Judges announce
bids for election

Two judges on the Forsyth
County bench have announced
that they will qualify for elec
tion next week.
Superior Court Judge
David L. Dickinson and State
Court Judge Philip Smith said
they will be candidates.
Dickinson will be seeking
a full four-year term to his seat
in the Bell-Forsyth Circuit.
Dickinson was appointed
in November by Gov. Sonny
Perdue to fill the vacancy left
by the death of Judge Richard
S. "Stan” Gault.
Dickinson began practicing
law in Forsyth County in 1989
in the firm then known as
Lipscomb. Johnson and
Ashway. Two years later, he
co-founded the firm of Hamil
and Dickinson where his prac
tice focused primarily in the
area of commercial litigation
and business related matters.
In August 2000, Dickinson
was appointed by then-Gov.
Roy Barnes to the State Court
of Forsyth County. He was
elected in 2002 without oppo
sition.
He is a member of the
State Bar in both Georgia and
Florida and is a member of the
Council of Superior Court
Judges.
He has been active in a
number of community activi
ties. including the Cumming-
Forsyth Chamber of Com
merce and the South Forsyth
Rotary Club.
"Serving the citizens of
Forsyth County as Judge of
the Superior Court is a unique
privilege,” said Dickinson, in a
written statement.
He and his wife. Karol
Ann. have one child. Ashton.

that the defendants acted in
"bad faith." were “stubborn
and litigious" or caused the
plaintiffs “unnecessary trouble
and expense," Miles said.
He told the jury that
Forsyth County acted in bad
faith because it had maintained
the dam and road until major
repairs were necessary'.
“What did [the county] do
when it cost too much? Zero.
Nada. Nothing." Miles said.
Miles and fellow attorney
Larry' Pankey also argued that
the county unnecessarily
caused the homeowners to sue.
The plaintiffs claimed the cost
difference between repairing
the dam and breaching the
dam was $140,000.
"For $140,000, we don’t
have a problem," Pankey said
during closing arguments. “For
$140,000, out of spite they’re
going to tear [the dam] down."
One juror leaving the court
house summed up the entan
gled dispute. “It gives me a
stomach ache the whole
thing.” she said.

been a faculty member for the
University of Georgia Institute
of Continuing Judicial
Education. Smith is a member
of the South Forsyth Rotary
Club. He is married to Pamela
Boles Smith.

Qualifying to start for 2004 elections

The political season offi
cially begins Monday with
qualifying for races on the bal
lot in the July 20 primary.
Qualifying for local races
will take place beginning at 9
a.m. in the atrium of the
Forsyth County Administra
tion Building, while candi
dates for state offices will
qualify at the Capitol in
Atlanta.
The qualifying for the
Republican primary in Forsyth
will be conducted by the
Forsyth County Republican
Party.
Qualifying for non-partisan
and Democratic candidates
will be done by Chief
Registrar Gary Smith.
The state offices on the
ballot in July will include
Superior Court judge, district
attorney, and state Senate and
House, who will qualify in
Atlanta.
Republican Party qualify
ing will take place in the state
Senate chambers, while
Democrats will qualify in the

division.
County offices to be decid
ed include County Commis
sion posts in districts 2, 4 and
5.
The Forsyth County Board
of Education Posts 3, 4 and 5
will also be up for election.
The 2004 election season
also includes many of the
county’s Constitutional offi
cers.
On the ballot will be sher
iff, clerk of court. Probate
judge, tax commissioner, and
coroner, as well as State Court
judge, solicitor of State Court,
and chief magistrate.
The qualifying will begin
at 9 a.m and continue through
5 p.m. Monday through
Thursday. On Friday, April
30, qualifying will end at
noon for both state and local
races.
