A motion was made in the United States circuit court yesterday by ex-Judge Horace Russell to dismiss the complaint of Alex ander Stewart and restrain him front bringing further suits against Henrv Hilton as an heir of the late Alexander T. Stew art. The present suit is brought by Beu- jatnin F. Whelden, as guardian of Mr. Stewart, and is an action to set aside a re lease given in 1881 by Stewart to Hilton of all claims against the A. T. Stewart estate. Ex-Judge Curtis, who appeared for the plaintiff, claimed that Stewart was a luna tic when he signed the release, and more over that the conditions had not been ■complied with, and a well-stocked farm, together with other considerations, had not been given as agreed. Ex-Judge Russell urgued that the action was not brought in good faith, but really was the intention of making as good a set- ' 1 " ' i possible. tlement out of court as j This was the third suit, each of the previous ones baying been dismissed for tack of costs. Ex-Judge Curtis admitted that two suits had been dismissed, but submitted affida vits from Mr. Wnelden showing that •whenever his former attorney, one Herbert H. Walker had asked him for money for costs he Bad given him $1000, which he now believed had been retained by Walker and the suits had gone bv default.
