WH E R E A S the se veral Road Ads heretofore made* by experience have been found inadequate to answer the lalutary purpoles for which they were intended: For whereof Be it enabled by the Represen tatives of the Freemen of the State of Georgia in General Ajjembly met, and by the authority of the fame , That froth and immediate . ly after the palling of this Ad, the Superior Courts of this Rate (hail in their refpedive counties have full power and authority to order roads, ferries or bridges, at any place or places where the fatie (hall in their judgment be found neceflary tor the use of the t public. Provided nevertheless , That houses, mill-dams or other reservoirs of water neietofore made, (hall pot in any case be affeded by virtue ot this Ad ; the Courts (hall defray the ex pence attending of bridges by levying an extra tax on the in habitants of the county for that purpose. When it (hall so hap pen that a bridge or bridges (hall be found neceflary to be ereded on the natural boundary of two or more counties, then and in that case the concurrence of the Courts whose boundary is thus to be bridged (hall be neceflary to order the ereding of Inch bridge or bridges; the expence thereof (hall be jointly borne by the coun ties ordering the fame, and paid nroportion to their general tax for the time biing. Be ft eneded, That the Court fl, a ll appoint Commissioners for each road by them ordered, who shall cauiS the fame to be kept in that repair which is required by this AS; And for refufing to receive ot neglefling to perform T:H E, the duty ot their apppintmcnts, the Court (hall at their dilCittion impose a fine on each or any oi them, in a him not exceeding sis y pounds for every (uch of fence. Be itfurther enacted by the au thority aforef id, That the Com mifliunersof any dillridt appoint ed by virtue mi this Act, or a majority cf them, (hall have full power and authoity to appoint overseers for the road, who (hall keep the fame in that repair which is required by virtue of this Adt: And, on refilling to receive or negledling to perform the duty of their appointments agreeably to this Adt, the Coin miflioners (hall at their dillre tion impose a fine on each or any of them so neglecting or refufirg to obey such orde s, alum not exceeding ten pounds for every (uch offence. Be it further enabled by the au thority aforef aid, That any per lon or pcrlons negledling or re fufing to work on the roads ag ( ee ably to this Adt, (hall, at the di(- cretion of toe (. Ommifiioners, he lubjedt to a (he of five (hillings per day for everv lh h offence: The owners of (laves or others, having any person or peTons in their lervice or employ* (hall be accountable for such person or persons negledling or reefing to work on the roads agreeably to this Adt, and fubjedt to a fie .. at the diferetion of the Com mi f fioners in a futn of five (hillings per day for every (uch offence. And be, it enabled by the autho rity aforefaid, That any perf n or persons who (hall obftrudt or caule a road to he obftrudted by fencing or otherwise, (hall at the diferetion of the Commiffiohers be fubjed: to a fine of ten pounds for every such offence, unless he has the permission of the Com missioners or a majority of them so to do. Be it further enabled by the au ' " ' Vv ” * *'•*' '7 ' * :. ; « [Vol. 111, No. CXXX..j thority aforfaid, That the over seers appointed by virtue of this Adt or any of them, (hall have full power and authority, verbal ly or otherw le, to cite all the male t.tnes frem sixteen to fifty ytars of age to convene, w > may by this Adi be liable to work on such division or part of the road, and cauie them to put the lame in that repair, which is re quired by viitue of this Adt, or woik thereon not exceeding twelve days in ohe year, or more than fix days at one time: The overseer or any of them (halt, on oath before a Justice of the Peace, report specially to the Commil fiontrs, within ten days after de fault, all persons who (hall ne gledl or refufe to work on the roads agreeably to this Adt. Be it further enabled by the authority aforefaid. That the pub lic roads of this (late (hall he opened thirty feet wide, from v\ hith all obftrudlions (hall be re moved, and kept iti luitable re pair for the uie of carriages. Be it further enabled by the au thority afirefaia , That the Com milfioners of roads, whole ap pointments have heretofore been made, and not revoked, (hall be continued, until otherwise order ed by the Court j and they (hall be, and they are hereby veiled with the powers granted to Com miflioners appointed by virtue of tj>is adt. Jfnd be it juriher enabled by the autfoorily aforefaid. That all f axes levied, and fines impoled, by vir tue of this adl, (hall be colledt ed by such person as mav he spe cially appointed by the Judges of the Court of the county in which they (hall he levied or impoled, and (hall be applied by the Court , in defraying the expences attend ing of bridges.
