Commissioners take
step to repair collapsed
Flynn’s Crossing wall

Forsyth County Commissioners are
taking steps to repair part of a retaining
wall at a south Forsyth shopping cen
ter. :
At a recent meeting, Forsyth
County commissioners voted 5-0 to
approve moving ahead with a con
struction and maintenance easement
for and payment to the property
owner of a damaged retaining wall
facade at Flynn’s Crossing at the
McGinnis Ferry Road and Windward
Parkway. The fagade collapsed unex
pectedly in April 2017.
“This is the easement we need, the
permission if you will, to basically
rebuild that wall and- drill some sub
surface nails to show up that side of
the wall,” said County Attorney Ken
Jarrard. “This has been vetted by the
attorneys of everyone involved. This
also authorizes the payment of
$17;500 to [property owner
McDonald Windward Partners 111,
LLC], which is the entity that we
have been negotiating-with.” ‘
Jarrard said the county had been
negotiating the easement for “a long
time” and the county needed the
agreement to move ahead with work.

enter their property for certain abili
ties to secure the wall with pins and
metals and stuff and get in there to
do certain work,” said Commission
Chairman Todd Levent.
In September, commissioners opted
to approve a bid for $831,957 to
Hayward Baker Inc., for its replace
ment at the entrance. :
Previously, officials said the wall
was built in 2002 with a 75-year
lifespan. Only a portion of the wall
fell and Deputy County Manager Tim
Merritt said in September it was his
understanding the rest would not
need to come down.
After the wall fell, county engi
neering officials likened the portion
of the wall to a brick facade on a
house, meaning the portion that fell
was more for aesthetics than struc
tural purposes.
Drainage issues have been given as
a possible reason for the failure.
Though the wall is part of a com
mercial shopping center, Forsyth
County is involved since about two
thirds of it is on county right of way,
after the property owner donated the
land during a traffic signal improvement
project done by the city of Alpharetta.
The property owner and Forsyth
County have both inspected the wall
since it was completed in 2002.

Barger said that animal control — a
function of the Forsyth County
Sheriff’s Office — “deals mostly with
domesticated animals, so the only time
we’ll actually assist with wildlife is if
the animal is injured or endangering
the public.”
He said that in the last four years,
he’s assisted with four red-tailed
hawks.
The problem, he said, is that there
aren’t a lot of local “wildlife rehabili
tators” who can house the animals that
local animal control rescues.
This particular red-tailed hawk was
discovered acting strangely in some
one’s backyard in southern Forsyth
County.
“Basically, the homeowner saw iton
a stump of a cut-down tree ... they
noticed it was hopping and not flying.
And, it appeared to be very under
weight. When I arrived, it basically
had its head tucked down in its wings,
so you knew something wasn’t right. I
called my supervisor, told him what 1
had and told him I'd like to take it to
Chattahoochee. [Chattahoochee
Nature Center] said they’d take it.”
Kathryn Dudeck, wildlife director
for Chattahoochee Nature Center (and
the person with whom Barger spoke
on the phone with Tuesday morning),
said when the hawk arrived it was very
emaciated. ;
“He was pretty much all feather and
bones,” Dudeck said, adding that only
about 15 percent of raptors survive to
see their first birthdays.
A raptor is a bird of prey.
“This [raptor] ... the left side of his
body was weakened, so he was either
hit by a car or caught in the draft of a
passing car,” Dudeck said. “Once

they’re grounded by an incident like
this, they will start pecking at dirt
[seeking nourishment] and may pick
up parasites.”
She said when Barger brought the
hawk in, things weren’t looking good
for the animal. The hawk died Sunday
morning. :
Barger said, in the case of wildlife,
deciding whether or not to intervene is
key.
“When we deal with wildlife ... if
the animal gets up and goes, then we
let nature take its course. If we find an
animal that’s injured, I have to deter
mine, ‘can I safely handle it without
doing more harm?’”
Added Barger: “Maybe this hawk
died peacefully instead of being out in
the wild where it could have been
eaten or in more danger. Helping an
injured animal ... or at least trying to
help. I love that. I love what I do.”
