Velocipede Run—Mr. W. A. Huff, onr great
oora and iwovimon dealer, has secured the iron
warehouse on the comer of Second and Poplar
streets, lately occupied by Wooifolk, Walker 4 Co..
for the purpose of converting the interior into a Ve
locipede Rink, for the amusement and exercise of
~® festive denizens of this town. He will immedi-
diAte, y ky * rtnooth plank track in the building, cir
cular in shape and about 18 feet wide, and when
completed will be one of the nicest, largest and best
establishment of the kind in the country. An ex
perienced rider and teacher of the velocipede will
he in Macon on Wednesday next, with about a dozen
of the bicycles, and so soon as Mr. Huffs rink is
ready, will give instruction to all who may desire it.
Mr. BoifeuDlet also proposes to open a rink in
this city in a few days, where ladies and gentlemen
may spend a most pleasant and profitable hour in
teeting their capacities for sporting a velocipede.
He will conduct the rink in a refined and orderly
manner, and allow no rowdyism or profanity about

PiiFTTT Girls.—This is a subject upon which
loyal Bendicts are prohibited, we believe, from pass
ing an opinion; hut as a faithful chronicler of cur
rent events, we must allude to the presence, in this
city for several days just past, of many of the pret
tiest young ladies from Alabama and different sec
tions of Georgia, that ever made the track of a
No. 1 slipper in our dost. The effects and fruits of
the Baptist Convention will be felt and seen for
many days hence, as we know several ardent swains
who are sighing most piteously as the day of ad
journment draws nigh; for they know that with the

Augusta. May 10.—The coid weather of the past
week haa injured crops in this section. The cotton
plant is dying out on sandy lands. It w feared tbe
stands will be destroyed and the crop hare to be re
planted. which will make the season late.
The city is full of visitors from all parts of Middle
Georgia, in attendance on the convention of Geoijjia
railroads.

New Gnu*.—The authorities of the city are
now having dug, at the intersection of Third and
Poplar streets, a large cistern from which tbe fire
engines of tho city can obtain water in case of fire
in that immediate neighborhood.

back of our left hand. So it is now time to bo look
ing after insects and small bugs. The big-bugs and
humbugs abound at all seasons.
Macon and Angaria Road.

We regret to loam that the report which we
published some few weeks since in relation to
tho negotiations for an early completion of this
road has not been realized. Onr information at
the time was of snch a character that we felt
satisfied of its truthfulness predicated upon an
inspection of a telegram to interested parties.
The parties who it was said had stepped for
ward in aid of the road were themselves so di
rectly interested in its completion, and withal
ao able to raise the funds necessary to accom
plish that remit, that we felt quite confident
the road would be pushed to completion at an
early day.
Our information was to this effect—the bonds
of the Macon and Augusta road were to be en
dorsed by the Georgia and the South Carolina
Railroad Companies and negotiated in New York
for a sum sufficient to complete the road from
MiQedgeviUe, its present Western terminus, to
Maoon. If these two latter companies would
endorse tho bonds note, we are informed the
money can be railed on them in a few days to
finish the road. We are unable to perceive any
good reason why snch an endorsement should
not be made. The road it already completed
toHilledgeville, a distance of about fifty miles,
and in excellent condition. A large portion of
the grading has been done between Miiledgeville
and Macon—tbe entire distance between those
points being only about thirty miles, twelve of
whieh are gRtfed. When completed, it is the

Kobe Hill Cexxteet—We spent an hour or two
yesterday afternoon, in walking through this roman
tic and beautiful place, with several ladies from'Ala
bama, on a visit to tbe city, daring the Baptist Con
vention. and it annoyed ns and other* not a little to
find that not one of the several cool and delightful
spring* within the enclosure of the cemetery is
supplied with a dipper, cup or gourd to drink from.
We hope those who have the cemetery in charge
still immediately attend to this matter, whilst so
many stranger* are in the dty. A dflbar or two will
supply all tho springs with a cheap cup or dipper,
that will be a great convenience to tboeo visitors
who would spend an boor in one of tho most beauti
ful cemeteries in the South.

