Development contracted with
land owner Mildred Hansard to
purchase a section of her land on
Old Buford Road. Purchase was
contingent upon rezoning the land
for apartment use.
Realty Development helped
Hansard request annexation of the
land into the Cumming city limits
where higher density apartment
zoning was allowed. The City
Council made the developer
aware rezoning would not be
guaranteed based on annexation.
The city did not, however, inform
Realty Development nor Hansard
of its inclination to deny apart
ment zoning.
After the property was annexed,
an application was filed for apart
ment zoning. Realty Development
provided information about the

The following reports were pro
vided by the Forsyth County
Sheriff’s Department for the peri
od ending July 15.
Old Atlanta Golf Club on Old
Atlanta Parkway reported some
one entered the club through the
rear doors and took a cashier tray
with SSOO cash in it. The incident
took place between July 9 and 10.
A 37-year-old man was arrested

August and September 1994
meetings. At the September meet
ing, the rezoning was denied.
Although information had been
provided regarding traffic and
school impact, the council denied
the request based on impact on
population, schools, water, utili
ties, public safety and streets. To
deny a rezoning, public health,
safety or the general welfare of
the community must be in jeop
ardy.
Realty Development filed the
lawsuit to gain the rezoning.
At the hearing, which began
Feb. 5, 1996, Realty Development
claimed the best use for the land
would be for an apartment com
plex. Hansard had been trying to
sell the land since 1990 with no
for driving with a suspended
license and possession of
methamphetamine July 12. The
man pulled in behind Deputy
David McWhorter and asked if he
had seen someone. McWhorter
had the man step out of his car
and checked his license, which
was suspended. McWhorter also
found the methamphetamine and
some unidentified pills.

The city claimed the land had
not sold because it had not been
marketed properly and Highway
Business zoning was the best use
for the land.
Judge Gault ruled it was appar
ent the land could not be sold for
business use because all other
land around the property had
already been developed for busi
nesses and Hansard’s property
never received an offer.
Gault also ruled the city’s infra
structure would be impacted less
by an apartment complex than it
would from Highway Business
zoning.
The city was given 60 days to
rezone the property to a “more
appropriate” zoning.
A resident on Bailey Drive
reported someone entered her
home between July 11 and 12 and
took a television worth $340.
A resident on Ranch Drive
reported someone poured water
out of a landscaping pool, killing
some fish and damaging plants to
the amount of S6OO. The incident
took place between July 12 and
13.

Ralph Gaither
Mr. Ralph Gaither, 73, of
Canton died Sunday, July 14,
1996 at the St. Joseph Hospital
after an extended illness.
Survivors include his wife,
Miriam Gaither, of Lathem
Town; a son, Ricky Gaither, of
Dalton; daughters, Kathy Fouts,
of Cumming and Joy Turner of
Canton; a brother, Edwin
Gaither, of Bayard, W.V.; a sister,
Leona Lower, of Cumming; and
four grandchildren.
Services were held at 2 p.m. on
Monday, July 15, 1996 at Orange
United Methodist Church.
Interment was in the church
cemetery. Rev. John Ozley offici
ated.
Huey Funeral Home was in
charge of arrangements.

Mrs. Azzie Phyfe Williams, 92,
of Alpharetta, died Sunday, July
14, 1996.

Mr. Laurie (Ty) Tyler
Mr. Laurie (Ty) Tyler, 86, of
Cumming, died Sunday, July 14,
1996. He was an attorney and
had worked for Southern
Railroad for 46 years as a com
puter programmer and auditor.
Survivors include his wife,
Gladys L. Tyler, of Cumming;
daughter and son-in-law, Carolyn
and John Hocking, of Cumming;
son and daughter-in-law, Thomas
and Carol Tyler, of Alpharetta;
grandchildren, Laura and Chris
deCastro, of Norcross, Cindy
Tyler, of Alpharetta, John and
Robin Hocking, of Roswell;
great granddaughter, Elizabeth
Hocking, of Roswell.
Graveside services were held
on Tuesday, July 16, 1996 at 3
p.m. at Sawnee View Memorial
Gardens. The Rev. Gary Armes
officiated.

Mrs. Jean Bell Cherry
Mrs. Jean Bell Cherry, 71, of
Shellman died Friday, July 12,
1996 at Joe-Anne Burgin
Nursing Home in Cuthbert, Ga.
Mrs. Cherry was bom Oct. 23,
1924 in Randolph County, Ga.
She was a retired bookkeeper for
an automobile supply company
and was a member of the First
Baptist Church of Shellman. She
was married to James Thomas
Cherry who died Feb. 27, 1995.
Survivors include two sons,
James T. Cherry, Jr. of Cumming
and Andrew “Andy” B. Cherry
of Albany, Ga.; a daughter,
Cyndi C. Bridges of Fayetteville,
Ga.; a sister, Diana B. Whaley of
Shellman; and seven grandchil
dren.
Services were held on Sunday,
July 14 at 2 p.m. at Rehoboth
Baptist Church in Shellman. The
Rev. Olin Johnson and Rev. Flinn
Gregory officiated. Burial was in
the church cemetery.
