Several public hearings
scheduled Monday

The Forsyth County Board of
Commissioners will address vari
ous.changes in county law
Monday including: restrictions on
sewage plants and provisions
requiring residential and commer
cial developments to have a set
back around the development’s
entire perimeter.
Public hearings were delayed
to the fourth Monday in January
due to recognizing Martin Luther
King Day last week.
The county government has
been considering preventing pri
vate entities from owning new
sewage treatment plants. While
private companies would still be
able to build such plants under the
new county code, they would no
longer be allowed to own them.
New sewage plants instead
would have to be turned over to
the county government for owner
ship. Existing private sewage
plants would continue to operate
under private ownership.
Commissioners have also been
considering requiring a 50-foot
exterior setback around the entire
perimeter of major new develop
ments along with a 25-foot buffer
requirement.
Other items expected to be
addressed during the public hear
ings include:
• Revisions to the county's
tree ordinance that would require
more trees on developments.
• An update of the county's
land use plan that includes a map
which recommends preferred
zoning for areas throughout the
county.
• An ordinance regulating
adult entertainment businesses.
• Revisions to the sign code
that would allow signs to extend
out 12 inches rather than six inch
es from business walls.
• Modifying the occupational
tax ordinance to allow staff in the
Planning Department to issue

• Revising the false alarm
ordinance to impose a SI,OOO fine
for each false alarm beginning
with the fourth one within a year’s
time. The ordinance allows for
appeals for the first three false
alarms within a calendar year.
• An ordinance regulating
pawn shops, requiring periodic
reporting by pawnbrokers as well
as special licenses.
• Rezoning 19 acres of land at
Hwy. 369 and Little Mill Road
from agricultural and residential
to commercial to allow a retail
shopping center.
• The denial of a variance for
The Teaford Company Inc. for
property on Friendship Circle
with a 60-foot buffer and 75-foot
setback.
• A request by The Teaford
Company to amend zoning condi
tions for property near the inter
section of Market Place Parkway
and Brannon Road to allow a
buffer variance for more uses than
only a septic area.
• A request by Centex Homes
to amend zoning conditions for
property located on Mullinax
Road near the intersection with
Fowler Road to allow existing
vegetation to remain in place
rather than construct berms
between a neighboring communi

Smoking ban for public places
is on agenda for commissioners

The Forsyth County Board of
Commissioners is considering imple
menting an ordinance that would ban
smoking in public buildings and busi
nesses.
The board had planned to discuss
the topic earlier this month, but post
poned it after the meeting ran longer
than expected.
An ordinance has not been devel
oped, but commissioners may direct
attorneys to draft one after discus
sions Monday. Such an ordinance
would then have to undergo at least
two public hearings before it could be
adopted.
In other business during the regu
larly scheduled meeting, the board is
expected to address:
• Setting qualifying fees for candi
dates to register for the 2004 election.
Qualifying fees cost 3 percent of the
position’s annual salary.
Salaries and qualifying fees are
listed respectively as follows: tax
commissioner, $67,514 with a fee of
$2,025; probate judge, $66,548 with
a fee of $1,996; clerk of court,
$68,430 with a fee of $2,053; sheriff,
$77,016 with a fee of $2,310; chief
magistrate, $62,689 with a fee of
$1,881; coroner, $36,322 with a fee
of $1,090; state court solicitor,
$63,662 with a fee of $1,910; state
court judge, $84,882 with a fee of
$2,546; commissioner, $4,200 with a
fee of $126; school board members,
$1,200 with a fee of $36.
• A request by the Civil Service
Board to increase compensation from
SSO per meeting to SIOO per meeting.
• Hiring Robert G. Betz to update
the county’s recreation plan for
$9,500.
• A change order of $57,585 to
Townley Construction to install a
water main on Robin Walk.
• A change order of $28,436 to
HDR for additional intersection
design work required by the state
Department of Transportation.
• A $157,000 contract with
Geographic Technologies Group to
update the county’s Geographic
Information Systems.
• Reallocating $20,000 of sum
mer school funds for a substance
abuse program at Piedmont Learning
Center.
• A $40,000 bid from North
Cherokee Electrical of Canton to pro
vide traffic signal repairs as needed.
The bid includes an additional
$20,000 for equipment.
• A bid of $29,600 from
McArthur Electric Inc. of Gainesville
for a new generator for the
Emergency 911 Center.
• A bid of $3.2 million from
Pierce Manufacturing of Bessemer,
Ala. for seven fire pumper trucks and
one ladder truck.
• A request from Focus
Development Inc. to rezone 43.9
acres of property located on the west
side of Mathis Airport Road near the
intersection with Bagley Road from
agricultural to residential-4.
• A request from John Coleman
to rezone 119.5 acres of property
located on the east side of Little Mill
Road near the intersection with Parks
Road from agricultural to residential
2.
• A request from Harris Moore to
allow a permit for a custom cabinet
shop on residential property located
on the west side of Dahlonega
Highway near the intersection with
Matt Highway.
• A request from Kelly’s Pond
LLC to rezone 12.2 acres of property