rkheat scenes occurred out on Third street, about
sun-up, a few mornings since that has been wit
nessed in that neighborhood for years. It was this;
Old Aunt Easter, a colored woman living in that
part of town, has a refractory son about eighteen
years old, named George. He had ran away from
her til day on Friday last, and had slipped into the
house late at night to sleep. Early next morning
bis mammy quietly entered the room and appropri
ated all of his clothes, even to tho shirt on his bdkk,
and went out to get her cowhide or hickory to give
him a little “parental larrupping.” On returning to
the room she found Georgo was up and alive to the
emergency. She gavo him one keen cot and though
perfectly nude aa he was, ho bounced out of tbe
door and into the street, and his mammy after him,
calling to those in front of George to stop him.
They succeeded in doing eo after bo bad ran about
three squares and squalling every jump as if he
were on fire. He was marched back to bis
parental roof, and bis mammy tied him up and gave
him just such a thrashing as no nigger has received
in this section Bince the dose of tbe war. Served
him right.
Boosxrs'a High.—It is currently, though not au
thors tively, reported that spring chickens havo been
roosting mighty high for tho last week within a cir
cuit of about ten miles around Macon, and that when
the precocious little bipeds aro forced to come down
to replenish their craws of a morning, they behave
like so many young partridges—take to grass and
are very shy.
We do not know whether this is so or not; but
we do know that when one of tho little rascals
is caught and offered for solo in market, it com
mands a fabulous price. Wonder if they know the
city Is full of strangers who like them for break
fast?

Major’s Court.—Three fights were docketed for
settlement in this court yesterday. Two were con
tinued and the third dismissed.

that it will pay handsome dividends. At any]
rate, the road would bring at any time, if ex
posed for sale, a sum much larger than tho
amount now required to finish it Tbe risk,
therefore, whieh would be token by an endorse
ment of its bonds would be alight, while tho
benefits to be derived from such endorsement
would be immediate and important. *
There is a painful rumor on the streets to the
effect that Mr. Wadly is negotiating with Judge
King to prevent tho completion of the road.
It is said that Mr. Wadly will aid tho Georgia
Road in constructing tho line from Athens to
Rabun Gap, provided the latter road will not
aid or assist the farther prosecution of the Ma
con and Augusta Road, and the Central Road
refrain from building the road from Eatonton
to Madison. How much, if there in any truth
in this rumor, we are not prepared to say. We
know that it is freely talked about, and that very
generally when there is ao much smoke there
must be some fire also.
But, independent of the aid of the Georgia
and of the South Carolina Roads, this great and
important work could and would be completed
by individual effort and means, if the pubho had
the least confidence in its President and Directo
ry. The President, and we believe four of the
Directors of the Road, were put in office merely
because they were scalawags, neither of them
owning a single dollar of the stock of the com
pany. By the charter of the company none
I but bona fide stockholeers can be Directors.
Wo believe that Conly, Blodgett 4 Co. were
elected on the ground that, being members of
the City Council of Augusta by military ap
pointment, they could represent the stock of
tho city. These men are no longer members of
Council; neither do they represent, in any re-|
speet, the sentiments or feelings of the
of this city. But so long as they remain in coTl
trol of tho road tho people will not lend their
aid for its completion. They do not possess
the confidence ot any one. It is generally be
lieved that if moneys were placed in thir hands
they would not bo judieioutlf, if ionetlly in
verted. Indeed, this want of confidence is so
strong as to prevent stockholders from. paying
np the installments due on their stoefc.
The Attorney of the road has, within a few
days once, given public notice that unless tho
amount of stock called in is not promptly paid
he will press its collection by suit. From our
knowledgo of the list of stockholders, such
threats would be unnecessary if any assurance
could be given to stockholders that their dues
would be applied to the legitimate purposes ot
the road. As the matter now stands, as anxious
as we are for the completion of the road, we
would advise our friends not to pay another dol
lar on their stock until a legal and competent
board of directors are chosen to manage the
company.
As we have said, we do not believe that the
present organization is a legal one; and we are
quite sure that it is an inefficient and incompe
tent one. We ’might say mote, but it is not
Ineoesaiy.
In the meantime we invite the attention of
the stockholders to the subject of a change in
the President and Directors of the road. This
change run be effected, and if done soon, will
go far toward restoring confidence in the enter
prise, and, we believe, will secure its very early
completion.
Since the above was put in type, we are pleased
to learn that the City Council, at its meet last
night passed a resolution directing the Mayor
to take steps to secure an early meeting of the
stock holders in order to secure a change in the
management of the.road, and to devise means
for its early completion. This is a capital and
well-timed movement, and if the other parties
interested in the completion of the road will
promptly respond to this action of one City
Council, we may hope to have the road finished
in time for the Fall trade.
The Lynchburg (Va.) News of the 8th inst,
says the fly is playing destruction with the to
bacco plants in that section, and many beds
which were quite promising ten days since have
been totally destroyed.
The same paper says the mountain tops,
visible from Lynchburg, were covered with
snow on the 7th. Rather out of season we
should say. „

