ness. William Rawson, Jr. is
proposing a day care center and
retail store in a 14,400 square foot
building.
A proposed gift shop and mini
storage facility would be built on
Browns Bridge Road east of Ga.
Hwy. 400. The rezoning of 1.15
acres of land from agricultural to
Commercial does not conform to
the master plan. A 7,200 square
foot building is proposed.

Padgett on November 1 to rein
state the deputies and “impose
only that measure of discipline as
warranted by the Personnel
Director.”
Padgett responded to the order
by sending a letter to the Civil
Service Board on November 2
stating that “1 do not recognize
your ‘directive’ of November 1,
1995 as a lawful act...l do not
intend to comply.”
In the petition filed on
Wednesday, the Civil Service
Board states the reasons for their
disagreement with Padgett over
his interpretation of the “emer
gency situation” section of the
Civil Service Rules.
The petition stated: “...the
belated invocation of the emer-

No ACLU lawsuit is looming

Nelson said.
Bob White, president of
Forsyth’s Friends of the Library,
has been asked to attend the meet
ing.
“I did not call the ACLU.
They called me,” White said. “I
explained I was not interested in
getting involved in any lawsuit. I
will meet with them and share any
information I have about the situa
tion.”
White and the Friends have
supported the library board’s poli
cies and open access to library
materials for ail age groups.

Baptist North administrators will
learn whether SHPA needs addi
tional documentation or questions
answered.
Baptist North submitted a
scaled-down CON for an $18.3,
41-bed facility after withdrawing
an application for a S2B million,
44-bed facility during the summer.
While the first application called
for a 92,000 square foot hospital,
the revised application calls for a
78,040 square foot facility.
The original application was
withdrawn at the last minute June
27, as Baptist North officials were
warned that SHPA would deny the
CON request because of the cost
of the project. In the face of possi
ble denial, hospital administrators
chose to withdraw the first appli
cation to avoid a 120-day waiting
period for reapplication.
Strong opposition by area hos
pitals such as North Fulton
Regional, Gwinnett and
Gainesville also could have jeop
ardized the approval of the CON
as it could again.
requesting a rezoning from resi
dential to commercial business for
the construction of a 16,400
square foot strip shopping center
on Atlanta Hwy. and Fransis Road.
The shopping center would sit on
3.28 acres of land. The rezoning
request does conform to the master
plan.
A 81,658 square foot shopping
center is the proposed use for the
rezoning of 9 acres of land on
Canton Hwy. and Bethelview
Road. The request, by Jebco
Ventures, Inc. is for commercial
business zoning from agricultural
and residential zoning. It does
conform to the master plan.
Two new subdivisions are
being requested at Tuesday’s
meeting including the rezoning of
10.95 acres of land from agricul
tural to residential on Lanier
Farms Road near Old Keith
Bridge Road. Dennis, Ella, Danny

currently being used as a mobile
home park.
A second subdivision on
Crossroads Road would only
include two houses on 1.57 acres
of land. JPS Development, Inc. is
requesting the rezoning from agri
cultural to residential. The two
houses would have a minimum of
1,200 square feet.
Both subdivisions conform to
the master plan.
James J. Heard is requesting
the rezoning of 1.39 acres of land
from agricultural to residential to
be combined with the existing
Heardmont Farms subdivision on
Matt Hwy. near Settingdown
Creek. The land would contain
one 1,800 square foot house. The
request does conform to the master

Department, Personnel
Department and the Civil Service
Board.
According to the correspon
dence, Padgett recommended that
officer Ron McDowell be sus
pended without pay for 5 days,
and then placed on probation for a
period of 90 days upon his return
to duty. Padgett recommended that
Whitfield and Holcomb be fired.
In response to Padgett’s recom
mendation, Masaschi responded
that he believed the punishment
was “in my judgement too
severe.”

The meeting will be held at
6:30 p.m. at the Forsyth County
Courthouse in the Jury
Assembly/Commissioners
Meeting Room on the second
floor.
Whitfield be suspended for three
days, Holcomb for five days and
McDowell should recieve a writ
ten reprimand.
In addition to Padgett firing
Whitfield and Holcomb, the two
deputies oaths of office were also
voided by Padgett.
The Civil Service Board con
cluded at a meeting on Oct. 31 that
Masaschi has the authority to
“veto a department head’s reocm
mended discipline of an employ
ee.” Any rules not specifically
covered by the rules and regula
tions can be interpreted by
Masaschi. The petition states that
it was within “the prerogative of
the Personnel Director to decide
whether...an emergency truly
existed.

Thirteen rezonings on
county commission
agenda for Monday

The regular Monday meeting
of the Forsyth County Board of
Commissioners will be dominated
by 13 rezoning requests. The
Planning Commission has only
recommended denial for one of
those requests, but several remain
controversial anyway.
One rezoning recommended by
