Tweed this morning eppeered in tbo
oourt-houao, in oharge of a deputy sheriff.
All the oily newspapers have been repre
sented on Blackwell's Island for n week
past, and the representatives had many
promises made them that Tweed would
leave tho penitentiary with their full
knowledge. Notwithstanding this, he
was smuggled off the island at 10 o'oiook
last night and brought to the eity, where,
according to a deputy sheriff, be drove
round in a carriage. It wee generally ex
pected he would be brought to coart to
day, and consequently a large number of
people gathered in the Immediate
vicinity of the court-hove, for
pose of getting eight of him. This
morning he went to his offloe in Duane
street, and spent some time in consulta
tion with his counsel, after which he pro-
eoedud to tho District Attorney's office,
acoompsuied by hiB son, W. M. Tweed,
jr., aud his private secretary, Foster
Dewey. In the Supreme Court
ohamber, one of hie oounsel, Mr. Mil
liard Boston, presented to Judge Davia,
the following order, which was signed by
him “at a special term of the Bnpreme
Court of the Btato of New York, held at
the court-house in tho city of New York
on tho 22d day of Jnne, 1878, present
Hon. Nonh Davie, Justine of Ihe
Btato of Now York, on relation of W. M.
Tweed, plaintiff in error, against Joseph
L. Liacomh, wsrdon of tho penitentiary
of tho city of New York, defendant in
error, tho petitioner Tweed, having proa-
edited liia writ of orror to tho conrt of
appeal, from tho order or judgment of
thia conrt, bearing date the — day of
March, 1878, which order or judgment
was duly entered by the olerk of the
court, end tho conrt of appeal having
reversed said order or judgment of the
court, and having directed the
discharge of the relator; now,
on the readiug and filing of the
remittitur from theaaid Court of Appeals,
and on motion of Mr. William Bnrdett,
Attorney for the relator, it is ordered
that tho order and judgment of the
Court of Appoala heroin be, and tha
canto is ltorehy made the order and
judgment of thia Court; and it is further
ordered that tho said relator Tweed be,
and bo is hereby discharged from the
oustody of the warden of the Peniten
tiary of tho City of New York.”
Mr. Walsh, Clerk of the Court of Oryer
end Terminer bofore Judge Brady,
Foster was the first one of
Tweed’s party to enter. He had
hardly taken his seat when Tweed enter
ed in charge of a deputy sheriff. He
walked rapidly across the roam and took
hiB seat beside his counsel. In a very
short time Ihe room was packed with peo
ple,and immense numbers were demoting
for admittance. After order had been
restored, District Attorney Phelps arose,
and addressing the Conrt, moved that
defendant, W. W. Tweed, be arraigned
to plead to an indietment found againat
him in Novemhor, 1873.
Mr. David Dudley Field arose, end on
behalf of Mr. Tweed stated that they
wore not roady to plead or make a mo
tion to quash; that they had only re
oeived notioo of this indietment a few
days since, and therefore time ought to
be allowed them to examine matters.
Mr. l'eckbam, in behalf of tha people,
stated that it was evident the defendant
intended to pnreue his old tactics and
stave off all proceedings as long ai possi
ble.
Mr. Field disclaimed any anob inten
tion, and stated that in law time ought to
be allowed biiu to examine the indict
ment ; aud further, that if they ware
forced to enter the plea, they would de
mand the right to withdraw at any time;
that it was a shame end cruel wrong to
find an iudiotmeut in 1873, and then, two
years afterwards, call it up without warn
ing to plead to it. Counsel further staled
that if they were foroed to plead by de
cision of tho Court, he would ask that the
rignt bo given to move to quash tha in
dictment after the plea was entered.
A legal war of words followod, which
lasted for nearly an honr—Messrs. Phelps
and Peckham, on behalf of the people,
olsiiuiug that aneb a thing was unheard
of in law, except in apeoial oases nnlike
the presout one, nnd there was no lesson
why thia case should be made a apeoial
one or special favor bo shown the defend
ant.
At this point, Mr. Field arose and de
manded to know what speoial favors have
been shown or would be. My olient,
said ho, has for seven mooths been ille
gally oonfiood in the Penitentiary, and,
when after committing tbio outrage—en
outrage which every one concerned in it
shall bo held strictly accountable—and
after he is released by a higher power
than themselves,it is wrong.it is unjust,to
ask us to plead to au indiotment of which
we know nothing. Counsel further said
it would not bo considered speoial favor
to issue warrants in Ibo oivil suits of six
millions of dollars, and lo fix bail at tho
enormous figure of throe millions of dol
lars.