Thirty-nix typos, mostly veteran Washingtonians,
were discharged from office to-day.
It seems to be determined that the disfranchising
clause of the Virginia Constitution will alone be
submitted to a separate vote of the people. Sher
wood and the Virginia politicians predict that under
this plan, the Constitution will be defeated by an
immense majority, as the test oath and county or
ganization clauses are regarded equally odious, es
pecially the county organization danse, whieh will
involve a ruinous expense to the people of Yuginia.
It is considered certain that the election will occur
on the first Friday in July.

to any office in the Internal Revenue office, shall be
a solemn oath of total abstinence from intoxicating
drinks and cigars.
Eeakly, Stewart, Martin and McKenzie visited the
President today, claiming to represent the Conser
vative Republicans of Virginia. The only result
which transpired was the assurance that Massey, of

From Virginia—Important Decision of
Judge Chase.
Richmond, Stay 10.—Chief Justice Chase, this
morning, delivered an opinion on an appeal from
Judge Underwood’s decision in the District Court,
declaring null the sentence of Judge Shaffsy, of the
State Court, on the ground of 8heffey's ineligibility
under tbe fourteenth amendment. The case was
that of Caesar Griffin (negro) sentenced to tho peni
tentiary for shooting a man. The Chief Justice
read tbe opinion of the Court, holding that a State
government in Virginia had been recognised all
during tbe war by Congress; first at Wheeling, and
then at Alexandria. The action of that Govern
ment in dividing tbe State bad been recognized by
tbe Federal Government, and Senators and Repre
sentative* elected by that Government bad been al
lowed seats in Congress. It eras under this govern
ment that Bheffey had been appointed, and be was,
therefore, a legal Judge, as far as the State Govern
ment was concerned. The question now came up,
whetiMr, being ineligible, be was absolutely remov
ed by operation of the fourteenth amendment. Tbe
United States District Judge had decided that be
was; but in an examination of questions of this
sort, great attention is to bo properly paid to the
argument of inconvenience, and a construction
which must necessarily occasion great public and
private mischief, must never be preferred to a con
struction which will occasion neither in so great a
degree, unices the terms of the instrument abso
lutely require anch preference. Tbe opinion hero
shows tbe anarchy which would be produced in a
State by declaring past legal proceedings void.
It then considers tho character and intent of the
third section of the fonrteenth amendment, which
are declared to bo punitive. It ia clearly against
the provisions of the Constitution which deny to the
legislative authority the power to deprive any per
son of life, liberty or property vritbont due process
of law, or to pass ex poet facto laws; and these,
if there were no other grounds, are reasons for
seeking another interpretation of the amendment,
than that asked by the prisoner's ooonsel. Tbe
fourteenth amendment is not self-enforcing and
needs further legislation of Congress to enforce it;
and two months after the judgment now being re
vised was delivered, Congress passed a joint reso
lution providing for the removal of all Ineligible
officers, showing that persons then bolding office
were held to bo de facto officers; and also provid
ing tbs means for their removal by the military.—
The Court said the Supreme Court had unanimously
concurred In tbe opinion that a prisoner sentenced
iff a Judge, de facto, though not a Judge tic jure,
could not be reached by habcae eorpu*.
The decision of the District Court was reversed,
and Caesar Griffin was removed to the State author
ities in tbe United States Circuit Court this
morning.
Jeter Philips, to bo fating next Friday for wife
murder, upon habcae corpue, was remanded to the
State authorities on the ground that be was sen
tenced before the fonrteenth amendment was pro
mulgated.

New Om-eans. May 10.—Tbe balance of tbe in
dictments against Auditor Wickliffe were, this morn
ing, dismissed by tbe First District Court.
A mutual injunction was obtained by Auditor
Wickliffe and Delaasiso, Gov. Warmonth’a ap
pointee, which leaves tho Auditor’s office still with
out an incumbent. _
A duel was fought yesterday between a Spaniard
and a Caban, growing out of cries of death to Span
iards, in tbe recent procession of Cubans and their
sympathizers. The Cuban was badly hurt. The.
Spaniard was unhurt. A public challenge is pro
mulgated from tbe samo Spaniard to all who In
dulged in the criss. Another similar one is reported
as already arranged.

Atlanta, Ga., May 10.—Yesterday John Henry
Foy, Secretary of the Working Hen’s Association,
and late sub-clerk in the Executive Department of
this State, shot his negro mistress for wishing to
separate from him. Foy then shot himself twice
and said, “I have shot myself; come and kisa me, I
am dying." Foy was about 35 yean of age, well
educated and came from New York city. Strong
hopes are entertained far the recovery of the col
ored woman.
