A man told me the other
day he had done several
thousand dollars of work for
the federal government and
although the job had been
finished three months he
hadn’t been paid yet. Is it
comforting to know that
things haven’t changed in
150 years?
In 1830 Reuben Thornton
was trying to collect $104.25
owed him by the United
States and/or the Cherokee
Nation. Reuben signed a
lease with the U.S. and the
Nation to rent what was then
known as Vann’s Old Ferry.
This lease entitled him to use
the lower Ferry plantation
and the upper plantation
which extended to Gothard’s
Ford. Also, he had the use of
the house, tenements, out
buildings and the ferry. All
this property was on the west
bank of the Chattahoochee
River. The lease was signed
Oct. 1, 1827 and was to run
for eight years, with rent be
ing S2OO a year. It was signed
by Hugh Montgomery as In
dian Agent for the U.S. in the
Cherokee Nation and John
Martin, the treasurer of the
Nation.
Now came the fly in the
ointment in the form of Winn
who ran a ferry on the east
bank of the Chattahoochee in
Hall County. Winn was using
both banks, in other words
he loaded people on his side,
took them across and put
them off. Good idea, huh?
But, when Thornton loaded
his and took them across,
Winn didn’t let him use his
bank. Matters came to a
head when Winn had Thorn
ton arrested for negotiating
with and leasing land from
Indians, thereby violating
the Intercourse Law.
Thornton first laid out ex
penses at Gainesville Court,
in the amount of $138.75 for
which he was paid, but a fur
ther trip to Savannah which
cost him $104.25, he was not
reimbursed for, although it
was undertaken at Mon
tgomery’s request.
The Expense Tally carried
some interesting items.
First, a trip to Greensboro to
see McAllister, the attorney
general. McAllister advised
him to hurry to Savannah
and see Judge Cay lor before
Winn could sign a warrant.

McAllister told him to hurry
as quickly as possible and he
had to override the horse
causing him injury which he
had to compensate for.
The War Department
threw it back to Montgomery
to file the papers. The col
onel mentioned was Thomas
F. Foster, whose letters
were addressed to him at the
House of Representatives,
Washington City.
“Set forth to win that both
of the governments have in
my lease bound themselves
to put me in peaceable and
quiet possession of and to
warrant and defend the said
peaceable possession of the
said lands, tenements and
Ferry Bank...” “It certainly
will not be contended that I
was ‘warranted’ and
‘defended’ in a peaceable
and ‘quiet’ possession, when
my person was arrested
under the laws of the United
States and forced as a
prisoner to attend the
Federal Court, at the
damage of $104.25 actual
money out of my pocket.”
Thornton threatened to
deduct the amount from rent
he would owe on the ferry
and questioned why Mon
tgomery paid the fees for the
attorney he sent him to, but
wouldn’t pay Thornton’s
travel expense. “It is equally
a damage to me to have to
pay a large sum of money
out of my pocket for travel
ing expenses, etc. as it would
have been for me to pay a
lawyer’s fee, it matters
nothing to me whether a
lawyer had it or a tavern
keeper got it,...and if the loss
of upwards of a SIOO is not a
‘damage’ in these hard
times, then I do not unders
tand the purpose of the
word.”
I would like to be able to
say Thornton got his money
but the cover on the file
recommended that he not be
paid per H. Montgomery.

April 1 Deadline To Return
All Property For Taxation
April 1, is the deadline for
“returning” property for
taxes. All real and personal
property whether owned by
individuals or corporations,
resident or non-resident is
liable to taxation, except as
otherwise provided by law.
(Georgia Code, section 92-
101).
All property must be
“returned” for taxation at
its “fair market value.”
(Georgia Code, section 92-
5701).
The word “returned in tax
terminology means reported
and the words “fair market
value” as defined in Georgia
Code, section 92-5702, as
amended in 1978 means
“what a knowledgable will

that is, those not permanent
ly affixed to and part of real
estate, for example:

determined by resorting to
any reasonable, relevent and
useful information available
including, but not limited to:
the original cost of the pro
perty, any depreciation or
obsolesence, and any in
crease in value by reason of
inflation.

returns are being mailed to
specific individuals who

Georgia law requires all tax
payers to “return” their real
and personal property for
taxation. If you fail to
“return” your property by
April 1 and the assessor later
“finds” this property, the
taxpayer must pay the
amount of taxes due and 10
per cent penalty may be add
ed. (Georgia Code, section
92-6913).
Most common among per
sonal property which is not
“returned” by tax payers
are boats, motors, swiin
docks, and boat docks, boat
houses (boat trailers are
licensed therefore not repor
table), motor bikes, trail
bikes and golf carts are
licensed for highway opera
tion, garden tractors and ac
cessories, some farm
machinery, equipment and
implements. Personal pro
perty within the home such
as furniture, appliances,
clothing, and other items
normally a part of or kept
within the home are no
longer subject to Ad
Valorem taxes therefore,
should not be “returned.”
Most common among real
properties which are not
“returned” are the addition
of a room or rooms and other
additions or modifications to
the home such as decks, por-

The only property owners
who do not have to file a
return are those who have
not altered or made any
changes in the property dur
ing the past year. And, those
who have obtained a building
permit before making im
provements since these im
provements are also
automatically picked up by
the assessors.
This is not a new require
ment, it is being brought to
the attention of all taxpayers
because property, both and
personal is being “found”
which should have been
reported.
Most owners of businesses
and farm equipment
“return” their property as a
routine matter because their
tax consultants know proper
ty taxes are deductable from
federal and state income
taxes. All individuals and
corporations who itemize
their deducations are entitl
ed to deduct property taxes
from federal and state in
