Our report of this oase in yesterday’s
paper mado an omission. Tho Bnpreme
Court affirmed the judgment of Judgo
Crawford, granting tho road a new trial.
Hilliard & Bussell, B. A. Bussoll for
plaintiff in error ; Joseph Fou, Foabody
ft Brannon for defendant in error.
Another tragedy has ended with taking
the life of a mouster who was a disgraoo
to humanity. He was a brute that ought
to hnvo beon shot down like a mad dog,
and the people are perfectly justifiable in
taking the law in their own hands after
the worse than murderer had been fully
identified by his victim.
Mrs. Ellington is a poor but respectable
lady, living noar Crawford, Ala. On the
first of October she was in her borne at
tending to her ordinary duties with a
young child in her arms. Her husband
was working in a field a good way's off.
This brute of a negro, Owen Wright, came
to the house and asked for her husband,
and was told he was away. The fiend
then seized the child, threw it on the
floor, and kicked it. He treated the mo
ther likewise. Her soreamB were una
vailing to attract assistance. He then
forced her at the point of a
pistol to the woods, fired off bis pistoh
and foroed the helpless and terrified
woman to strip her clothing, gratified
his hellish lust after overpowering and
kicking her, and again brandishing his
pistol swore he would kill hor if she told,
and left. The diatraoted creature at onoe
sought her husband and revealed all. The
neighborhood was aroused, but the negro
esoaped. Mr. Dudley, before the alarm
raised, saw him pass his house, and
noticed him closely booause of bis animal-
looking face.
The deed was widely advertised and re
wards offered by Mr. Dudley. Owen
Wright was arrested in Atlanta. Mr.
Dudley being tolegrnphed for went to Ate
lanta nnd immediately recognized the
scoundrel. Owon went to Atlanta for some
devilment. Iu irons he was brought to
Beale and lodged in jail a few days sinoe.
Mrs. Ellington wont to Beale on Friday,
and at once rooognizod and identified
him as tho negro who had committed the
outrage. Bbe was positive at the first
glanoo, and declared it after closer ex
amination. Womon oan't forget a face
liko his, whioh is tho moanest we have
ever seen in any countenance. He de
nied his acts, and that he knew either
Mr. Dudley or Mrs. Ellington, and was
coarse, brutal, joering and insolent.
The rage of the poople was intense.
They felt the necessity of setting an ex
ample of terror and oxeoute summary
justice upon such an incarnate fiend for
the protection of helpless women and
children whose protectors might be called
away.
Lust afternoon one hundred citizens from
the country, well armed, viRltod Beale.
Thoy were not disguised. They made the
jailer deliver to them tho keys. They
took tho tall, brawny negro from his ooll,
carried him to a blacksmith shop and re
moved the iron anklets, and having him
soonroly tied, disappeared in the woods.
They would listen to no expostulations.
Thoy were firm, oool Bnd determined.
Beyond this our special telegram says
nothing. From the declarations of the
party it is supposed he was burned ; any
way, ho was lost. The report also oomes
that he oonfossed tbo crime.
Wo are opposed to mob law, but in a
aaao of this kind, where identification was
absolutely oertain, the summary execution
was just. Tho deed tho condemned com
mitted was worse than murder. He b|d
bettor havo killed his victim. He had
outlawed hiniRolf. Ho showed no moroy,
and deservod nono.

Goodman's Cross Boads, on Saturday
night, was crossing the mountain on his
return from Columbus where he had sold
ootton, two white and throe colored men,
armed with olubs, robbed him of $157.
The white men stood at the horses’ heads
and the negroes approaohed either side of
the buggy and one from behind who held
his Brms while the others searohed for
money. They threatened to kill him but
seemingly yielded to the intercession of
one of the negroes.

,700,000 bales. The war In the East, and the
olltlcal complications and feverish anxiety in

and goods find a slow sale at unremuneratlve

KELLY A LEON'S MINSTRELS.
Thoy played hist uight a programme
which was fresh iu minstrelsy. The
* ‘grand opening” was a bouquet of songs
and musio. “Soo that my grave is kept
green,” a boantiful song by J. II. Bar
ridge, was rendered in a most admirable
stylo. “The Koutuoky Hose.” sung by
Mr. Courtright and “Thoy all do it,” by
Edwin Lester, elioitod enthusiastic ap
plause.
Tho “artistic” double jig by Tierney
and Cronin boars not a misnomer. It
was exquisite.
Wm. Courtright as “Stuttering Joe”
and tho original iiowy-flewy was highly
enjoyablo. He haH a keen sense of the
ludicrous.
Tho “Belles of the Kitchen” was as
fine an aftor piece as we have ever seen,
if not the beat.
“A Fivo Cent Shave,” by Snrridge,
Japanese Tommy and Lester, was anoient
aud rather tirosome. Dwarfs are not in
teresting, though Tommy did create some
fun. With this exoeption, the entertain
ment was first rate. The jokes were new
aud very onjoyable.
Kelly A Leon present a minstrel per
formonoo different from all others. The
burlesque opera is alone worth all the
others oombined. In. this the aotors are
not blackened, and Leon still retains
traces of that voice which was once so
wonderful. It was humorous beyond de
soription.

The Mandrako Pills act upon the liver,
