I told him to go ahead. John T. Henderson commissioner of agri culture until the meeting oi the general .assembly. It is a four-years’ term, and one that is Ailed by the governor’s appoint ment, and the public do not understand why the appointment does not read for four years. Had the term expired during a session of the legislature the appoint ment would have been for four years, subject to confirmation by the senate. Occurring as it does, August 26th, it creates a vacancy in the ollicc from that date until the assembling of the legislature. For this intervening time, therefore, Governor McDaniel orders Judge Henderson commissioned at once, as there will lie no opportunity to have the appointment sanctioned by the senate. The appointment must be confirmed by the senate, however, before the commis sion for four years can be issued. Accord ingly when tiie legislature assembles Judge Henderson’s name will be sent in by Gov. McDaniel to the senate, and when the ap pointment is confirmed by them he w"‘ ' commissioned for the term of four year: dating from August 26th. A special to the Montgomery Advertiser from Birmingham dated August 2., says: A negro named Alex Peck entered the court house about 1 o’clock, and after depositing his ballot refused to pass out at the back door, as all voters were required to do. Deputy Sheriff Dave Brown attempted to compel him to go out that way, and the negro turned and struck Brown several blows on the head with a stick. As auick as possi ble Brown drew his pistol and shot, the ball taking effect in the left thigh. As soon as the report oi the pistol was heard, about two hundred negroes who were standing around the court house, made“a|"rush£to get inside, but were prevented. A negro named Morris Bates then called to the crowd of negroes to come on and get pis tols and fight for their rights. Mr. J. L.
