Pre-Trial Services Is Working Well Here
Preliminary evaluation in
formation on the Blue Ridge
Judicial Circuit’s Pre-Trial
Services Project has been
released by the office of the
Ninth Judicial District Court
Administrator in Canton.
The Pre-Trial project is co
sponsored by Cherokee, For
syth, Gilmer, Pickens and
Fannin Counties in a
cooperative funding agree
ment with the Georgia State
Crime Commission.
The District Court Ad
ministrator, John T. Shope
of Canton stated, in a
prepared release, that the
Pre-Trial Services project
has three primary objec
tives: diversion of defen
dants from the normal court
process where court costs,
restitution and counseling
can provide an alternative to
the very costly trial process;
the screening of defendants
in the county jails for con
sideration for release pen
ding court action on their
cases; and, the initial inter
view to determine indigency
for the assignment of ap
pointed counsel.
For the calendar year 1979,
project staff collected a total
of $15,143 in court costs and
$15,818 in restitution
payments from individuals
in the program. Estimated
jail cost savings to the coun
ties for the same period of
time, based upon a savings
of $4.50 per prisoner per day,
exceeded more than $51,300.
In addition, Shope stated
that indirect savings in court
operations costs based upon
a state average of $1,900, per
felony case and SBSO per
misdemeanor, exceeded
$450,000, during the same
period. Shope states that
although these estimates of
savings of court operational
costs are not pure savings to
the county, the counties bear
a sizable portion of costs of
cases that are tried by a
jury.
Don Cochran, Probation
Officer with the Department
of Offender Rehabilition’s
Ellijay Office acknowledges
the services provided under
the Pre-Trial Program.
“One of the problems
associated with Pre-Trial,”
he says, “is that most of our
citizens are not familiar with
the benefits that Pre-Trial
provides or with how the pro
gram operates.”
“The screening of indigent
defendants for appointment
of counsel by the court has
been a major side benefit of
the program,” according to
Shope. “Appellate court
decisions place this respon
sibility on the trial judge and
if this can be acco lished at a
time prior to the time of ar
raignment, court dates do
not have to be postponed in
order to afford indigent
defendants opportunity to
confer with their attorneys.
In addition, the District
Administrative Office an
nounced that the Blue Ridge
Pre-Trial Services program
has been selected for inten
sive evaluation by the State
Crime Commission’s evalua
tion team.
“The citizens of the coun
ties in the Blue Ridge Circuit
are fortunate to have local
leadership that recognizes
the ultimate tax savings that
Pre-Trial Services pro
vides,” said Shope.
The Pre-Trial Services
project appears to be an ef
fective, efficient mechanism
for providing workable alter
natives to an ever increasing
criminal caseload. Its
benefits span the criminal
justice system, reducing jail
costs, court operational
costs and even welfare
payments to the families of
program participants.
The Pre-Trial project
employs two full-time
counselors and a secretary.
The cost of operating the
program for the entire cir
cuit during calendar year
1979 was $42,000. Federal
funds provided 60 per cent of
this amount while the
balance was shared by the
five counties in the circuit on
a pro-rate basis.
Congressman
Moves Office
Ninth District Con
gressman Ed Jenkins has
moved his Gainesville
District Office to a new loca
tion. The office, which
serves as the central office
for the Congressman’s
district operations, is now
located in the “Old Coca
Cola Building,” at 301 Green
Street.
