McCay, J.—In an issue formed to try the
genuineness of a recorded deed proposed to be
used as evidence, and affidavit is made that it is
a forgery, nnder section 2C80 of the Code, the
burdanrof proof is upon the party asserting the
genuineness of the deed, and the fact that the
deed is recorded does not furnish any evidence or
chango the onus.
2. Recitals in a private deed only bind parties
and privies, and those claiming nnder it
3. If evidence of title is permitted to go to
the jury, without objection to the proof of exe
cution of the paper, it is too late, after verdict,
to make the objection.
4. If one have written evidence of title to a
tract of land, and by his tenant, take actual
possession, and afterwards sell, by written agree

tinues, for some years, in possession in his own

dissolved by the defendant giving seenrity, as
provided in the Code, and the seenrity is or be
comes insolvent, the plaintiff may garnishee
again.
2. Under section 2027 of the Code of Geor
gia, it is the duty of a Court, when it has juris
diction of a right, and no specific remedy is af
forded by erpross law, so to monld its processes
and proceedings as to afford relief to the party
having the right.

day or two since where owners of the railroads
of your Stato had reduced the fare, in order
that persons desiring to do so might attend the
Commencements of tho various CoIIogcs of yonr
State. Many persons will, of course, take ad-
vantago of their circumstances, and, no doubt,
will have a pleasant timo at yonr institutions.
We have some persona in our city who are de
sirous of attending tho State University, and I
suppose many persons from other portions of
this State are also desirous of attending, bnt
their pecuniary resources will not permit it—
unless the fare on some of the railroads is re
duced. Can you not use yonr influence in onr

A Lkttir moil General Jordan's Command.
The Montgomery (Ala.) State Journal publishes
the following extract from a letter jnst received
from a young Alabamian, now with General
Thomas Jordan in Cuba:
We are now camped near Holguin, a most
beantiful place. Yesterday evening, at S o’clock,
the Spaniards attacked a part of onr lines, bnt
we repulsed them easily, and ran them into the
little town, under the protection of their heavy
guns. The loss in onr brigade, strong, was
nine killed and fourteen wounded. Lieutenant
George Stone of Nashville, was killed. The
Spaniards don’t fight as well as the Yankees.—
They oome qnick and leave quick. The boys
are all well clad and doing splendidly. We are
disappointed in not having received American
reinforcements before this. General Jordan is
popular, but very firm and decided.
Radicals In North Carolina.
Wilmington, July 19.—The Republican party
of this county has divided into two formidable
factions. Each wing has a candidate in the field
to fill a vacancy in the Legislature, occasioned
by the resignation of Gen. L. G. Estes. One
of the most prominent leaders of one section,
in a speech to-day, predicted bloodshed before
the campaign is over. Conservdtivee and Demo
crats take no part in the contest, and will run
no candidate. Either faction, composed almost
entirely of negroes, has nominated a white can
didate. It is fonnd necessary to station a strong
force at all stations. The mast bitter person
alities are indulged in by many of the speakers,
and several slight collisions have already oc
curred.
