ALABAMA. Sumter County Prisoners. STRONG EVIDENCE IN TIIEIU FAVOR. Mohii.e, October 7.—The testimony in the preliminary examination of Stephen Renfro, Chas. Bullock and Phillip A. Hill man. charged with the murder of W. P. Billings, in August last, was concluded this evening, nud the case is now being argued. It will be concluded to-morrow. The evidence for the prosecution is most ly negroes. Two swear positively that Reufro and Bullock were present at, aud did the killing, along with twenty or twenty-five others. The witnesses swore they were present and saw the killing. Hillman was not identified ns one of the parties, and will probably be discharged. The evidence for the defence, estab lishing an alibi in the cases of Renfro and Bullock, is very strong. Several par- tios, white and black, swore positively that, they (tho prisoners) were at their respective homes about the hour of the killing. Their homes are some distance from tho scene of tho killing—the near est is nine miles away. Much sympathy is expressed for the prisoners, who are quiet, respectable looking geiitlemeu. A NEW YORK TRIBUNE CORRESPONDENT VS. RADICAL LIARS. New York, October 8.—The Tribune has sent a correspondent to Alabamn to THE ELECTION. investigate the reports about outrages ou Republicans in that State. His first let ter, dated Montgomery, October fid, published this morning, and contains the following: I kuow nothing, personally, of the condition of the disturbed coun ties. I shall go to them in n day or two, but ns far as I have been able to investi gate, I have found that the administra tion journals and administration politi cians have grossly slandered the people of this State. The party press on both sides arc very bitter in political controversy, but tho Republican papers are just as de nunciatory of their opponents as those published in tho interest of the Demo cratic party, and it is not true that the latter have advised or do advise their friends to resort to intimidation lenco. Tho authors of some of these slanders that are destroying the credit of State and driving away immigrants, live in this city, and I don’t wonder that they are treated wiili contempt. They say they are ostracised, but they pass through the streets without molestation or insult. I have word of high Republican officials here who are well received, socially and in business relations that honorable men. no mutter wlmt their politics, are treated alike, and all arc, except a few worthless follows whose society nobody desires. MORE OF THE EVIDENCE—DECISION CAN T BE CONJECTURED. Mobile, October 8.—Tho testimony in the Sumter county case closed yesterday. Robert H. Smith, one of the counsel for the defense, is now making his arguufent Tho decision of tho commissioners will probably bo rendered to-morrow. The evidence is very conflicting—that for tho prosecution, except Henry J. Grattan, Billings’ law partner, is colored. Tlg» evidence for tho defence is part white and part colored. Of the wit nesses, Clark, for the prosecution, identi fied Renfro ami Bullock, and swore posi tively that they were present at and assisted in tho killing, along with twenty or twenty-five others. Witnesses swore that they wore on tho road at the time aud saw the killing. Hillman was not identified, aud will probably he dis charged. Tho evideuce for Renfro and Bullock establishing alabix is strong. Several parties swore positively that they were at their respective homes, the nearest nine miles away from the scene of the killing at the time of the murder. There is a discrepancy about tho namo of Hillman. He is called in tho affidavit aud warrant of arrest William Hillman. Ilis true name is Phillip A. Hillman. Tho two main witnesses for the prose cution swear that Billings, who was about thirty-five years old, was killed between sunset and dusk Saturday, August 1st, as lie was riding along the public road about one hundred yards from his residence in Suuiter county. Both tho man aud horse were killed aud found dead Sunday morning. They swore that Renfro came out of the woods and said with nu oath, “Halt, God damn you! ’’ when others rose and fired. Nothing was proved by the prosecution as to the previous threats of either of the prisoners against Billings. The prisoners are quiet, respectable looking young men, and farmers iu Sumter county. Coujecture us to tho probable decision of the Commissioners is idle. BULLOCK AND RENFRO JAILED WITHOUT 11ATL—HILLMAN DISCHARGED. Mobile, October 8.—After the argu ment in the case to-day, and about 2:fi() p. m., the Commissioner rendered his de cision. commit ting Renfro and Bullock to jail without bail, aud discharging Hillman. The Commissioner refused to enter into the constitutionality of the law, and bases his decision upon the fact that while tho evidence establishing alibi* iu the cases of Bullock and Renfro was strong, there was testimony enough to justify tho commit tal. After tho decision, aud before it was carried to effect, the United States Dis trict Attorney asked the Commissioner to hold Hillman until a new affidavit, charg ing him with tho whipping of Wilson Do^le, could bo prepared and n warrant issued for his arrest, sioner refused to do. Subsequently, and whilo at perfect lib. erty, Hillman told the United States Dis trict Attorney that I10 would appear at 5 p. m. nud give bail to answer this new charge. TALBOT COUNTY. Senate—W. 1. Holly Springs, Oct. 8.—Monday night five negro prisoners broke jail here aud escaped. One of them, named James Perkins, uuder sontence of hangiug for murder, struck the guard, Mack Hill, on the hoad with a bar of iron, causing his death at 5 o’clock that afternoon, sheriff's posse recaptured them all. Ilill is a brother of James Hill, Secretary of State. Holly Springs, Oct. 8.—Last night a mob of negroes, numbering about forty, took James Perkins aud William Ravenu- wood (colored) from the jail and shot them dead, thereby avenging the death of Mack Hill. It was done so quietly that few persons knew of it until this morn ing. [What will the Government do with the negro Ku-Klux ?] LOUISIANA. PROBABLE REVIEW BY THE PRESIDENT. Washington, Oet. 7.—Tho following special to the Jit raid undoubtedly reflects tho views of tho President. It is dated Washington, October (fill, aud comes almost directly from him : The opinion of Keverdy Johnson and Charles O’Conor, with tho rejoinder of Mr. Johnsou, ou tho Louisiana question, have called attention to an iiuportaut principle in tho political government of the country, viz., the right of tho Presi dent to reviow his own acts. Tho Presi dent recognizes tho necessity of having this subject settled without delay. Tho views of both Johnson and O’Conor, pub lished in tho lit raid, have been carefully read by the President. He does not agroo with Johnson, that either Kellogg or Mc- Enery was elected ; but lie unequivocally declares that the election in 1872 was a mockery, and that his only motive in re- coguizing Kollogg was to save society in Louisiana from anarchy. He does not consider either Kellogg or McEnery tho lawfully elected Governor of Louisiana. On Friday last, in a conversation with a Southern gentleman, he intimated that this would he his position in his next mes sage to Congress, and that I10 should n y k that provision be made for a freo and fair election, at. tho earliest possible day, aud should give emphasis to what ho lmd already declared, that it was time for the Republican party to unload Louisiana.
