Editors Telegraph: I cannot refrain from
giving expression to the favorable impressions
made on my mind dnring a recent visit to Mon
roe and Bibb counties. I found everybody hap
py, contented and employed in the different
pursuits of life, apparently indifferent to its
cares.
At a pie-nic at Dr. Hunter's, I have rarely, if
ever, met with such a refined and elegant peo
ple. If acountryistobejndgedbyitscitizens,
Monroe and Bibb deserve to be song by the im
mortal bards. I have always thought there was
a striking analogy between every country and
Us people. The one gives character to the oth
er-illustrating what is natural and beautiful in
a country, influences the taste and manners of
its people. Hospitality and generosity are dis
tinguishing traits of Georgians. Nowhere will
you find theso more strongly developed than in
this people. Like their hills, they rise into
grandeur, and, departing, we leave them with
the sweetest memory.
But to the pio-nio. We cannot forget its
pleasant associations. It was a bright day that
bronght so many hearts together, rejoicing.
The beauty of country girls vied with tho taste
of city be lift. The gents from tho rural dis
tricts mingled indiscriminately; and oh! what a
dance wo aid have. The Macon band and harp
were there, and with sweetest music filled the
air. I have studied with pride tho architecture
of your citj—its hills Btudded with palaces of
ease and pleasure—Lnd thought there .must bo
some hidden beauty where thcro was so much
external splendor; but then, did I little dream
of issuing from its rosy bowers a little faiiy
queen. The others were angels, but this one
was a fairy queen. With her soft eyes meeting
yours, you would feel her willing subject
I cannot give her name, *

And painful still to love
“And not bo loved again.”
Among those whom I know and most promi
nent, I may mention General Holt and family,
whose good humor is an acquisition on any oc
casion. The General is vory popular over our
way, as the President of ono of the leading rail-

on red lands, from cold. From appearances
I should conclude fertilizers were extensively
used.
We have had a slendid rain in Talbot, and our
crops never looked better. *

attorney’s lien, from Webster.
McOay, J.—Tho lien of an attorney for fees,
on papers in his hands, on tho judgments he
has obtained for his client, does not operate so
as to prevent a bona fide settlement by the de
fendant with the plaintiff in full, provided there
was no notice to the defendant not to pay with
out reserving the fees; and provided, also, tho
settlement was not mnde with intent to defeat
tho attorney in collecting his fees.
Judgment affirmed.

Warner, J.—When a bill was filed against an
executor by a creditor, praying for An injunc
tion and tho appointment of a receiver, ollcdg-
ing that tho executor was insolvent, unmarried,
extravagant, engaged ixt no settled business,
and intending soon to remove to Honduras,
and was badly managing his own business, as
well as that of his testatrix, that ho said he
wonld sell the property of his testatrix, realize
the money, and leave without paying any of the
debts of the estate. Held that the Court below
erred in dismissing the complainant’s bill upon
demurrer thereto for want of equity.
Judgment reversed.

Warner, J.—When, upon tho trial of a cause,
a mortgage deed, which had been recorded, was
offeredin evidence, and was objected to on the
ground that it did not appear to havo been
stamped, and the party offering the mortgage
deed proved that the deed had been stamped
according to law: Held, that the Court should
have submitted tho question of fact to the jury,
under the cvidenco whether tho deed had been
stamped or not, as required by law, under tho
charge of the Court upon that point.
Held, also, that when the deed, showing a
settlement between the parties, was offered in
evidence, the Court should have left the ques
tion to the jury ns to whether the deed was de
livered or not, under the evidence contained in
the reooid, and have charged the jury as to the
law applicable to that point in tho case. When
there is evidence as to the delivery of a deed, it
is a question of fact for the jury and not for the
Court to decide upon the fact, whether there
has been a delivery of the deed.
Held, further, that where an instrument is
offered in evidence, required by law to bo
stamped, and, by the act of one of the parties,
the stamps are prevented from being put on the
deed, the party so preventing shall not be held
objecting thereto; but, if the Court shall be sat-
iaiied that there was no intention to defraud tho
Government of its revenne, the Court may, in
such a case, allow the proper stamps to be
placed on the instrument, at the time of the
trial.

Warner, J.
1. When a suit was instituted in the oounty of
Early, against L. andP., alleging that they were
partners, L. residing in the county of Clark,
and a short time before the session of the Court
in Early, at which the case was tried; F. died,
the defendant's counsel moved to continue the
case as to L, the alleged surviving partner, upon
the ground that the partnership was denied, and
that the survivor, L. had rebed upon the evi
dence of P, the decedent, to disprove the alleged
partnership; but, in consequence of the sudden
and unexpected death of F, there had not been
time to procure the evidence of L, the other
partner, who lived in the county of Clark, to dis
prove the alleged partnership. Held, that the
Court erred in overruling the motion for a con
tinuance upon the showing made therefor as
stated in the record.
2. When one of two contracting partners is
dead, the plaintiff can not be a witness against
the surviving partner to prove a contract made
with the deceased partner.
3. A plea denying the existence of a partner
ship is a plea in bar, and although sworn to, is
not a dilatory plea, which is required to be filed
at the first term of the Court. Judgment re
versed.

Scrofulous poison is one of the most destructive
enemies of our race. Often, this unseen and unfelt ■
tenant of tho organism undermines the constitution,
and invites the attack of enfeebling or Altai diseases,
without exciting a suspicion of its presence. Again,
it soems to breed Infection throughout the body, and
then, on some favorable occasion, rapidly develop
into one or other of its hidoons forms, either on tho
surface or among the vitals. In tho latter, tuber
cles may be suddenly deposited in tho lungs or
heart, or tumors formed in tho liver. These focta
make the occasional use of the Sarsaparilla as a
preventive, advisable.
It is a mistake to suppose that so long as no erup
tions or humors appear, thcro must be no scrofulous
taint. These forms of derangement may never
occur, and yet the vital forces of the body ue so re
duced by its subtio agency, as materially to impair
the health and shorten the duration of Bfo. It is a
common error, also, that scrofula is strictly heredi
tary. It does, indeed, descend from parent to child,
but is also engendered in persons born or pure
blood. Low living, indigestion, font air, licentious
habits, uncleanliness, and the depressing vices gen
erally, produce it. Weakly constitutions, where not
fortified by the most constant and judicious care,
are peculiarly liable toil. Yet the robust, also,
whose turbid blood swells tho veins with an appar
ently exuberant vitality, are often contaminated,
and on the road to its consequences. Indeed, no
class or condition can depend on immunity from
it, nor feel insensible to tho importance of an effec
tual remedy, v
