Tort reform bill coming down to wire

Unless the Georgia General
Assembly acts with uncharacteristic
lightning speed, the state will not see
a tort reform law passed again this
year.
Both houses are considering sev
eral tort reform bills in their respec
tive judiciary committees. No legisla
tion had passed either house as of
Tuesday with three days left in the
2(X)4 session.

Knox and others are hopeful that
a tort reform law will pass the House
now that the chairmanship is reas

"1 would think the speaker hasn’t
gone to this trouble without some
thing happening,” Knox said.
Knox previously stated that he is
in favor of tort reform that will make
a significant difference, and that the
bills under consideration may not be
the legislation to do the job.
House Bill 1396 protects hospi
tals from liability for civil damages
incurred by independent contract
physicians. House Bill 1399 rede
fines who can testify as an expert
witness in a medical malpractice suit,
which would weaken standards
expert qualification according to the
Medical Association of Georgia.
House Bill 1400 punishes attorneys
for filing “frivolous lawsuits.”
House Bill 1712 combines all
three house bills into one. The com
mittee tried to engross, or finalize,
the bill for passage in the House
early this month. The motion to
engross failed.
Senate Bill 432 would have put a
$250,000 cap on damages paid by
health care providers to a plaintiff in
a malpractice suit.
Zoning
change
for kennel
approved

The Forsyth County Board of
Commissioners Monday approved a
rezoning request that will allow pet
kennels in Johns Creek.
The kennels, however, will not be
the typical run of the mill animal
cages. Instead, the proposed plan is
for a state of the art facility operated
by PETsMART for a "Pet Hotel"
a boarding facility for pets the com
pany has begun at select stores
throughout the country allowing the
owners of dogs and cats to leave their
pets at the store for professional care.
The board unanimously approved
the request from Hendon/Atlantic
Rim Johns Creek to rezone 5.78
acres located on the north side of
McGinnis Ferry Road near the inter
section with Peachtree Parkway from
commercial business to highway
business. Kennels are not allowed in
the commercial business zoning cate
gory.
Commissioners granted the
rezoning request along with the con
dition that animals will not be taken
outside of the building for walks and
the adherence of state health rules
that apply to the cleaning and
removal of animal waste.
Commission Chairman Jack
Conway said the pet hotel will be at
the old Kmart.
The board also addressed the fol
lowing rezoning requests and:
• Approved a request from PC
Homes to rezone 128.86 acres locat
ed on the east side of Tribble Road
near the intersection with Hwy. 20
for a 225-unit single family residen
tial subdivision with a proposed den
sity of 1.74 unites per acre.
• Denied a request from Joe
Barrow for a Home Occupation
Permit for a woodworking business
on Keith wood Drive.
Though the planning commission
recommended approval of the permit
with conditions that would ensure
neighbor’s concern with the appear
ance of Barrow’s property, commis
sioners unanimously rejected the
request.
“I think the intensity ... is too
much for this neighborhood,"
Conway said.
• Approved a request from
Barbara and Sam Palaio to rezone 1
acre located on the east side of Hwy.
9 near the intersection with Mountain
Road from neighborhood shopping
to industrial to allow a proposed
manufacturing facility.
• Approved a request from
Candy Hammond to rezone 4.35
acres located on the west side of
Hwy. 306 near the intersection with
Rendering Plant Road from agricul
tural to commercial for a boat stor
age and office development.
• Approved a request from Mike
Katshor to rezone 1.16 acres located
on the northwest comer of Hwy. 53
and Dogwood Path from lake resi
dential to highway business to allow
the proposed use of a painter’s shop.
• Approved a request from
Robert L. Milford to rezone 1.17
acres located on the south side of
Hwy. 369 near the intersection with
Dr. Bramblett Road from agricultural
to neighborhood shopping for a pro
posed beauty shop.
