is rather difficult to cumpreheud just now.
We know this much, that Governor Reed
is out and that Lieut. Gov. Day is iu; und
further, that the High Court, to-wit; the
Senate, has adjourned without uppoiutiug
a day for thu trial, notwithstanding tho
respondent demanded trial and declared
himself teady. And right hero arises a
nice question which will probably be tak
en before the Supreme Court, now* in ses
sion, for adjudication. That question is,
the rcBpouduut having been arraigned and
pleaded not guilty to the charges, uud tho
Court having udjourned without day—for
tho adjournment is in point of faot sine
dir—whether this adjournment uuder tho
circumstances does not opernto qh on ac
quittal of tho accused?
Wo believe that some of our best law
yers take the ground that such is the case.
It is evident that the Senate by adjourn-
lug without fixing a day for tho trial has
put it beyond its power to try tho ease at
all. That body, unless tho acting Gover
nor shall aeo proper to convene the Legis
lature in extra session, Is funrtvs oftieio.
It omuot convene itself, and oaunot, con
sequently, without the exercise of discre
tion in au officer who, by the Constitution,
has uolhiug to do with impeachment
trials, discharge a duty whioh the Consti
tution ilupuses upon it.
A great doal muy be said on both sides
of this question, doubtless; but however
it may he deteimiued, it is quite pluiu
that the Assembly aud its managers huvo
mixed mutters aud got them iuto a pretty
muddle. It would be a singular ending
of thu proceeding if, after a series of
charges involving a degree of guilt iu tho
accused kuffioiuut to stud him to the Pen
itentiary, subsequent bungling on the
pail of tho proseeuliou should result iu a
technical acquittal uf the respoudeut snd
his restoration to the Executive chair.
