FATAL WRECK A sign on an 18-wheeler involved in a fatal
traffic accident Wednesday sends an unheeded message. Cumming
resident Beverly Annette Bennett, 33, was killed in this accident when
the car she was driving collided head on with the transfer truck, which
law enforcement officials said was on the wrong side of the road. The
driver, 47-year-old George Dewberry of Atlanta, was charged with sec
ond degree vehicular homicide.
Woman accused of helping Potts back in jail
The young woman accused of aiding convicted killer
Jack Potts in his aborted escape attempt from the For
syth County Jail was taken back into custody Wednesday
after a superior court judge accused her and her attorney
of “manipulating” the court and revoked her bond.
Kelly Gwen Charles, charged with armed escape for
allegedly giving Potts the gun used in his jailbreak, was
taken from the courtroom in tears Wednesday after
Judge Frank Mills revoked her bond for failing to be pre
sent when her case was called for trial earlier that day.
Her attorney, Martin Findley, told Mills that Charles’
absence from the courtroom was due to a “miscommuni
cation” on his part as he had not expected the case to be
called last week.
Mills, however, was not satisfied with that excuse. The
judge said it seemed more like manipulation to him and
ordered the defendant remanded into custody.
Mills’ irritation stemmed from Charles’ request, min
utes before jury selection was to begin, to have another
attorney appointed for her due to a potential conflict of

interest with Findley because of the attorney’s previous
representation of Potts.
Findley told the court that he had planned to obtain a
waiver from Potts that would allow him to use evidence
favorable to Charles that could be detrimental to his for
mer client in his coming escape trial. But the attorney
said he had not had sufficient to time to obtain that waiver
as he had been retained by Charles only nine days before
her trial.
Mills responded that he felt the request for another at
torney was simply a move to get the case continued, but
said he would postpone the trial until other counsel was
obtained for Charles.
The judge had earlier denied a motion for continuance
made by Findley who had argued that he had not had
adequate time to prepare the case.
During a hearing on the issue Thursday, Mills said
Charles would remain in custody until he is convinced she
has had enough time to prepare her defense.
