Council denies alcohol license, updates ordinance

The Cumming mayor and
city council denied an alcohol
consumption license as they
approved several amendments
to the city’s alcohol ordinance
Tuesday during their regular
monthly meeting.
Council members denied a
consumption on the premises
license appeal made by
Guillermo Perez and Rincon
Veracruzano for a restaurant at
316 Bald Ridge Road. The
council denied the original
request and Tuesday’s appeal
because the business was locat¬
ed in an area zoned institutional.
The approved amendments
affect areas of the alcohol ordi¬
nance including issuance of
permits in certain zoning dis¬
tricts, “brown bagging,” criteria
for pouring permits and out¬
door sales.

Two Forsyth County men
were indicted last week on
charges of child molestation in
separate incidents from late
2004 and early this year.
Edward Earl Bennett, 60,
of 2625 Mountain Road, was
charged with two counts of
child molestation: Authorities
say Bennett molested a girl
under the age of 16 on May
16.
Ricky Lee Brewer, 45, of
6320 Oak Grove Circle, was
indicted on two counts of
child molestation. Authorities
allege Brewer molested a girl
under the age of 16 between
Dec. 1, 2004 and Feb. 13.
Other indictments returned
by a Forsyth County grand
jury last week include:
• Dustin Francis Buccheri, 34,
of Dahlonega, was indicted on one
count each of interference with
government property, possession of
marijuana with intent to distribute
and obstruction of an officer.
According to court documents,
Buccheri is accused of kicking out
a screen inside a Cumming police
cruiser and running from an officer
while in the possession of marijua¬
na on June 16,2004.
• James Nolan Burns, 28, of
Canton, was indicted on one count
each of possession of methamphet¬
amine with intent to distribute, pos¬
session of drug-related objects and
possession of marijuana in connec¬
tion with an Aug. 12 traffic stop at
Hwy. 9 and Bannister Road.
• Juan Carlos, 24, of 2099
Canton Highway, was indicted on
one count of obstruction of an offi¬
cer for allegedly punching a
Forsyth County Sheriff’s deputy in
the mouth during a Feb. 4 incident
at Carlos’ home.
• Deborah Leith Crownover,
age and address unavailable, was
indicted on one count of first
.degree forgery for allegedly pass¬
ing a forged $400 check on Nov.
25, 2004.
• Kristina Cates, age and
address unavailable, was indicted
on one count each of criminal
attempt to commit burglary and
possession of tools for the commis¬
sion of a crime. Authorities allege
that on Jan. 2, Cates pried open the
back door of J.J. Morley
Enterprises at 75u0 Industrial
Court, Alpharetta.
• Terri Delong, 41, of 3641
Canton Highway, was indicted on
one count each of first-degree for¬
gery and theft by taking.
Authorities allege that in
September 2004 Delong took two
personal checks' from the outgoing
mailbox at the Forsyth County
office of the Georgia Division of
Children and Family Services and
tried to cash one for $537 at the
Check Exchange on Atlanta Road.
• John Pierre Hellerstedt, age
and address unavailable, was
indicted on one count of theft by
taking for allegedly stealing more
than $500 in cash from a woman
living on Melrose Trace March 25.
• Amanda Lynn Lingerfelt, 34,
of Cleveland, Ga., was indicted on
one count of first-degree forgery
for allegedly forging and passing a
check for $8,500 Dec. 11.
• Tracy Jayne McDonald, age
and address unavailable, was
indicted on one count of first
degree forgery for allegedly alter¬
ing a prescription for Lortab on
Jan. 27 so that the amount read 130
pills instead of 30 pills.
• Christopher Charles Mendes,
age and address unavailable, was
indicted on one count of possession
of methamphetamine with intent to
distribute in connection with a
Sept. 1 arrest.

presented a draft of the updated
alcohol ordinance containing
the amendments.
Under the first amendment,
alcohol may only be handled
by employees who have been
issued a permit by the
Cumming Police Department.
The amendment states “at all
times that a Licensee is open
for business, either the
Licensee (if an individual) or at
least one manager that holds a
valid Employee Permit for that
establishment must be on duty.
Alcoholic beverages served for
consumption on the premises

• Approved renovations to
two city water tanks per the
request of Jon Heard, director
of facilities. The council voted
to advertise for bids for the
painting of one 100,000-gallon
tank and one 500,000-gallon
tank. Heard said the repairs
already have been included in
this year's utilities budget.
• Approved a list of 34 alco¬
hol license renewals for 2006
per a recommendation from
Police Chief Mike Eason.
• Heard a report from City
Administrator Gerald
Blackburn on the 2005 Steam
and Gas Engine Show held
Friday and Saturday at the
Cumming Fairgrounds.
Blackburn said the show was
molestation, cruelty to children in
the first degree and four counts of
sexual exploitation of a minor. The
alleged acts, involving a girl under
the age of 16, occurred between
July 1, 1998 and Jan. 30, 2000,
according to court documents.
• Terry L. West, age and
address unavailable, was indicted
on two counts of terroristic threats
and three counts of harassing phone
calls for allegedly threatening to
kill two men over the phone
between Feb. 8 and Feb. 22.
• Marcus William Collier, age
and address unavailable, was
indicted on one count each of
armed robbery, aggravated assault
and entering auto, and two counts
of fleeing and attempting to elude.

Chesley Howard Dixon, 19, of
Alpharetta, were indicted on one
count of possession of marijuana.
Both Gass and Dixon were indict¬
ed on one count of theft by receiv¬
ing motor vehicle. Court docu¬
ments allege the two teens tried to
flee law enforcement while driving
a stolen Volvo on Ga. 400 on July
20 .
