Rouse company plans Forsyth project

planned for southern Forsyth County
by The Rouse Company, owner of
Perimeter Mall and one of the
nation’s premier development com
panies.

Local towing operation not legal

A south Forsyth towing operation
that in the past year has run into mul
tiple allegations of fraudulent busi
ness practices apparently is towing
cars illegally in the state and
impounding them illegally in the
county.

The project would be in the
McFarland Road area at the Fulton
County line.
According to forms filed by the
county’s planning office, Rouse
plans a major mixed-use project that
could include retail, office, hotel and
luxury condominiums or apartments.
The form was filed as the first
step toward reviewing the project as
a development of regional impact, a
process required for major develop-
celed the required “property permit”
that allowed Mazdak Auto Sales &
Service, which also does business as
Mazdak Towing and Service, to tow
vehicles as a for-hire motor carrier,
according to a spokesman for the
transportation division of the Georgia
Public Service Commission.
The loss of the permit came sev
eral months after the state was noti
fied that the company’s liability

the case of Forsyth County, develop
ments of regional impact must be
reviewed by both the Georgia
Mountains Regional Development
Commission and the Georgia
Regional Transit Authority.
A spokesman for The Rouse
Company confirmed Monday that it
has begun the process that ultimately

insurance had been canceled, said
Maria Dorough of the PSC
Transportation Division.
“Their property permit was can
celed in November 2000, which
means they are not legal as a for-hire
motor carrier,” Dorough said, adding
that charging for towing defines the
company as a “for-hire” motor carri
er under state guidelines.
“If they are transporting cars and
are being paid to transport those cars,
they are a for-hire motor carrier. It is
still not legal to operate unless they
have authority through the PSC,” she
said.
Moreover, Deborah Ertzberger, a
business license clerk for the Forsyth
County Department of Planning and
Zoning, said Mazdak also is operat
ing outside its county business
license.
She said the company is licensed
to sell used vehicles or repair or serv
ice them. While towing is allowed as
a service, impounding or storing
vehicles is not.

project viable but said it is too soon
to specify what might be included in
such a development or how large it
might be.
“We have requested a meeting to
understand the process. The county
has filed the first, very preliminary
forms necessary to get such a meet
