As soon as an article purporting to be of utility
has been tested, and Us merits endorsed by public
opinion, unprincipled parties endeavor to replenish
their depleted purses by counterfeiting, and sub
stituting a spurious for the genuine article. Some
time siDoe, mercury, in the disguise of pills, pow
ders, Ac., was given for all diseases of the stomach

concert at the Cleburne Hall, opposite Byington'a
and Brown’s Hotels, on Fourth street, to-morrow
(Monday) evening, and we are informed that some
of the very best vocal and instrumental music will
be rendered on tho occasion. Programmes, etc.,
will be distributed to-morrow, in which full particu
lars will be given. From what we can learn from
those who are posted, it will be one of the best things
of the kind we hare had in a long while. The
strictest order and decorum will be maintained by
the city police, and nothing will be tolerated that
would offend the most fastidious.

Sot known there was but a small crowd attended
the sale of city lots yesterday, and, as many of the
lots failed te get a bid over the value at which they
were aeaeeaed by the commissioners on public prop
erty, they were not sold. The terms of the i
were half cash and the balance on the first of Janu
ary, 1870. The following lota receiving bide over
the aeseesed value were sold. They are situated in

Accidxxt os the Central Railroad.—The up
passenger night train from Savannah, on Friday
night last, met with an accident at Station 8%, about
105 miles from the city, by which the whole train,
except the locomotive, was thrown from the track.
Several can wen demolished, but no lives were
lost. A abort train of can left here about noon
yesterday, for the scene of the accident, and to
bring up the passengers and baggage.

The Pio-Nkl—We have only space to say that the
pio-nic yesterday at Hunter's, was largely attended
by the young people of both city and county, and
that they spent a most delightful day in each other’s
company. Miller's string band kept six or eight
cotillions going all day, and the tables at dinner
time was spread with all the substantiate and deli
cacies of the season.

Washixgtox, June 5.—Gen. Grant has appointed
Charles B. Mobley. Attorney of the Southern Dis
trict of Florida. John Lynch, Surveyor General of
the District of Louisiana.
Admiral Hoff reports from Hatanzas of tho 27 th
that a feeling of animeeity between the volunteers
and the Cuban element is much lees than be had
been led to believe when at Havana on the 20th. A
stranger would not suspect a revolution to be in
progress.
Lieut. Commander, Eastman, reported that the
Railway to Puerto Principe has been repaired and a
locommotive and freight cars came down to Newvi-
ai a alow rate, taking three days to make forty-
sight miles. They were guarded by two thousand |

attacked the convoy of a tratn and defeated them—
destroying the bridges built by the Spaniards, and
captured forty-three officers and men including a
Colonel. This is the only decided success the Bevo-
Ivtioniata have lately had.
The removal of Gen. Lisca by the Government,
and the appointment of Gen. Letma to succeed him
gives great dissatisfaction. In consequence of the
successful landing of expeditions in the district of
Gnantaniria, and the defea(*of the Spaniards in a
recent engagement, and then the insurrection had
been greatly strengthened and new life infused into
when to all appearances it was dying out two
weeks previously.

Charles Langson, colored, has been appointed to
the mission to Liberia.
■in the case of James Weaver, a citizen of Texas
tried for murder, convicted, and sentenced to be
bnng, by a military commission—the Attorney Gen
eral has given an opinion, in which ho reviews the
reconstruction laws and the duties of a command
ing officer, and says: “ As the State of Texas had
not in September of 1888, and has not since, adopt
ed a constitution in conformity with the provision
[of the act of Congress, and has not beoome entitled
■ representation in Congress, the act was operative
in Texas at the time the militxiy commission was
organized for the trial of Weaver, and the com
manding General exercized the discretion entrusted
to him by the third section by deciding that it was
necessary a military commission should bo oiganiz-
for the trial. If, therefore, the statute of March
2d, 1867, is a constitutional and valid statute, it
then appears that the jurisdiction of tbs said mili
tary commission was complete, and that there Is do
[legal obstacle to the execution of the sentence.”
■The Attorney General maintains that the right of
war did not necessarily terminate with the cessation
of active, actual hostilities, and not until the work
of restoring the relations of peace shall have been
| accomplished, can it be so considered. It is for

article is to ascertain what is thought of it at home
where it is manufactured. 8uch a test Lippman's
Pyrafoge can well stand, as to-day it is decidedly
the favorite remedy for chills and fever, dumb ague
and other diseases of a malarious origin, to the city

