NOTICE OF SALE UNDER POWER
On December 1,1997, John S. Hardegree, Jr.,
and Deborah T. Hardegree executed a note for
Four Hundred Sixty Thousand and no/100
Dollars ($460,000.00), payable to Oakwood
Food & Beverage, Inc., which note with interest
thereon, at the rate of 9 percent per annum,
was payable in monthly installments of
$4,655.00 each, beginning on January 1,1998,
and continuing thereafter on the same day of
each succeeding month, with a final payment
on December 1, 2012, each payment being
applied to the interest then due and the bal
ance to the reduction of the principal amount,
interest being computed on the unpaid princi
pal. Time was made the essence of the con
tract, and the deed to secure debt contained a
provision for the payment of 15 percent of the
principal and interest as attorney's fees, if col
lected by law or through an attorney at law. In
order to secure the payment of said note, John
S. Hardegree, Jr., and Deborah T. Hardegree
executed and delivered to Oakwood Food &
Beverage, Inc., a deed to secure a debt, con
veying the following described land:
All that tract or parcel of land lying and being in
Land Lot 1214 of the 14th District, Ist Section,
Forsyth County, Georgia, and being more par
ticularly described as follows:
Beginning at a point on the northerly right of
way line of Georgia Highway No 53 (60 feet
from the center of said Highway), said begin
ning point being 647.4 feet north 74 degrees 57
minutes 00 seconds East from the southeast
corner of said land lot; thence from said begin
ning point as above determined North 03
degrees 49 minutes 00 seconds West 163.1
feet tn a .noint: thence North 63 decrees 00
minutes 00 seconds east 200.00 feet to a point;

Being the some property as conveyed to
Oakwood Food and Beverage, Inc. by virtue of
Warranty Deed dated January, 1987, in Deed

If there is any change in the ownership or pos
session of the above described property with
out the prior consent of the Second Party, the
entire principal indebtedness secured hereby
and all accrued Interest may, at the option of
the Second Party, be declared Immediately
due and payable or Second Party may change
the terms of the secured Indebtedness or make
other changes as are allowed by law.
Said Deed is recorded in Deed Book 1200, pp.
708-710, clerk’s office, Superior Court, Forsyth
County, Georgia.
Because the said John S. Hardegree, Jr.,
leased the premises to Altaf A. Kanani on
December 1,1998, without the prior permission
of Oakwood Food & Beverage, Inc., Oakwood
Food & Beverage, Inc., pursuant to the provi
sions of said note and the deed aforesaid
securing the same has exercised its option and
declared the entire balance due and collectible
Notice fixing the liability for attorney's fees has
been given according to law. There is a bal
ance due as of December 29, 1998, of
$448,363.25 principal, besides interest and
attorney's fees thereon.
The property will be sold as the property of
John S. Hardegree, Jr., and Deborah T.
Hardegree. Altaf A. Kanani, to the best of the
undersigned's knowledge and belief, is the
party in possession.
The said deed contains a power of sale, autho
rizing the grantee, as attorney in fact for grantor
therein to sell the property conveyed thereby in
order to satisfy said note, as well as subse
quent advances, after advertising the same
once a week for four weeks in the official
gazette of said County, and in accordance with
said power of sale and by virtue thereof the
undersigned will sell the property above
described at public outcry to the highest and
best bidder for cash, on the first Tuesday in
February, 1999, at the place of public sales
