Deaths
Margaret Bennett
Margaret Westbrook Bennett, 65, of
Route 1 Gainesville, died on Oct. 9,
1985 in the Northeast Georgia Medi
cal Center following a short illness.
Services were held Oct. 10 at the
New Hope United Methodist Church
with interment in the church ceme
tery. The Revs. James Styles, Ralph
Harris and Bud Sutton officiated.
Mrs. Bennett was a native of For
syth County and lived here most of
her life. She taught for 35 years in
Forsyth County schools including
Matt Elementary, Chestatee Elemen
tary and Cumming Elementary,
where she retired after 25 years of
teaching. She was a member of the
New Hope United Methodist Church.
Survivors include her husband,
Ray Bennett of Route 1, Gainesville;
daughter and son-in-law, Beverly and
Dean Dodd of Gainesville; daughter
and son-in-law, Betty and Clyde
Warner of Marietta; a son, Roger
Ray Bennett of Gainesville; grand
daughter, Cindy Ann Dodd of Gaines
ville and grandson, Nathan Scott
Bennett of Gainesville; a brother,
Wiley Westbrook of Columbus; two
sisters, Elizabeth Smith of Gaines
ville and Evelyn Higginbotham of
Gainesville and a number of neices
and nephews.
Little-Davenport Funeral Home
was in charge of arrangements.
Dennis Kilgore
Funeral services were held Friday,
Oct. 11,1985, at 2 p.m. at the chapel of
Ingram Funeral Home for Dennis
Wayne Kilgore, Jr., 20, of Drew Road,
Cumming Route 4.
The Rev. Bill Gibson officiated the
service for Mr. Kilgore, who died
Wednesday, Oct. 9, 1985. Interment
was held in Hopewell Christian
Church.
Surviving Mr. Kilgore is his father,
Dennis Wayne Kilgore, Sr., of Du
luth; his mother, Mrs. Tony Barrett
of Duluth; four sisters, Mrs. Kenneth
(Kay) Robinson, Miss Becky Kilgore,
Miss Tina Kilgore and Miss Jennie
Kilgore, all of Suwanee; a brother,
Steve Barrett of Duluth; a grand
mother, Mrs. Nellie Kilgore of Du
luth; great-grandmothers, Mrs. Ellie
Weaver and Mrs. Eula Painter, both
of Ellijay; and several other rela
tives.
Bernice McGinnis
Funeral services were held Thurs
day, Oct. 10,1985, at 3 p.m. at Bethle
hem Baptist Church for Mrs. Bernice
Brannon McGinnis, 75, of Bethelview

The Rev. J.T. Sewell and the Rev.
Jimmy Orr officiated the service for
Mrs. McGinnis, who died Tuesday
evening, Oct. 8, 1985. Interment was
held in the church cemetery.
Surviving Mrs. McGinnis are her
two sons, Charles and Morris; four
grandchildren; one great-grand
child; five sisters-in-law, Mrs. Arthur
(Bertha) Cowart, and Mrs. Oford
(Bertie) Fagan, both of Cumming,
Mrs. Buell (Olive) Brannon, Mrs.
Randall (Mary) Brannon, and Mrs.
Durant (Ruth) Brannon, all of At
lanta; and a number of other rela
tives.
Ingram Funeral Home was in
charge of arrangements.
Samuel Stark
Memorial services will be held
for Samuel M. Stark Jr., 80, of 215 Old
Holcomb Bridge Way, Roswell, for
merly of Cumming, who died
Wednesday, Oct. 9,1985.
Surviving Mr. Stark other than his
wife, is a daughter, Mrs. Sydney
Martin of Concord, Mass.; three
grandchildren, and several other rel
atives.
Ingram Funeral Home is in charge
of arrangements and will announce
the date of the memorial services
later.
Albert Sweatman
Funeral services were held Thurs
day, Oct. 10,1985, at 2 p.m. at Daves
Creek Baptist Church for the Rev.
Albert “Son” Sweatman, 54, of Daves
Creek Road, Cumming Route 10.
The Rev. Carrell Pruitt and the
Rev. Theston Vaughan officiated the
service for Rev. Sweatman, who died
Tuesday, Oct. 8, 1985, following a
sudden illness. Interment was held in
Daves Creek Cemetery.
Surviving the Rev. Sweatman is his
wife, Mrs. Faustine Stancil Sweat
man of Cumming; a son, Joey Sweat
man of Cumming; a brother, Roy
Sweatman of Cumming; four sisters,
Mrs. Lela Pagh, Mrs. Ethel Bene
field, Mrs. Marie Pruitt and Mrs.
Sara Howard, all of Cumming; a
mother-in-law, Mrs. Fannie Mae
Stancil of Alpharetta; brothers-in
law, Roger Stancil of Cumming and
Bradford Stancil of Alpharetta; sis
ters-in-law, Mrs. Nelda Roach of Al
pharetta; Mrs. Sybil Hubbard of
Cumming; and Mrs. Ellen Bales,
Mrs. Willene Jones and Mrs. DeEtte
Bennett, all of Alpharetta; and a
number of neices and nephews.

Setback variance is denied

An addition to an industrial build
ing in southwest Forsyth County must
be relocated in order to comply with
county setback requirements.
That was the ruling Monday night
by the Forsyth County Board of Ap
peals, which denied a zoning variance
for the addition.
Preston Wright was seeking a side
yard variance of 16 feet for a storage
shed added on to a commercial build
ing on Creamer Drive.
Don Kaiser, who is leasing the
building from Wright, said there was
a misunderstanding about setback
requirements when the shed was con
structed.
The 16-foot variance was being
sought to allow the shed to remain 9
feet from the property line instead of
the required setback of 25 feet.
Five residents at the appeals board
meeting expressed opposition to the
variance.
One of those residents said the shed
would have been in compliance if it
had been added to any other side of
the building.
Don Creamer, another resident,
expressed concern that approval of
the variance would set a precedent.
Following comments by residents,
the board voted to deny the variance,
meaning Wright may appeal to the
board of commissioners, or relocate
the shed.
In other business, the board
granted approval to four variances:
• Judy and William D. Wheeler,
side yard variance of 6.1 feet, to allow
a residence to remain 18.9 feet from
the property line on lot 13-A, Section
A, of Oak Grove subdivision. The
applicants said they didn’t know until
after they purchased the residence
that it was not in compliance with
setback requirements.
• William F. Brockman, front yard
variance of 40 feet, to allow a resi
dence to remain 40 feet from the edge
of the right-of-way instead of the
required 80 feet. The affected prop
erty is lot 67, Block C, in Mountain
Side subdivision. Reasons given for
the variance included a narrow lot
depth of only 128 feet, and hilly condi
tions on the lot. Appeals Board Chair
man Charles Smith said he had
inspected the lot personally, and
agreed with Brockman that 40 feet
from the right-of-way was the only
reasonable place to put a residence.
• Patricia A. Richards, lot size
variance of .26 acre, to place a mobile
home with another residence on 1.74
acre. The mobile home will serve as a
residence for Mrs. Richards’ 67-year

old mother, who is ill. The variance
was granted under the “hardship”
rule, meaning it must be renewed
every year and is valid only as long as
the hardship exists.
• Jerry L. Henderson, front yard
variance of 40 feet, to build an office
building next to a doctor’s office at
the intersection of Turner and Bald
Ridge Marina roads. The board voted
to grant Henderson “up to” 40 feet,

Board members took no action on a
request for a front yard variance of
three feet by David Garmon, who was
not present at the meeting.
Garmon will be contacted and in
formed that if he doesn’t attend the
next appeals board meeting, his re
quest will be denied.
