An aQ for regulating the trade between thejub je&s of his Majesty's colonies and plantations in North-America-, and in the IP est-India JJlands , and the countries belonging to the XJnited Stales of America ; and between his Mate fix's /aid fubjeds and the foreign funds in the Weft-Indies . WHEREAS the regulations # made by his Majesty’s seve ral orders in council, for car rying on the commerce be tween his Majesty’s fubjetls in North-America, and in the Weft-Indies, and the inhabitants of the territories belong ing to the United States of America, in pur suance of the powers veiled in his Majesty .for that purpose by several ad» of parliament, .have by experience been found to be benefici al : And whereas it is now proper that the laid regulations ihould be eftabliftied and .made permanent; Be it therefore enacted by -the king's meft excellent majesty , by and nvi ‘h the advice and consent of the lords spiritual and temporal , and commons, in this ptefent parlia ment ffftembledyand by the authority of the fame , That n !° good* or commodities whatever ftiall '.be! imported or brought from any of the ter ritories belonging to the United States of Ame rica, into any .of Jus Majesty’s \Veft -India islands (in which description the Bahama is lands, and the Bermuda or Somers iftands are included) under the penalty of the for feiture thereof, and also ofthe ftiip or veftel in which the fame iliatl be so imported or brought, with all her guns, furniture, ammu nition, tackle and apparel, except tobacco, .pitch, tar, turpentine, hemp, flax, malls, yards., bowsprits, ftaves, heading-boards, timber, ftiingles, and lumber of any fort; borfes, neat cattle, llieep, bogs, poultry, and J>ve flock of any fort; bread, bifeuit, flour, peas, beans, potatoes, wheat, rice, oats, barley, and grain of any fort; such commo dities refpedjvely, being the growth or pro dudion of any of the territories of the said United States of America. And be it further enatfed by the authority afore paid, That none of the goods or com modities herein before excepted# enumerated jand. d.efcribed, fball be imported or brought into any of the said iftands from the territoi j-ies of the said United States, under she like penalty of the forfeiture thereof, and also of the ftiip or veftel in which the fame dial! be jfo imported or brought, together with all her guns, furniture, ammunition, tackle and ap parel, except by Britilh fubjeds, and in Bri tish built Chips, owned by his Majesty’s sub- and navigated according to iavr. And be it further enacted by the authority rforejaid , That it ftiaiJ be lawful to export from any of the said Weft-Indja iftands to any .port or place withip the territories be longing so the said United States, any goods or commodities whatsoever, which are not now by law prohibited to be exported from the said islands to any foreign country or place in Europe; and also sugar, molasses, coffee, coqoa-nuts, ginger and pimento: And that all cocoa-nuts or ginger which (hall be so ex ported, fball be fubjed and liable to the fame duties to which the fame are now severally fubjed and liable if exported to any Britilh colony or plantation in America; and that the said duties ftiall be raised, levied, colleded, paid, _ recovered and applied, ia the fame T H E manner as the duty on cocoa nuts or ginger exputted to any Britilh colony or plantation in America aiefeverally raised, levied, col lected, paid, recovered and applied : Pro •vidtd s> That no sugar, molalles, cof fee, tocoa-nuts, ginger, or pimento, nor any other articles or commodities whattoever, (except fait from the islands calied Turk’s illands, being part of the Bahama islands) lhall be so exported, except by Btitith fubiefts, and in Britilh built Ihips, owned by his Ma jesty’s fubjefts, and navigated according to law, tinder the like penalty of the foifeiture thereof, and also of the lhip or veil'd in which the fame (hall be exporter!, together with her guns, furniture, ammunition, tackle and apparel. And he it further enabled by the authority afrefaidt That in every case where, on ex portation of anv goods or commodities to any Britilh colony or plantation in America, a bond is now, or may be hereafter required by law for the due landing of such goods and commodities in such colony or plantation, and a certificate is required to difeharge such bond, a similar bond Jhall be required, on exporta tion of such goods or commodities to the ter ritories of the United States, for the due landing the fame in the said territories; and such bond (hall and may be difeharged, upon a certificate under the hand and seal of the Britilh consul or vice-consul, provided any such consul or vice-consul thall be resi dent at the port or place where such goods {hall be landed; or in there lhall not be any such consul