WE, the people of the United States, in
order to form a more perfed union,
eftablilh justice, insure domestic tran
quility, provide for the common defence, promote
she general welfare, and secure the blefTihgs of
liberty to ourselves and our poderity, do ordain
and edablilh this Constitution for the United States
of America.
Art. 1. Sett. I. All legidative powers herein
granted, (hall be veiled in a Congress of the Unit
ed States, which (hall consist of a Senate, and house
of Representatives.
11. The house of representatives (hall be
posed of members chosen every second year,
by the people of the several dates, and the electors
in each date (hall have the qualifications requisite
for eleftors of the mod numerous branch of
the date legiilature.
No pet son (hall be a representative who (hall not
bare attained to the age of *5 years, and been 7
years a citizen of the United States, and who (hall
cot, when elefted, be an inhabitant of that date
in which he (hall be chosen.
Representatives, and direst taxes (hall be appor
tioned among the several dates which may be in
cluded within this union, according to their re
fpeftive numbers, which (hall be determined by
adding to the whole number of free persons, in
cluding those bound tofervicc fora term of years,
and excluding Indians not taxed; three fifths of
aU other persons. The aftual enumeration (hall
be made within three years after the fird meeting of
Che Congress of the United States, and within eve
ry subsequent term of ten years in such manner as
they (hall by law direct. The number of repre
sentatives (hall not exceed 'one for every
30,000, but each date (hall have at lead one re
presentative, and until such enumeration (hall be
made, the date of New Hampfliire (hall be en
titled to chufe 3, Maflachufctts 8, Rhode-Ifland
end Providence Plantations f, Connecticut 5, N ew-
Yorh 6, New-Jersey 4, Pennfyivania 8, Dela
ware 1, Maryland 6, Virginia 10, North-Caroli
na 5, South-Carolina 5, and Georgia 3.
When vacancies happen in the representation
from any date, the executive authority thereof
shall iflue writs of eleftioa to ill such vacan
cies. ;
The house of representatives shall chufe their
speaker and other officers, and shall have the foie
power of impeachment.
fSeft. 111. The senate of the United States (hall
be composed of two senators from each date, cho
ftn by the legiilature thereof, for fix years y and
each senator (halt have one vote.
Immediately after they (hall be aflembled, in
eonfiequence of the fird eleflton, they (hall be di
vided as equally as may be into three ciafles. The
feats of the senators of the fird class (hall be va
cated at the expiration of the second year, of the
second clafe at the expiration of the fourth year,
and of the third class at the expiration of the sixth
yehr; so that one third may be chosen every se
cond year, and if vacancies happen by resignation,
or otherwise, during the reccfs of the legiilature
•f any date, the executive thereof may make tem
porary appointments until the next meeting of the
legiilature, which fliall then fill such vacancies.

attained to the age of thirty years, and been nine
years a citizen of the United States, and who (hall
not, when elected, be an inhabitant of that state
for which he (hall be chosen.
The viee-prefident of the United States (haH be
prelident of the senate, but (hall have no vote un
less they be equally divided.
The senate (hall chose their other officer*, and
also a prelident pro tempore, in the absence of the
vice-prelideni, or when he (hall exercise the office
of prelident of the United States.
The senate (hall have the foie power to try *ll
impeachments. When fitting for that purpose,
they (hall be on oath or affirmation. When the
president of the United States is tried, the chief
jultice (hail preside, and no person (half be con
victed without the concurrence of two thirds of
the members present.
Judgment in cases of impeachment (hall not ex
tend farther than to removal from office, and dif
quahfication to hold and enjoy any office of honor,
trust, or profit under the United States ; but the 1
party convicted (hall nevertheless be liable and
fubjeft to indictment, trial, judgment, and puniffi
ment, according to law.
SeCt. IV. The times, places and manner of hold
ing elections for senators and representatives, (hall
be prescribed in each (late by the legiilature there
of; but the Congrefsmay at any time by law make
or alter such regulations, except as to the places
of chufing senators.
The Congress (hall assemble at lead one* in every
year, and such meeting (hall be on the firft Mon
day in December, ualefs they (hall by law appoint
a different day.
