A RAILROAD CASE.

Washington, October 27.—The supreme
court rendered its decision to-day in the
case of the Wabash, St. I/Ouls and Paolftc
Railroad Company, plaintiffs in error,
against the people of the state of Illinois.
The specific allegation was that the rail
road company charged Elder McKinney
36 cents per 100 pounds for transporting
goods from Pt ori.i to New York city, and
on the same day charged Isaac Bailey and
F. O. Hwannell 26 cents per 100 pounds for
the same class of goods from Gilman, ill., 1
to New York, Oilman being 8(1 miles nearer
than Peoria is to New Y'ork. The discrim
ination, it was alleged, was in violation of
the law of Illinois, which prohibits any 1
charge for the transportation of passen
gers or freight Within the state of Illinois
1 proportionately greater than would be
charged for the transportation of passen
gers or like classes of freight "over a
greater distance of the same road.”
The gist of the decision is contained in 1
the conclusion, as follows: “When it is at
tempted to apply to transportation through ,
a series of states, a principle of this kind, I
and each one of the stateH, or half a dozen
states, shall attempt to establish its own j
rates of transportation, its own methods to j
prevent discrimination in rates, or to per- j
mit it, tlie deleterious influence upon the
freedom of commerce among the states and
upon the transportation of goods through I
those stutes cannot be over-estimated. :
That this species of regulation is one
which must be, if established at all, of a
general and national character, and can
not be safely and wisely remitted to local
rules and local regulations, we think is
clear from what lias already been said.
And if it be a regulation of commerce, ns
we think we have demonslrated it is. and
as the Illinois court concedes it to be, it
must he of that national character, and the
regulation can only appropriately be by
general rules and principles which demand
that it should be done by the congress of
the United States under the commerce
clause of the constitution.”
The judgment of the supreme court of
Illinois, which was adverse to the railroad,
is reversed, and the ease is remanded to
that court lor further proceedings in con
formity with the above opinion. Opinion
by Justice Miller.
Judge Bradley delivered a dissenting
opinion, in which tin; chief justice and
Justice Gray concurred. In this opinion it
Is conceded that congress might, if it saw
lit, regulate the matter under considera
tion, hut not having done so, it is hold that
the state does not lose its power to* regu
late the charges of its own railroads in its
own territory simply because the goods or
persons transported have been brought
from, or are destined to, a point beyond
the state borders.

Shrieks run through the corridors of the
fourth floor of the fashionable boarding
house, and echoed down the elevator shaft
and stairways. There was a rush to room

wife of a day was lying, all disheveled,
drumming with her French heels on the
carpet, and sending forth scream upon
scream from her lovely throat. The hus
band, a small and elderly man with a beak
like an eagle’s, cowered in a eornor. He
was os pule as a corpse, and shook from
the top of his bald head to the ultimate
toes of his large ioet.
Agitated ladies foil upon the bride,ripped
mysterious strings and jerked hidden but
tons from their fastenings. They chafed
her jeweled and shapely hands, and threw
water into her fair young face, regardless
of the consequences to the new mauve
wrapper, with a Watteau pleat.
“What is it, dear?”
"What has ho done?”
“Did he beat, you?”
“Did he choke you?”
“Why did you marry the villain?”
These were a few ot the questions that
rattled upon her like a charge from a shot-
gun.
The bride struggled to a sitting position
and, glaring wildly at the corner where
the little man shrank and shivered, pointed
a trembling linger at him.
“Ho deceived me—he—that maul” she
gurgled.
“Yes! Yes! How, dear? How?”
“Ho said he was worth $303,030.”
She shrieked again.
“Veil I” roared the little man, goaded by'
the stabs of dozens of indignant and loath
ing eyes. “Veil, vot of it? Shu wouldn’t
hov me mitout!”
“He’s only,” sobbed the bride, “he’sonly
worth f201)3!”
“Monster!”
This by a chorus of twenty.
And the pauper husband returned cowed
to his corner, and observed in miserable
silence the practice of the art of bringing
a puro sealed and suffering woman out of
a fit of hysterics, without medical assist

Said corporation to have power aud authority to
sell, lease or rent itssuid water power, lands, ma
chinery, lacto ies and buildings, or such parts ar d

sons or ot her corporations as it may deem fit and
proper; and to advance from ils corporate capital,
funds to such persons or corporations as may oc

State; but it shall have authority in pursuit of its
said business and promotion ol its objects to es

exercise its rights and franchises heretofore men
tioned, and to build actories, make improve
ments, contracts, agreements, investments aud

afore mentioned with regard to its property and
upon the lands and property which may be here
after acquired by said corporation in the State of
Alabama, und at such other places within and
without the limits of said States of Georgia and
Alabama, as its objects and interests may re
quire.
THE CAPITAL STOCK
of said corporation shall be one hundred and fifty
thousand dollars, payable in money or.property,
as said corporators may determine, to be divided
into shares of £100each, of which amount ten per
cent, thereof shall be paid in before said corpo
ration commend s to do business; and petitioners
desire s«id corporation shad have authority to in-'
crease said capital stock from time to time as it
may deem ht and proper to any sum not exceed
ing one million dollars,
They desire said corporation to have the power
of suing unci being sued; to have and to use a
common seal, and to alter, break and change the
same at will; to make rules and by-laws lor the
management of its business, not in conflict with
the laws of this State und the United States, and
the same to alter, amend and rescind at pleasure:
to receive, lease, rent or purchase and hold such
real estate and personal property as may be now
oi hereafter necessary for its corporate purposes,
for the expansion ana advancement of its objects,
for the securing of debts due and to become clue
to said corporation, and the same to sell, mort
gage and convey ut will.
That it have power to effect loans and to issue
bonds in the name of said corporation, without
securit y or to secure such bonds by mortgage ol its
property, real and personal, or of such parts or
portions thereof us may be desirable; and to loan
out its surplus earnings upon mortgage or other
available security.
To elect and appoint such officers, managers,
directors and agents as it desires; and to provide
such rules and regulations with respect to stock
holders who refuse to pay up any balance, due on
their stock as will compel them to pay upon pen
alty of sale or forfeiture of such st ock, and to do
and perform all such act s as are necessary for the
execution of its powers and to carry out the ob
jects and purposes of this corporation.
The individual property of each stockholder
shall not be liable for - the debts, liabilities, obli
gations or default of said corporation except to
the amount of unpaid stock subscribed by such
stockholder.
Wherefore petitioners pray that they, their as
sociates and successors be duly incorporat e d un
der the name as aforesaid for the term of twenty
years, with the privilege of renewal, with all the
P were herein prayed for, aud with such oilier
powers aiul privileges as are incident to corpo
rations under the laws of this state, and that af
ter the filing, recording and publishing of this
petition, as provided by law. tlie Court will pass
an order declaring this application granted.
