We. the Grand Jury affirm that we have
met 'to determine from the evidence
presented if there I probable cause to
believe that a crime has been commit
ted and that the person or persons
named in the indictment or special pre
sentment committed it." In the course
of our deliberations we returned the

Additionally, we considered and recom
mended an increase in the range of
compensation to be paid to bailiffs
under Court decision 15-12-7 from

Finally, in light of the failure of the
recent decision by the voters of
Forsyth not to authorize the bond pro
posal to fund construction of a new
Judicial Center, and in light of the con
tinuing need for office space, public
record space the need for expanded
facilities for the Sheriff's Department
and criminal detention, which has been
advanced by previous term Grand
Juries, the Grand Jury recommends
the appointment of a citizen task force
to study alternative means for address
ing the real and increasingly urgent
needs for space of the Clerk s Office,
the Sheriff's Department, the detention
center, and public record storage of
Georgia's fastest growing County

PREQUALIFICATION NOTICE
Notice is hereby given to all prospec
tive bidders that the Forsyth County
Board of Education (the Owner") has
adopted a process for mandatory pre
qualification of prospective bidders for
the Shiloh Point Elementary School
project ('the Project'). All prospective
bidders who wish to participate shall
submit their prequalification statement
on Prequalification Statement forms
provided by the Owner on or before
April 12th . 2004 at 3:00 PM by caus
ing same to be received by the
Owner's Director of Facilities at Forsyth

Prequalification Statement forms may

Failure to fully comply with the immedi

The Owner will, on or before April 20th,
2004. notify each prospective bidder, in
writing addressed to the address set
forth on the prospective bidder's
Prequalification Statement, as to
whether it is or is not prequalified to
bid on the Project
All prospective bidders who become
prequalified to bid on the Project shall
be deemed qualified and the Project
shall be awarded, if at all. to the lowest
responsive prequalified bidder unless
one or more of such bidder's qualifica
tions changes after submission of its
Prequalification Statement and before
the award, and such change results in
the bidder being disqualified under the
Criteria, in which event the Project
shall be awarded, if at all. to the next
lowest prequalified bidder who remains
qualified at the time of the award.
Each bidder shall have a continuing
duty to notify the Owner, in writing, in
the event any of its qualifications
change on or after the date it submits
its Prequalification Statement and
before the subject project is awarded
and the construction contract executed
by the Owner. Any award shall further
be conditioned upon provision by the
bidder of appropriate performance and
payment bonds covering the Project as
provided by applicable law.
Any disqualified bidder may respond Io
its disqualification by submitting a writ
ten response to the Owner's Director of
Facilities, to be actually received by the
Owner within three (3) business days
of such disqualified bidder's receipt of
its notice of disqualification Such writ
ten response shall set forth in reason
able detail the reasons why such dis
qualified bidder believes it should have
been prequalified to bid on the Project
The Owner s Director of Facilities shall,
within seven (7) business days of
receipt of any such response, rule
upon the sufficiency of such response
and either declare that such bidder be
deemed prequalified or declare that
such bidder shall continue to be dis
qualified for the Project Such ruling by
the Owner's Director of Facilities shall
be immediately communicated to such
bidder in writing and shall be final and
binding
The Owner reserves the right to reject
any and all bids and the right to waive
any and all formalities and technicali
ties
