Butte rela ted tbe following touching story in the course of his speech : During the winter of 1863-’64 it was my fortuue to be president of one of the courts-martial of the Army of Northern Virginia. One bleak December morning, while the snow covered the ground aud the winds howled around onr camp, I left my bivonao fire to attend the session of the oovrt. Winding for miles along un dertake paths, I at length arrived at the OdvtMround at Bound Oak church. Day after fay it had boon our duty to try the w |soldiers of that army charged with s of military law ; but never had provions occasion been greeted anxious spectators as on that awaited tho opening of the ,se after case was disposed of, tglh the case of “The Confeder ate Stales vs. Edward Cooper” was called; charge, desertion. A low murmur rose spontaneously from the battle-scarred spectators, as a young artilleryman roie from the prisoners’ bench, and, in re sponse to the question, “Guilty, or not guilty?” answered, “Not guilty.” The Judge Advocate w an proceeding to open the prosecution, when tho Court, ob serving the prisoner was unattended by counsel, interposed and inquired of the accuse l: “Who is your counsel?” He yeplied: “I have no counsel." Suppos ing that ii was bis purpose to represent himself before tho comt, the Judge Ad vocate was instructed to proceed. Every charge and specification aga-nst the pris oner was sustained, ’i he prisoner was then told io introduce his witne'ses. He replied: “I have no witnesses.” Astor- tonished at the eulmnoss with which lie seemed to bo submitting to what he re- | S aided as inevitable fate, I said to him : Have you no defence ? Is it possible tin t you abandoned your comrades and de serted your colors iu tho presence of tho enemy W.Flout any reason ?” He replied : “Thera was a reason, but it will not avail me before a military court.” I said: “Perhapi you are mistaken; you are ehaMf with the highest crime known to minifti law, and it is jour duty to mako known the causes that influenced your ftottom.” For the first time his man y foft* trembled, aud hi» blue eyes swam la fears. Approaching the president cf fh§ court he presented a letter, saying, as did so: “There General, is what did I opened tho letter, and io a mo ot my eyes filled with fears. It was wed from one to another of the court il all had'soen it, and those stern war- rs who had passed with Stonewall •kson through a hundred battles wept [e cUildron. Soon as I sufficiently re ared my solf-possession, I read tho ;er as the defence of the prisoner. It in these words: y Dear.Edwaiid: I have always been »ud of you, and sinco your connection ih the Confederate army I have been iuder of you than ever before. I would have you do anything wrong for the •Id; but before God, Edward, unless come h lino wo must die! Last night aroused by little Eddie’s crying I and saii : “What’s the matter, Ed- and he said: “Oh, mamma, I’m so And Lucy, Edward, your dar- Lucy, she never complains, but she owing thinner and thinner every day. before God, Edward, unless you come >e we must die. Youa Mart. rniug to the prisoner, I asked: at did yon do when you received this ir ?” He replied : “I made applica- for a furlough, and it was rejected; in I made application, and it was re ad ; a third time I made application, it was rejected, and UiAt night as I “ered backward and forward in the i, thinking of my home, and the mild of Lucy looking up to me, and tho ing words of Mary sinking in my in, 1 was no longer tho Confederate Her, but I was the father of Lucy and husband of Mary, and I would have L Bd those linos if every gun in the bat- bad fired upon me. I went to my *• Mary ran out to meet me, her au ras embraced mo; and she whisper- )! Edward, I am so happy! I am id you got your furlough V She must felt me shudder, for she turned pale ath, and catching her breath at cveiy !, she said: ‘Have you come without furlough? O ! Edward, Edward, go j go back! Let mo and my children -lown together to the grave, but O, for IVen’s Rake, save the honor of our ■® 1 Aiul here I am, gentlemen, not tMMpght here by military power, but in obedience to the command of Mary, to •bide the sentence of your court.” Btery officer of that coart-martial felt the force of tho prisoner's words. Before them stood, in beatific vision, the elo quent pleader for a husband’s aud a fa- tWj wrongs ; but they had been traiued by their great leader, Kobert E. Lee, to in§d tho path of duty, though the light- flash scorched the ground boueath feet, uud each iu his turn pro- ed tho verdict, “guilty.” Foriu. for humanity, fortunately for the leraoy, the proceedings of the court viewed by tho commanding g G n- id upon the record was written : ‘Headquarters, A. N. V. finding of tho court is approved, mner is pardoned and will report >mpauy. It. E.
