Art . 4 th. Any non-commissioned
officer or private militia tnan, who
shall desert, or without leave from
his commanding officer absent him
felf from the company, guard or de
tachment to which he belongs, shall,
upon convi&ion thereof, be punished
according to the nature of his offence,
at the dilcretion of a court-martial.
Art . stb. Whatsoever officer or
private shall be convi&ed of having
advised or persuaded any other officer
or private to desert, shall luffer such
punishment as shall be ordered by
the sentence of a court-martial.
Art.bth . Any officer commanding
in quarters or on a march, shall keep
good order, and to the utmost of his
power redress all such abuses or dis
orders, which may be committed by
any officer or private under his com
mand ; if upon complaint made to
him of officers, non-commissioned
officers orj privates, beating, or other
wise ill treating any person, or of
committing any kind of riot to the
disquieting Os any of the inhabitants
of the State, he the faidcommander,
who shall refufe to have justice done
on the offender or offenders, and re
paration made to the party or parties
injured, shall, on due proof thereof,
be punished as ordered by a general
court-martial, in such manner as if
he himfelf had committed the crimes

' Art* 7 th . Any officer, non-com
missioned officer or private, 1 who
shall think himfelf aggrieved by his
Captain, or other officer command
ing' the company to which be be
longs, may complain thereof to the
commanding officer of his regiment,
who is hereby required to funimon a
regimental court-martial* for doing
justice to the complainant, from
which regimental'court-martial, ei
ther party may, if he thinks himfelf
still aggrieved, appeal to a general
court-martial* but if upon a second
hearing the appeal (hall appear to be
vexatious and groundless, the person

post committed to his charge, or Shall
force or induce others lo to do in the
time of action, or in the face cf an
enemy, Shall be puniShed at the dis
cretion of a general or regimental
court-martial.
Art- \sth. Whatsoever officer or
private Shall be convidted of holding
correlpondence with, or of giving
intelligence to the enemy, either di
re&ly or indirpdtly, Shall fuffer
or such other punishment as by the
sentence of a general court-martial

Art. 1 6th. No general court-mar
tial Shall consist of a less number than
nine, or of a greater than thirteen,
none of whom Shall be under the
rank of a commissioned officer, and
the president Shall be a field officer;
and the president of every court
martial, y nether general or regimen
tal, Shall have power to administer
an oath to every witness, in order to
the trial of offenders; and the mem
bers of al) courts martial Shall be
duly sworn by the president, and the
next in rank of the court-martial,
Shall administer an oath to the pre
sident.
, Art. ijtb. No field officer Shall
be tried by any officer under the de
gree of a Captain, except in cases
where a Sufficient number of Captains
cannot be had.
Art. 1 sth. The commissioned of
ficers of eyery regiment, may, by
the appointment of their Colonel or
commanding officer, hold regimental
fourts-martial for trial of all such
matters as Shall come before them,
but do sentence of such courts Shall
be carried into execution, until the
Colonel or commanding officer of
the regiment Shall have confirmed
the fame.
