Yesterday afternoon at 8j o'clock, be
fore Justices C. C. Ogle tree, T. J. Sbi-
and M. MoCahey, commenced the
examination of Sydney Kimbrough,
charged with the murder of Euisnuel
Ellis, both colored. The examination did
not close until 7) o’clock.
The prisoner is a blacksmith by trade,
and works iu Nance's shop, five miles
N. E. of Columbus. He works there with
a Henry Smith, colored, who is said to be
now iu Alabama. The dead man was
about the same age, not so stout as pris
er, and farmed a field of Mr. Ghas. Glen
on shares. He is represented aa honest
and industrious.
The witnesses were Shepherd Ransom,
Wylie Ransom and John Chapman, bro
thers of the deceased, and Justice Ogle-
tree, Dr. Nance and Messra. W. W. and
G. L. Glenn.
The evidence can be thus summarized:
Deceased had for some time been
missing some com, and on the
Thursday morning of August 24th
went out to reconnoitre. He found pris
oner in the field. He started to carry
prisoner to Mr. Glenn. Deceased had a
gun. When he turned prisoner caught
hold of him, took the gun from him and
broko it over his head. Evidences remain
of a tussle iu the field, and corn piled np,
and a pool of blood, aud also the print of
a pair of ahoes with iron heels. Prisoner
wears siioh shoes. The stock of the gun
has been found, but the barrel disappear
ed. The deceased walked to his home
and took to hia bed and did not leave it
until he was a corpse.
Juslioe Ogletree held a preliminary trial
next morning, and required him to give
a bond of $850 for assault with attempt
to murder. He escaped from Bailiff
Hodges and fled to his sister’s house, in
Harris county, whither he was pursued,
captured and brought to Columbus jail.
Ellis died Monday night, August 31st. Dr.
Nanoe testified from the wouuda received.
There were many partioulara to form a
connected chain of evidence, but wo have
no room for them.
EVIDENCE or THE DYING M IN.
The following was admitted as the dy
ing declaration of Emanuel Ellis, the de
ceased. Justice Ogletree testified that
Dr. Nauoe, on the preliminary examina
tion for the defense, took this down as the
substanco of evidence of deceased. He
was then not able to leave his bed, and
the examiuatiou of the prisoner held iu
his house. He was sworn. It was writ
ten in pencil, and copied iu writing.
Ou the following Saturday Emanuel El
lis waa told he was in a dying condition,
and was asked by Justieo Ogletree, Mr.
W. W. Glenn and Okas. Glenn if he bad
any statement to make. Ho HAid, “As a
dying man, Sid Kimbrough is the uiau
who struck mo oil the head."
Mr. Chas. Glenn read the statement over
nrofnlly and slowly to him, and he said
it was true.
The following is the atutement:
Tho attempt was made August 27th,
1874, nt 4 o'clock in the morning, iu the
corn field which he (Ellin) cultivated, be
longing to Mr. Charley L. Glenn. Some
person had been iu said field taking some
corn. This caused him (Ellis) to recon
noitre. Ou arriving there, lie (Ellis)
found Sidney Kimbrough there pulling
off his (Ellin) corn, and approaching with
in a distance of 12 feet of Kimbrough, he
(Ellis) asked him what he waa doing.
Said Sidney Kimbrough Advauoiug upon
him (Eilis), he (Edia) ordered him not to
come any nearer. He (E.lis) then told
prisoner he wanted him to go right before
Mr. Glonn. Prisoner then asked
deponent which way to go. Prisoner then
turned and seized deponent, and threw
him on the ground. He then stamped
deponent. Deponent then rose and seized
hold of prisoner, the prisoner atill holding
deponent's gun in right hand drawn over
him. Prisoner then struck deponent with
the said gun, near tho breech portion of
it, upon the forehead, knooking him to
the ground iu a partly insensible condi
tion. Prisoner then left deponeut. De
ponent states that said attempt to murder
him took pluce in Muscogee county, Stato
of Georgia. Deponent further states he
has no further witnesses; that no person
else was present at the time.
Senator Crawford, for the defense,
olaimed that this was not a dying.confes
sion, and the deceased was not in condi
tion at that time to understand it, for the
evidence showed that the prisoner soon
after became apoeohlesa aud died Monday
night. (This was Saturday night.)
Messrs. Thornton A Grimes contended
it should bo admitted and the statement
was read.
The case waa then submitted without
argument.
THE DECISION.
After a few ’moments the Justices an
nounced as their conclusion, that the
prisoner be committed to jail for murder.
The prisoner's wife and son were in the

tion.
