To make juries in criminal crises judges o:
the law and the facts.
The bill provides th *.\ wbcreaa.by a recent
decision of tlic Suprcm : Court, juried are in
effect required to lake ilu: law n> given them,
the A scuibly do enact that juries shall be the
absolute judges of the law and the facts
after the charge of the court shall be given
to them.
Messrs. G-*odc and Simmons, of Gwinnett,
supported the Dill, and argued that as the
iracticc now was, judges had absolutely tbe
i ate of defendants in their hand-, and more
dignity should be attached to juries.
Mr. lloge opposed the bill. If passed it
would be most disastrous in its consequences.
It would in effect always create a reasonable
doubt in criminal cases. The attorneys
would then declare the law according to their
own interpretation, which interpretations
would always vary just as the causes of the
attorneys conflicted.
Mr. Bacon claimed that Judges were not in
fallible; how could they lie when even Judges
of the Supreme Court often differed in tlieir
interpretation of tin* law. Then should the
life of a hum in soul depend on the capricious
judgment of the judge?
Mr. Pou thought the bill was in the interest
of public safety, private security ami of hu
manity. It was intended to render explicit
and unequivocal the already cxialingqnovU-
ion of the Code.

To the General Assembly:
I would respectfully cull your attention to
a matter of very great importance to the
present and future of Georgia.
A proposition has been made to connect
the waters of the Mississippi river with the
Atlantic Ocean through the territory of Geor
gia. Tbc proposed route lies along the 3Iis-
sissippi river to tbe Ohio, up that stream to
the Tennessee, and up the Tennessee to
Guntcrsville. From this point it is about
thirty miles to Gadsden, on the Coosa river.
Across this narrow neck of laud it is proposed
to cut a canal connecting these two streams,
and thus opening at once the navigation of
the great rivci^of the West to Rome. Ga.
The survey of tills canal route has been
made by tbe United Slates Government and
the line pronounced eminently feasible. It
is believed that the Etowah river, above
Rome, can be so improved as to extend navi
gation thence to Carteravillc. From this
point to Macon a preliminary survey has also
liecn made by the United States Government
for a canal and the work pronounced entirely
practicable by the Engineer in charge. Thu*
the entire water connection can be made
through our State to the Atlantic Ocean and
the great rivers of the WesL
A bill granting aid by tbc general govern
ment to this important enterprise is pending
before Congress with good prospects of be
coming a law at no distant day. The need of
a direct and unobstructed water communica
tion between the Mississippi river and the
Atlantic ocean ha* long been felt as a nation
al necessity. Tbc routes at present cxiating
arc notoriously inadequate to the wants of
trade.- Beside* other grave objections they
ore closed by ice on nn avc age of five months
in the year; thus causing a serious in
terruption to commerce and involving
heavy losses to the producing sections. The
proposed route through Georgia will be free
from these obligation*. It is much shorter,
moic direct, aud will never lie obstructed by
ice, and being a rivrr route for much the
greater portion of the ware, will be much
cheaper than those where lake navigation
and long lines of canal are used. For these
and other obvious reason* the Georgia route
commends itself to the attention of the com
mercial world and especially to
people, who will be directly lienefittcd by it.
It is a well known fact, of course, that
transportation by water is the cheapest
known to commerce, and it is very confident
ly hoped that the oi>etiing of this route will
turn the great bulk of Western trade that
centers at St. Louis through our territory to
our own seaports, and thence to foreig
markets. This will of necessity create
large import trade in return. Tbe rapid de
velopment of our agricultural, mineral and
manufacturing interests and resources will
follow; the tide of emigration will be turned
toward Georgia, aud her increase in wealth
and population will l>c far beyond anything
she has experienced in the pasL
It is very desirable that the preliminary
surveys made by the government engineers
should be extended so as to determine more
fully the final locution of the line and its
bearing upon the commercial centers of our
own Slate, on*.' especially to determine tbc
possibility of opening some of our connect
ing stream* to free navigation. To this end
a thorough examination of the country and a
survey of the rivers should be made at the
earliest period practicable, and I earnestly
recommend the subject to your favorable

The Senate resolution prohibiting the
Treasurer of the State from paying a claim
of $ii.!)14 35 for which he had received an
Executive warrant, on account of work done
by said Cole in making Allaloona embank-
m-nt in Bartow county. -
Mr. Simmons, of Gwinnett, supported the
resolution in an earnest speech, in which he
guve-aclcaf exposition of Cole’s persistent
elTorts to recover the claim, after he had re
ceived $00,900 for culverts which he built for
the road, nnd which fell through before a
single engine ever psssed over them. The
claim had been rejected promptly liy every
Governor from Howell Cobb down to Bul
lock.
Mr. W. D. Anderson said if the claim was
just, it ought to be paid, if unjust, it ought
not to be paid, lie thought the House was
not prepared to vote upon the question, be
cause the facts were not known. He was
in favor of submitting the matter to the
Governor and the Attorney General with
certain instructions.
Mr. Pierce thought, since the committee
had reported both the facts and the law, it
became the duly of the House to net directly
on that report Tbe gentleman from Cobb
was persistent in ins opinion that tlic Slate
Roau lease should bo disposed of by the
House, but now he thought it proper to refer
a similar case to the courts.
Mr. Snead read some of the evidence of
Judge Hopkins, wherein he notonly testified
that he was convinced that the claim was un
just, hut tliat Cole was actually indebted to
the road.
Mr. Hail, of Upson, ofiered a substitute di
recting the Governor to reopen and review
the award rendered by David Irwin, John
Harris and D. P. Hill in favor of Colo for
$3,500, and also the decision of D. A.
Waiker, Benjamin Conley and George Hill
yer awarding to Cole $7,345, provided he
shall he of opinion that there exist legal
grounds for such proceeding.
Mr. Crittenden thought that they ought to
act directly on the report of the committee,
and moved to lay the substitute on the table,
which motion prevailed.

When he is called to sec a patient he does

tice, they use no costly medicines, bat catnip,
piuk-root, red pepper, composition tea and
lobelia. Hence it costs them leas, and they

from receiving interest on deposit! ov other
use of the seme.
Mr. Hoge opposed the bill He believed it
to be purely in tbe interest of the Georgia
Railroad. Moreover, tbe fact of depositing
in the Georgia Railroad Bank was no security
against loss, for the cashier of that bank wm
obliged to recognize the order of the Treasu
rer for any amount. The bond of the
Sheriu w.is the only sifeguanl.