or vice-consul so refi dent, then under the hand and seal of any officer or of ficers who are or may be appointed by the said United States, or any of them, for the pur pose of granting such certificate; and if it lhall happen that thete finll not be any officer so appointed, then, and in such case, such bond lhall and may be*c]ifcljarged, upon a certificate under the hand and seal of any ma girtl&te of the said Uni ed States, or any of them, certifying that theie is no such officer at the port or place where such goods lhall be landed, and that oath hath been made before foch niagiftrate by the matter, or other per son having the charge or command of such ship or yelfel, that the goods for which such certificate is required werd duly landed by him at such port or place within the;territories belonging to the said United States. And whereas it is expedient to give due en couragement to the making of fait in the said illands called Turk’s islands V Be it therefore further enabled by ihe authority aforejaid , That it lhall and may be lawful for any ship or ves sel belonging to the inhabitants Os fie said United States of America coming in bailaft, and net otherwise, to enter the ports of the said illands, called Turk’s illands, for the purpose of being there laden with fait, and for no other purpose whatever; underand : fubjeft to the provisions, regulations and re ftriftions hereinafter mentioned ; any thing in this aft, or any law, bfage, pr custom, to the contrary notwithstanding. Providtd always, That the maficr, or other person having or taking the charge or com mand of such lhip or veflcl lhall, immediately after the arrival of such lhip or vettel n.to any port ofthe said ittands, make a just and true en try, upon oath, before the collector or othtr principal officer of such port, of his lhip or veflekdcclaring of what country ihe is built,ho w manned; who was the matter during the voy. [NO.XCII.] age, and who are the owners thereof, and the i purpose foi w hich (lie euters the laiu port, in order that such (hip or vettel may undergo the ft arch and examination ofthe proper officers of his Majefiy’a cuftoras j and such matter or other person taking the charge or command , thereof, lhall truly answer upon oath to such quefttons touching and concerning the fame, as lhall be demanded of him by such collec tor, or o’her principal officer, upon pain, for any default therein, that such matter, or 0- ther person having or taking the charge cr command of such fli p or vettel, lhall forfeit i the sum of one b net red founds ; and the leftor, or oilier principal officer of his Ma«» jest ’s customs at such port, is hereby autho rifed and required to adminittcr the said oaths p herein before required to be taken. And be it further enabled by 'he authority aforejaid , That there lhall be raised, levied, coliefted, and paid, unto and for the use of | his majesty, bis heirs and fucceflors, a ton- I nage duty at and after the rate of TwoShiU | lings and Six-pence fteiling payable in dollar# at the rate of Five Mailings and Sixpence pet ounce, so e ichanu every ton but then of every ftiip or vettel belonging to the inhabitants of the said United states of America, so corning to ihe said illands called Turk’s illands; and that the tonnage of every such lhip or vcliel lhall be afeertatned bv i cjmeafurement, made by such officer or officers as Jhall be appointed for that purpose by the commiffionera of hi# N»ajefty’s customs in England for the time being, or any four or more of them; which said officer or officers so appointed as afore* said, fliall. adincafure luch lhip or vettel ac cording to the following method, via. Drop a plumb hue over the Beta of the lhip, and meafnre the difiance between such line and the after-part of the ttern port at the load water maik; meafure from the top of the said p’umb-ljne, in a parallel direftiorj wi h ihe water, to a perpendicular point im nicdia ely oVer the load watermark at the fore part .of the main flem ; fubtrafting from fuclt measurement the above distance, the remain der will be the (hip’s extreme lengthy from wh.ch is to be deducted three iuchesfor every foot of the load draught of water for thd rake abaft, and also three-fifths of tb# (hip’* breadth for the rake forward, the remainder lhall be esteemed the just length of the keel, to find the tonnage; and the breadth dial! bo taken from out fide to outside of the plank, fn the btoadeft part of the (hip, either above or below the main wales, exclufiye of all manner of llieathing or doubling that may he wrought upon the tide of the tttip ; ft l * o mul tiply the length of the keel for tonnage flic, bteadth so taken, and that pioduft by half the breadth, and divided by ninety-four, the quotient lhall be deemed the true contents of the tonnage.