„ SeCt. V. Each house (hall be the judge of the
elections, returns and qualifications of its own
members, and a majority of each (hall constitute a
quorum to do bufinefe; but a frnaller number may
adjourn from day to day, and may be authorised
to compel the attendance of absent members, in
such manner and under such penalties as each house
may provide.
Each house may determine the rules of its pro
ceedings, punilh its members for disorderly beha
viour, and, with the concurrence of two-thirds,
expel a member.
Each house (hall keep a journal of its proceed
ings, and from time to time publiffi the fame, ex
cepting such parts as may in their judgment require
secrecy; and the yeas and nays ot the member*
of either house on any question fliall, at the desire
of one fifth of thofc present, be entered on the
journal.
Neither house, during the session of Congress,
(hall without the consent of the other, adjourn for
more than three days, nor to any other place than
that in which the two houfe* (hall be fitting.
SeCf. VI. The senators and representatives (hall
receive a compensation for their services, to be
ascertained by law, and paid out of the treasury of
the United States. They (hall in all cases, except
treason, felony and breach of the peace, be pri
vileged from arrest during their attendance at the
session of their refpefiive houses, and in going to
and returning from the fame» and for any speech
or debate in either house, they (hall not be ques
tioned in any other place.
Nofenatoror representative (hall, during the
time for which he was elefted, be appointed to any
cil office under the authority of the United States,
which (hall have been created, or the emoluments
whereof lhall have been encreafed during such
time; and no person bolding any office under the
United States, (hall be a member of cither house
during bis continuance in office.

ginate in the house of representatives, but tli«
senate may propose or concur with amendmeuts as
on other bills.
Every bill which fhal} have palled the house of
reprcfentatives and the senate, lhall, before it be*
come a law, be presented to the president of tho
United States; if he approve be lhall sign it, but
if not he lhall return it, with his objections to that
house in which it lhall have originated, who (half
enter the objections at large on their journal, and
proceed to re-confidtr it. If after fucb reconfide*
ration, two-thirds of that house lhall agree to pa ft
the bill, it lhall be sent, together with the objec
tions, to the other house, by which it lhall like*
wife be re-confidercd, and if approved by two*
thirds of that house, it lhall become a law. But i»
all fucb cases, the voteeof both hoafea lhall be de
termined by yeas and nays, and the names of the
persons voting for and againfithe bill, lhall be en
tered on the journal of each house refpetfively. If
any bill Ihalf not be retnrned by the president with
in ten days (Sundays excepted) after it lhall have
been presented to bim, the fame lhall be a law, in
like manner as if he had signed it, unless the f 'on
grefs by their adjournment prevent its return, i»
which case it Dull not be a law.
Every order, refolUtion, or vote to which the
concurrence of the senate and house of represen
tatives may be necedary (except on a queftiou of
adjournment) lhall be presented to the preii lens
of the United States; and before the fame lhall
take effect, lhall be approved by him,, or being
disapproved by him, lhall be re-paiied by two
thirds of the senate and house of reprcfentatives
according to the rules and limitations prescribed
in the case of a bill.
Sect. VIII. The Cotigrefs lhatr have power to lay
and collect taxes, duties, impolts and excises to
pay the debts, and provide for the common de
fence aifil general welfare of the Unued States;
but all duties, impolts and excises lhall be uniform
throughout the United S:ates.
To borrow money on the credit of the United
States.
To regulate commerce with foreign nations, and
among the Several Bates, and with the Indian
tribes
To eltablilh an uniform rule of naturalization,
and uniform laws on the fubjeCt of bankruptcies
throughout the United States.
To coin money, regulate the value thereof, and
of foreign coin, and fix the standard of weights
and measures.
To provide for the ptmilhment of counterfeiting
the fecuriries and current coin of the United States.
To efiabliih post offices, and poll roads.
To promote the progress of science and ufeful
arts, by securing for limited tiroes to authors and
inventors the exclusive right to their refpcAive
writings andDifroveries.
To conllitute tribunals inferior to the fupremC
court.
To define and punilh piracies and felonies com
mitted on the high seas, and offences against the
law of nations.
To declare war, grant letters of marque and
reprisal, and make rules concerning captures oa
land and water.
To raise and support armies, but no appropri
ation of money to that ufc lhall be for a longer
term than two years..
To provide and maintain a navy.
To make rulesf or the government and regulation
of the land and naval forces.
To provide for calling forth the militia to exe
