Warner, I.—When a matter in controversy,

three arbitrators, for their consideration and
judgment, and it appear* from the record that, |
after hearing and considering the evidence sub
mitted bv the respective parties, an award was
mode by'the arbitrators and returned to the Su
perior Court, as provided by the 4184 section of
the Code, and one of the parties suggested, on
oath, that the award was illegal upon several
grounds, stated therein, for the purpose of hav
ing a trial, before a special jury, as to the Y»li-
- Jity of said award, and the grounds snd specifi
cations set forth in said affidavit being demurred
to as being insufficient in law to authorize the
setting aside said award. JJAd : That the de
murrer only admitted the truth of such facts as
were teeU pleaded snd set forth in the affidavit,
and that to make such factsavailable against the
award; it ahould have been alleged in the affi
davit, that the facts set forth and complained of,
were the "result, either of aeeulent, mistake or
the fraud of Borne one, or all of The arbitrators,
or parties, or is otherwise illegal.” and the par
ticular illegal acts complained of must be speci
ally set forth, which, m law, will vitiate tho
award, otherwise the affidavit will be demurra
ble. The general allegation that the award was
contrary to the evidence before the arbitrators,
or without evidence, or that other proper cred
its were not allowed by them, etc., ii not suffi
cient to set aside the award, unless it is alleged,
and proved, that the award was the result,
either of accident, mistake, or the fraud of some
one, or all of the arbitrators, or parties, oris
otherwise illegal, ss where the arbitrators should
refer the matters submitted to them to chance,
or lot. The award of the arbitrators is final
and conclusive between the parties, unless it ia
attacked and set aside upon some one of the
grounds specified in the Code, and the affidavit
must state some one of these legal grounds, with
sufficient precision, so that an issue ran be
formed and tried thereon.

Brown, 0. J.—1. When a testator who died
in 1853, by will directed, that his execator cause
to be removed to a free State, and there eman
cipated his negro boy John, and that the exec
utor pey tho expense of his removal, and for
his reasonable support and schooling, until he
is put to a^trndo, and that when, it he do, he
reaches the age of twenty-one years, they in-
TOBt snd secure for his benefit, as they may
deem best, tho sum of three thousand dollars,
to be raised out of the estate. Held: That
such devise constituted a legal trust, which
neither oontravened tho policy ot the State at
that time nor at the present time.
2. It was tho duty of the executor to execute
this trust, and his failure to do so, till after
John was twenty-one years of age, and his de
tention in Georgia ss a slave by the Execntor,
did not destroy tho trust, or prevent its execu
tion at a later period. Equity considers that
done which ought to have been done, and di
rects its relief sooordingly.
3. Slavery having been abolished in Georgia,
and freedom having come to John, when he was
not permitted to go to it, as directed by the will,
snd promised by the executor, when he assumed
tho trust, he being eui juris, with the right to
litigate in the Courts of this State, may, in his
own name,(oaheis’OTer twenty-one years of
age,) proceed in a Court of Equity, to compel
the execution of this trust, in accordance with
the will, or os nearly so as the changed condition
of the country will permit, and to recover not
only the legacy as provided by the will, but such
reasonable oompensation, for the support and
education, which the will gave him, as the Court
may find to bo duo and unpaid.
4. While a freedman may, in the courts of
this State, enforoe any legsi equity which was
created in his favor whilo a slave, that did not
contravene the policy of the law, he cannot
maintain an action for injuries which he may
have received, or for wages on account of labor
done by him while ha was a slave.

brought, and pending the actio*, the parties
plaintiff and defendant settle the case, and the
plaintiff reoeives from defendant the amount
agreed upon in the settlement and satisfaction
for the injury, and the defendant at the time of
Buch settlement, has no notice of any claim of
plaintiff's counsel for fe«s for prosecuting said
snit, other than the pendency of such suit, the
defendant is not liable to pay the fees of plain
tiff's counsel, and the snit cannot be prosecuted
the came in of the plaintiff for the use of his
counsel for the recovery of their fees.

A Princess in • Beer Saloon^.
The New Orleans Picayune tells this story:
“Some years since the daughter of Prince
Henry of Reuss-Greiz, a small German princi
pality in the middle of Germany, became deep
ly attached to a young subaltern who command
ed the annual contingent furnished the army of
the King of Prussia. Of course all thought of
marrying him with the consent of the Prince
was ont of the question; but it was arranged
that the young Lieutenant should resign his po
sition in the army, and together they would es
cape to the United States. Embarking at Ant
werp, they came to New York, snd were mar
ried there. But being young and without expe
rience in the ways of the world, their little
means were soon exhausted, and they found
themselves in a strange land, friendless and in
poverty. They were afraid to communicate
with any of their countrymen, lest the arenm-
stoncea of their flight should become known,
and themselves arrested.
“Unacquainted with our laws, and supposing
that the authority of their petty prince was as
potent here as among the groin fields of their
native land, they sought obscurity and shrunk
from their names and station Being blazoned
abroad. At last, pushed to the extreme of pov
erty, the husband, who was on excellent musi
cian, obtained a situation in the orchestra at
Niblo'a Garden, bnt learning that inquiries had
been mode by the Prussian Consul of their
presence in the city, he threw up his engage
ment and came South, and in the summer of
1867 fell a victim to the yellow fever. His wife,
now left alone, and reduced to the extreme verge
of poverty, applied for and obtained a -situation
in a beer saloon in this city, where she now is.
“It is a strange episode in real life, but a true
one, and exhibits os no moralist could describe
the viaaitudes of fortune. She is now perhaps
25 years of age; small in stature, with an ele
gant symmetrical figure, and face decidedly
pretty. Her face is shaded with light brown
carlo, and her manners and conversation evince
one accustomed to good society. She displays
• good deal of reluctance in talking to strang-
ets, but once interested in conversation, she
becomes animated and engaging. She seems to
feel her questionable position very sensibly and
the slightest allusion os to what she was, and
is now, is sufficienkto provoke her to tears.' 1
