whether the cigar boxes held for sale, ar.d
being sold by the defendant, with the
marks, devices arid designs thereon, are
such colorable imitations of the complain
ant’s goods as to be likely to deceive or
mislead purchasers to tne injury of com
plainants, being for the jury on final hear
ing of the bill, an irreparable damage not
being probable, there being no charge
that the defendant is insolvent, there was
no error in denying an interlocutory in
junction. Injunctions in restraint of trade
should be sparingly granted before final

Blandford, J.—Prior to the Constitu
tion of 1877, if the property of one I
were damaged by the buiding of i
sewers and grading of streets, unless
it was done unskillfully, it was dam- |
num obsque injuria, and the provision in |
that Constitution as to compensation for
damage to private property as well as for
its taking for public use, did uot make that ,
a nuisance in law which was not a nuis- ,
ance before. Hence a suit for damages, |
both past and future, must still be brought I
within four years for the doing of such !
work by the city. As there was no origi- j
nal nuisance, there could be no continu- I

Drift- into a Bridge
The steamer Amos Hays arrived at the
wharf from Chattahoochee early yester
day morning. The boat wa3 bound for
Apalachicola, but in consequence of seve
ral accidents, the cargo had to be trans
ferred to tne Fannie Fearn at Chattahoo
chee. Besides the accident to her wheel
and machinery at Snaae Siioales, on the
down trip, by a log getting entangled in
the paddles, the boat met with a second
and more dangerous accident near Chatta
hoochee. From Snake Shoais down to
Chattahoochee, only one engine couid be
used.
Just below the junction of the Flint and
Chattahoochee rive s the second engine
gave out. The boat then drifted down at
a rapid pace until it struck the Pensacola
and Alabama railroad bridge. The bridge
was not high enougn for her to pass un
der. and the exhaust pipes Were torn awav.
At one time it seemed as though tne ofii
cers’ rooms, pilot house and smoke stacks
would be demolished likewise.
Captain Marcrum was in the pilot house
at tne time, but when the danger became
imminent he jumped out and made for the
second deck. In his haste he stumbled
and fell, sustaining severe bruises and flesh
Wounds. All the crew were preparing for
a general and hurried exodus from the
steamer, but fortunately the officers’ quar
tere did not give way, and the boat was
thus fastened in the bridge. The ‘‘Texas’’
of the steamer was materially damaged
and otner injuries sustained.
ALer a world of difficulties the boat was
rescued trom her perilous position. Her
machinery and wheel were promptly put
in repair.
When she arrived at the wharf yesterday
mornine she had a very heavy load of cot-
ten, a miscellaneous freight and a number
of passengers on board. The cotton was
consigned as follows: Blanchard, Humber
& Co., 48 bales; F. J Jenkins & Co.. 45: Car
ter & Bradley, 71;Slade & Farish, 17:Fluor-
noy ifc Epping, 81; Eagle and fffienix
Manufacturing Compam, 75; Perry Spen

A Sad Death at Ty-Ty,
Ty-Ty, Oct. II.—Death has again visited
our county; this time the family of Mr. J.
B. Hanou has been robbed of one ot its
bright members. Daniel, the youngest
sou of Mr. Hanon, died yesterday after a
long seige of wh aoping-cough. rfe was a
very promising young m in, about 18 years
of age. It has been out a short time
since Mr. James Hanon, an older son of the
same family, died very suddenly. The
sympathy of the entire community goes
out to the old gentleman and his wife and
to the brothers and sister of the deceased
young man.

Mr. T. M. Maund, of Dawson, has again
moved to this place. He was for several

Simmons, J.—1. Where a railroad com
pany receives freight for shipment and its
employes strike or cease to work for the
company, it is still bound to forward the
freight within a reasonable time;
but if the strike is accompanied with vio
lence and intimidation, so as to render it
unsafe to forward the freight, the com
pany is thereby relieved from liability for
delay, especially when the resistance made
by strikers is of such a character as
j could not be overcome by the company,
or controlled by the civil authorities
when called upon by it. Geismer vs. Lake

2. If the proceeds of flour, sold when it
did arrive, although unusually delayed in
arriving, were sufficient to pay the amount
of the draft advanced by plaintiff upon the
faith of its shipment, he couid not recover
in this action. Profits he anticipa’ed mak
ing at the time he made the advance could
not be recovered by him from the railroad
company.
3. The bill of lading for the flour not hav
ing been endorsed to plaintiff by the party
in whose favor it was issued, the former
! could not maintain an action against the
( company upon it.

i Honorable, the Superior Court of said County;
j The petition of M. M. Moore, G. Gunby Jordan,
E. H. Jenkins, F. C. Reich and C. A. EtheredKe,
all of said C' Unty, showeth that at the Novem
ber term. 1868, of this honorable court, a charter
: was duly granted, incorporating “The Rescue
! Hook and Ladder Company” and that the period
of the charter will eipire on the 28th day of No
vember next. Petitioners aver that they are
stockholders or said corporation and for them
selves and their associates desire the renewal of
their said charter to be named and styled ‘The
Rescue Hook and Ladder Company,” to be lo
cated in the city of Columbus in said county, for
the purposes usually and generally incident to
associations of said kind under the fo lowing re
strictions and immunities;
1. That said Rescue Hock and Ladder Com
pany shall consist of not less than forty nor more
that- one hundred members, with power to elect
from themselves such officers to command them
as they may deem expedient and necessary: all
members of the same to be citizens of the State
and inhabitants of the city of Columbus, except
as hereinafter provided for.
2. That all the officers and members of said com
pany shall be exempt from militia duty, except
in times of alarm, insurrection or invasion.
3. That said company -hall have powerto make
such by laws, rule s and regulation for its govern
ment as <t may deem proper—provided that there
be nothing in such by-laws, rules and regula
tions inconsistent or in any wise in conflict with
the acts of incorporation of the city of Columbus
or any ordinances passed by the constituted au-
