Sec. 3. Sections 33811 to3288, both inclu sive, ul.Barl 3, .title 3. chapter 3, article 3, of th, Code of Georgia, providing sum mary and cumulative remedies against the nffici-re and stockholders of Banks, are hereby repeal'(1, as to all Banks and (be officers and stockholders thereof making the assignments heroin before provided for, Bsc. 4. K vor.v bolder of tba bills of any such Banks sha'l ‘bo entitled to his full of tile assets of such Banks, in the hands of tho assignee, according to the priorities eiUblHbpd by law ; but neither such homer of bills nor the assignee shall be allowed to proceed by suit against any stockholder, personally, for collecting what may remain unpaid, within ten years from the passage of this Act, unless per- milted so to do by some future act of the General Assembly. Bee. 5. All laws and parts of laws mili* tating against or conflicting with this Act are hereby repealed. Sec. G. This Aot shall lake effect from the day or us link! passago and approval by the Governor. A Curloua Cast—Rebecca H, Tuula va. C. W. Hull*.-Perjury or Forgery Involved. From the Norfolk Post. 2dth< Mr. BulU, the defendant, is a lawyer, who came to Norfolk during tho war, and rented a bouse from - Mrs. Tunis. In 1864. He continued io bold the premises throughout the following year, 18US, atan advanced rent. But, in July last, the dwelling was leased to Mr. Gilbert C. Walker, for the year 186G-^and Mr. Buttz was notified of the fact. Previous to this time, according to the evidanco of Mr. Buttz himself, ho aud the plaintiff had been an friondly terms, and he was in the habit of visiting her house, frequently, as ho says, “taking wine with her.’ 1 But, when they fall out About the house, Buttz discovered wlml be suddenly conceived to b« a vary grave omission on the part of Mrs. Tunis. That lady had actually for gotten or neglected to affix the necessary revenue stamps to the receipts she had given U> him fur house rent. This Vas a great oversight on tho part of the lady, and one which would auhject her to a prosecu.ion for violating the intarnal rev enue laws, and the payment of a heavy line on each receipt. Whether pronpted by motives of patriotism or revenge, it is difficult to say; but Mr. Buttz declared it to be an impulse of purest patriotism. lie took the receipts to Colonel B.qoe, collec lor of revenue, and iusisted thiil the lady should ho prosecuted. The Collector at once summoned Mrs. Tunis before him to an.-wer for the offence. Bhe pleaded igno ranee of utiy wrung intention, end lbe Collector condoned tho act by allowing her to affix the stamps then and there, is his presence. Subsequently Mr. Buttz caljvd, and op being informed of the manner in which tho matter had been compromised, de clared that it did not satisfy him; that he would lay tho case before the authorities at WashiugluD t have the law enforced, and demand bis half of tho Buss assessed, which ho would he entitled to ax jpforaier. As he bad to incur the odium, it was but proper that he should receive compensn- lion. This ended the mutter in regard to lbe revenue stamps and Mr. Butts’s revenge. Now comes the question of forgery. , On the trial a receipt was produced by Mr. Buttz signed by Mrs. Tunis, purport ing to have Veen given fur the month of January, to which is added tho clause, "For the house rentod for the years 1866 and 1806 to C. W. Bnttz.” This last clauso was held to have the binding force of a lease or contract, as it was signod by the owner of the property. The history of this receipt is rather interesting. The theory of the plaintiff's counsel was that Mr. Buttz bad interled this clauxe after the lady had signed the original paper ; and in support of this theory Mrs. Tunis made oath to the effect that when sho signed that receipt in her own houso, wuore it was made out by Buttz, the latter clausa was not contained io it. On the contrary, Buttz, when put upon the stand to testify ki his wwa behalf affirmed that tho redeipl was g'-nuine, and had not hern tampered with Thus the matter stood when the evidence closod. There was no now principle involved in tho suit, but there was considerable hard .wearing. It seems that no distinguished throe kinds of Bleep—the diurnal, the an nual and the metumorphio.
