CHAIR from IB
Georgia.”
Another thing that Bagley
won’t change is a big red tele
phone on the judge’s bench. It
rings downstairs to the office
of the clerk of court.
The phone, which has no
dial, begins ringing when the
user removes it from the cra
dle. The judge will have no
part of any sleek modem tele
phone. Instead, he is quite
happy with the sturdy Western
Electric model that was the
same style used from the late
1950 s to the 19705. Again, not
superstition, just tradition.
Bagley, who is in his early
40s, doesn’t fear technology.
His courtroom is in the
process of being equipped
with a high tech plasma moni
tor for displaying evidence to
a jury.
Across the bench from the
old red hotline is a state of the
art computer with connections
to the courthouse computer
network.
The chair seems to be the
most important connection to
history for Bagley. The chair
was purchased by Forsyth

County in 1977 when the
courthouse was opened. The
chair was first used by Judges
Richard Neville and Marion T.
Pope. Later the chair was also
used by State Court Judge
8.8. Robertson and his suc
cessor, Judge Richard S.
“Stan” Gault. Prior to the cre
ation of the Bell-Forsyth
Judicial Circuit, the chair was
used by Superior Court Judges
Frank Mills and Michael
Roach, along with Gault, who
by then had been promoted to
Superior Court. Bagley began
using the chair when he was
appointed to the State Court
bench by then-Gov. Zell
Miller.
Pope went on to become a
member of the State Court of
Appeals and has now retired
and is again practicing law in
Canton.
“When I first went to the
bench, the circuit had five
counties, Forsyth, Cherokee,
Pickens, Gilmer, and Fannin,”
said Pope. “I think all of them
had a chair that had been there
forever. I used to think that all
the judges that ever preceded
me sat in this chair. It’s kinda
like still presiding justice from
the same chair.”
Pope said he fully under
stood Bagley’s feelings about
using the chair of his prede
cessors. “He could have it
reupholstered,” said the for
mer Court of Appeals judge,
laughing.
“Men, in particular don’t
like to throw out things, any
way. We get an old chair at
home and watch TV, even if
it’s worn out. The king won’t
throw out the throne.”
With the exception of Pope
and Mills, who remains the
senior judge of the Blue Ridge
Circuit, the others judges are
now deceased.
Bagley said that while he
doesn’t consider the chair to
be a monument to his prede
cessors, it does offer special
memories.
“It is a reminder of the
men who have served before
me,” he said. “These men
were real people and had the
same tough responsibilities
that I face each time I rule
from that bench.”

Help for Haiti project
The Sawnee Woman’s Club recently presented Dr. James Whitney with a
check to purchase a portable dental vac, to be used during missionary trips to
Haiti. The club has also helped in other ways to support the efforts in Haiti.
Above, Dr. Whitney accepts the check from club member Amelia Stockton.
