To determine this question it is necessary to look to the action of Congress and the President of the United States, suspending the privilege of that writ. By act of Congress, passed the 7th of June, 1802, entitled “An act for the collection of-direct taxes in insurrectionary districts within the United States, and j for other purposes,” it was made the duty of the i President to declare, on or before the 1st ol July then j next following, by hie proclamatio, in what States or I parts of States insurrection existed. Aucordingly, by proclamation dated July 1st, 1862, , the President declared the States of South Carolina, ! Florida, Georgia, Alabama, Louisiana, Texas, Arkan sas, Tennessee, North Carolina, and the State of Vir- ; gin’ia, except certain counties, to be in insurrection ' and rebellion. i By act of Congress approved March 3, 18G3, it was enacted: “That, during the present rebellion, the President of the United States, whenever in his judgment, the ] public safety may .require it, is authorized to suspend the privilege of the writ of habeas corpus in any case throughout the United States, or any part thereof." In pursuance and by virtue of the authority vested in the President by this act of Congress, he issued his i proclamation dated.Sept. 15. 13G3, and declared “the | privilege of the writ of habeas corpus suspended throughout the United States," and "that this suspen sion will continue throughout the duration of the re- belllon, or until this proclamation shall, by a subse- j quent one to be issued by the President of the United ; States, be modified, or revoked." The meaning of this proclamation is, that during j the rebellion, the President might modify or revoke ; his proclamation suspending the privilege of the writ of habeas corpus, but if not modified, or revokod, tile | suspension would continue throughout the duration | of the rebellion—and it maybe added that no sound, : sensible construction can make it extend any fnrthet out. The President of the United States, by proclama- ; tion bearing date April 2, I860, has declared that i ••standing armies, military occupations, martial law, f military tribunals, and the suspension of the writ of j habeas corpus are, in time of peace, dangerous to the public interest, and incompatible with the individual rights of citizens, contrary to the spirit of our free institutions, and an exhaustion of the National re sources, and ought not, therefore, be sanctioned or allowed, except in cases of war, or for repelling in- ; vasion, or for the suppression of insurrection or re- ; bellion,” and he then “proclaims and declares that ; the insurrection which heretofore existed m the t States of Georgia, South Carolina, North Carolina, ! Virginia, Louisiana, Alabama, Arkansas, Mississippi, j Texas and Florida, is at an end, and hene.eibfth to be i si»regarded. • j Therefore, there being no invasion, insurrection, or rebellion, the suspension of the writ of habeas corpus has expired by its own limitation. It was limited to the continuance of the rebellion, and cannot by any rule of construction, be made to extend beyond it. Any further proclamation by the President declar ing the privilege of the writ of habeas corpus restored is unnecessary. His declaration that the" rebellion is at an end, ends the suspension of the writ of habeas corpus, and it is incorrect to say that a proclamation of the President is necessary to restore the writ. The privilege of the writ of habeas corpus is a con stitutional right; it is not derived from an act of Con gress, or from a Presidential proclamation. IN GENERAL. —The other day the innocent inventor of a contriv ance for charging beer bottles visited Hamilton, Cen- ada, with a sample, but the frightened Canadians im mediately seized him for having “infernal machines" in his poaeession. —Three screw frigates have been placed in Cadiz harbor, ready for sea, in case of the appearance of Chilian privateers. —The Preaident has issued an order to the various Departments to withhold all advertising patronage from the Chronicle, Forney's paper. —For the first time since his illness, the Prince Imperial went out on the 21st of March, and played for an hour in the Empreaa’ resererved garden, with young Connean, son of the Emperor’s physician and friend. The following day he stood next to his moth er on the central balcony of the Tuillsries during the Emperor's review. The Prince still looks delicate. —The Pennsylvania House has passed a bill pro viding that colored persons shall not be excluded from the passenger cars. —The Tennessee State Representatives who with drew from their seats have nearly all been re-elected by large majorities. —The Rev. A. M. SUipp, formefly Professor of his tory and belles letters in the Universitiy of North Car olina, has become President of Woodford College, South Carolina. —The cholera Is said to have made its appearance In several districts of Germany. —It is statsd that one of the New York firms charged with the reosnt whiskey frauds has been assessed by the revenue officers for a deficiency of $150,000 in the returns. —The light of the burning of Pike's Opera House was seen by persons sixty miles sway. —-QnantreU, the noted Kansas guerrilla, is said to be X esiding in one of the West India islands, and hard at work. —William Lloyd Garrison wants to impeach Presi dent Johnson, and laments that be is not in Congress to do it. —Henry Ward Beecher compares the Radicals in Oongrass to monkeys in a cocoa-nut tree, pelting the President from a safe distance. —Tha Bangor Whig reports the most serious freshet tor years in the eastern part of Maine. A gentle man from Ellsworth says that they use cauoet to sail about thair cellar*) and navigate the streets in flat boats. —Barnum has been elected to the Connecticut Leg islature.
