ist Section of Forsyth
County, Georgia, and refer
ence is made to said Subdi
vision plat for a more parti
cular description of the within
described Lot #5.
The debt secured by said Se
curity Deed having been decl
ared due because of default in
the payment of the loan, and
the debt remaining in default,
this sale will be made for the
purpose of paying the indebt
edness, attorney's fees and the
lawful expenses of said sale.
Said property will be sold to
the highest bidder for cash.

subject to all outstanding ad
valorem taxes, assessments,
and/or easements and/or re