Keep orr the Track.—An old negro man, saun
tering along on the Southwestern Railroad track,
yesterday afternoon, came very near losing his life
by hia carelessness. He escaped, however, with
only a broken arm. The passenger train was on a
curve and down grade, and the engineer did not see
the old negro until the locomotive wee within twen
ty or thirty steps of him, so be was knocked heels
over hoed from the track. * The train was stopped
as soon as possible, end be wee taken on end brought
to station one, where he received medical aid.

‘She Flu the Track.”—A crowd of several bun
fired persona assembled at the Race Track yester
day afternoon to witness a half mile dash between
the two young mares, “Kate Spears” and “Jones
County Scratch,” for a puree of 8500. There was
considerable smell side-betting before tho nags
started; and “Scratch” seemed to be the favorite by
a majority of tho crowd; and to nearly every in
stance where choice was given she was chosen aa

About 4 o'clock, preliminaries were made and the
nags catno to the “scratch,” both looking to good
condition and everybody elated with the prospect of
seeing a close and fast race. The signal for a start
was soon giyen and both nags got off well; but with-
the first hundred yards the “Jones County
Scratch” “Flu the Rack,” and ran nearly square
off at a tangent for nearly two hundred yards before
her rider, (s tittle negro child that should never
have been put upon her,) could rein her to. Mi
while Kate came to at a brisk canter, winning the
race and puree without even testing her speed.
Wo never saw a more indignant and disgusted set
of fellows than those who had ao liberally and cheer
fully planked up their “dough” on the Jones county
sorrel. They came homo satisfied that if she
couldn't “scratch gravel,” sbo had ‘ scratched” them
out of all their pocket change.

had left, a quarter-race for 825 was gotten up be
tween two nags on the ground, which afforded some
sport, but we could get no particulars.

Congress to determine when the war has so far end
ed that the work can be safely and successfully
completed. The Attorney General sees no reason
to law for withholding the President's approval of
tho findings.
During the argument, tho Attorney General says:
It is obvious that Congress, under the Constitu
tion, has no right, to time of peace, to subject any

Foreign News.
London, June 5.—Tho Jemperato speech of Lord
Clarendon to the House of Lords last evening, on
the subject of the Alabama treaty, elicited the fol
lowing comments from the London journals this
morning:
The Times says: “For our own pari, considering
the demands of America and the ready concessions
of England, wo wonder the latter got off so well.
The rejection.of tbs treaty waa more a lucky
chance than the result of the firmness of anybody
engaged to behalf of Great* Britain.”
The Standard says: “The negotiations for the
Alabama treaty failed because America never in
tended them to succeed. If England now admits
that it ia her duty to renew her efforts for a peace
ful settlement, it is without hope. Our honest de
sire for such a settlement will not be appreciated
but by a email portion of the American people.
Meantime, until the details of Mr. Motley's mission
ere known, we should fold our hsnds'and limit our
compliments to him ss a great historian.”
The Star says: “The Americans can no longer
doubt our readiness to do them justice, or our de
termination to preseive our national character and
credit.”
Madrid, Jane 5.—Admiral Topeto read Dulce's
telegram, announcing his resignation as Captain-
General of Cuba, before the Cortes, last evening.
Great excitement prevailed. Marshal Serrano asked
for a suspension of judgment until' the arrival of
Dulce, and until the particulars to tho matter aro
known. It is rumored that General Dulce was re
called on account of his lenity to tho Cuban insur
gents.

Auocraa, June 5.—The Elberton Gazette states
ia its last issue that an insurrectionary plot has
been disclosed by a negro, having for its object the
burning of the town of Lexington, the county seat
of Oglethorpe county, and the massacre of its in
habitants. The sheriff and posse, to arresting the
negreee implicated, were resisted by one, whom they
shot and killed.
